Consumer Complaint: I live in a rental home that was leased from XXXX XXXX from XX/XX/XXXX to XX/XX/XXXX. When I rented this home, I gave XXXX XXXX a deposit of {$1000.00} dollars as well as a Pet Deposit of {$650.00}. I never missed a payment and was rarely late. The first thing that occurred was each time I had an issue such as a dish washer breakage, XXXX would raise my rent one week after by {$50.00}. This happened each time I reported an issue, and it soon went to {$150.00} per incident. After a while I learned not to report an issue. After that the house was lived in and I repaired any issues that arose. At the end of my lease in XXXX XXXX XXXX, I gave XXXX a 30-day notice by email as well as a written letter. During the month after the notice no one from XXXX wanted to walk the house or speak about the rental status. I had been offered a job in AZ and we moved quickly. I hired cleaning companies and XXXX XXXX to clean the carpets. This home was in poor shape concerning leaks in the chimney and the fireplace, so it had mold. The cleaning company refused to come in and clean because of the poor state of the chimney and the water leaks. XXXX XXXX came and when connecting to the front faucet, broke it clean of into the brick. It took a few days to get XXXX at XXXX to find help to fix the faucet. The city had to turn off the water so XXXX XXXX could repair the plumbing for the water. After that there was an issue in the main line and the water was turned off again. Due to many issue with the poor water pipes on this home and getting XXXX to repair things I had to abandon the carpet cleaning. I assumed my deposit would take care of any carpet cleaning costs. I never heard from XXXX until National Credit Systems called me and stated I owed XXXX XXXX {$4000.00} for new carpet and new paint. The lady I spoke to was quite rude and insisted I would pay this debt! Their website states recover money that is rightfully owed to them by former residents so I told them the carpet and paint was Ten years old and was beyond its ability to be cleaned. NCS stated they wanted the {$4000.00} or they would place this on my credit which was done. I stated I would not pay {$5000.00} to replace carpet that was Ten years old ( including my deposit ). Since this has been on my credit, I have received several phone calls from very difficult and mean people. They will not settle and refuse to hand over any documentation from XXXX concerning the details of the carpet replacement and paint. Their website, when accessed to get the details of the debt says : There is an error accessing the files.. Cant open file. I have sent them repeated emails to their customer service email, and I have sent repeated certified mail to their address. I have received no response. All I can do is call and deal with their personnel which is difficult and always leads to a bickering match. My last call I asked them to take a settlement and they absolutely reused and stated it was all or nothing. Today I called XXXX XXXX and asked if the debt NCS was requiring me to pay was what they asked NCS to collect. I did this because of the fraudulent tactics many people claim NCS uses on the consumerfinance.gov site. I have now sent two more certified letters threatening a lawsuit. If I find that NCS has fudged any numbers, I will sue them to the fullest extent of the law. Please note : XXXX never once looked at the home while I was there. XXXX never paid any attention to the chimney, which was in poor condition when I moved in ( including old silicone to stop leaks ), and the per deposit of {$650.00} was plenty to take care of any cleaning needs because of a dog. Instead, I lost my deposit, my {$650.00} was ignored and NCS is requiring me to pay for ALL new carpet in the home. This is unfair and illegal because carpet and paint are a wear and tear item for a rental. Pet hair can be vacuumed and is not a basis to charge such a large amount of money.

With all the grief Ive been dealing with due to the injustice Ive incurred, I am willing to go to the furthest extent of the law for My Rights as an Adult, being above 18 yrs of age, that I should not have to explain the fact that according to the Fair Credit Reporting Act 15 USC 602 & 1681 it plainly states that There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy ; and my privacy has absolutely been violated to the pointe I have to type this demand/complaint letter. XXXX & XXXX etc. are consumer reporting agencies and I am obviously the consumer, a living breathing Man, not a corporation or a legal entity. I, as a Man, have the right to protect my personal information and to make sure it isn't shared without my knowledge or consent, which is backed by 15 USC 6801. As should already be aware as an agent/principal, 15 USC 6801 it states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers ' nonpublic personal information. NATIONAL CREDIT SYSTEMS & XXXX XXXX is a financial institution by definition under title 15 USC 1681 sec 604a sec 2 states that in general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. NATIONAL CREDIT SYSTEMS, XXXX XXXX, XXXX & XXXX, etc DO NOT HAVE MY CONSENT, NOR MY WRITTEN CONSENT TO FURNISH ANY OF MY INFORMATION. Let it be known to XXXX & XXXX etc that ALL CONSENT whether it be verbal, non-verbal, written, implied, or otherwise is REVOKED. 15 USC 6802 ( b ) ( c ) states that A financial institution may not disclose nonpublic personal information to a non affiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. NATIONAL CREDIT SYSTEMS & XXXX XXXX never even contacted me or sent me an email or anything of that matter informing me of my right to exercise my nondisclosure option. 12 CFR 1016.7 states that A consumer may exercise the right to opt out anytime. Please consider this as Me OPTING OUT of your reporting services. 15 USC 1681s-2 ( A ) ( 1 ) A states A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 USC 1681 ( e ) states Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681 ( c ) of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681 ( b ) of this Title. XXXX and XXXX are not maintaining reasonable procedures so that leaves me with no choice but to have to decline further involvement. Lastly, 15 USC 1681 C ( a ) ( 5 ) states " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information any other adverse item information, other than records of convictions of crimes which antedates the report by more than seven years. This account is an adverse item, they are reporting again without my permission which is against the law!!!!!

I never had a written or oral agreement with National Credit Systems. Consumer Complaint: I am requesting the deletion of account NATIONAL CREDIT SYSTEM XXXX. This debt collection agency has engaged in practices that are abusive, deceptive, and unfair actions which are clear violations of the FDCPA. They have reported an account that I did not agree to nor sign any agreement for. A legal contract necessitates the agreement of two parties, and I had no involvement in any such agreement. Moreover, they failed to follow the proper five-step validation procedure, further highlighting these unfair practices. I also have uncertainties regarding whether I ever held an account with the original creditor. The original creditor did not verify the account, nor the balance listed on my credit report. NATIONAL CREDIT SYSTEM is illegally furnishing an account to my credit report. This company is also calling me continuously and harassing me about a debt that I do not owe them. Please consider this letter as an official request for cessation of communication under the FDCPA. Failure to comply with this request will be a violation of the FDCPA, and I will have no choice but to pursue legal remedies available to me under the law. Delete the account NATIONAL CREDIT SYSTEM from my credit report immediately.

I had demanded that the inaccurate information to be removed and blocked from my credit report. this information has obscurities, has errors & omissions I requested for augmentation of the record, this is defamation of character and it's injuring me financially. I've spotted many red flags regarding this matter such as : No consistency - Different staff or salespeople are telling you different things. Wont put it in writing- No one will give you clear information in writing, even when you ask for i I demanded the direct verification, and validation all data for this account, every notation, dates and balances, whether reported or not. I demanded proof as per Public Law No. 91-508 ( FCRA sec 605, 609, and 623 ). and to please verify and validate all data for this account, on top of it, if this is a collection account and the collector need to prove that this debt can survive collection, that they own this debt, and the extent to which they can collect this debt. I do not recognize any of the charges on the account nor the account itself, it does not belong to me, I purge myself and my person ( s ) from any and all assigns for account listed herein, so be it, and I have yet to receive any proof or verification. their silence is acquiescence.

Consumer Complaint: I sent a certified letter ( requested by my agent with the debt company ) with the relevant information about my account with The XXXX at XXXX XXXX not actually having a balance ( this included the image of the cashier 's check that was cashed by the apartment complex, a note signed by the manager stating the account actually had a XXXX balance, and my copy of the cashier 's check. ) It was delivered on XX/XX/2023 XXXX am to their XXXX XXXX . I also called on the XXXX of XXXX to ask about my status and was told it was " in processing '' by a manager at the company and was told to check back the next day. I have given the company almost XXXX weeks since that specific phone call and have heard nothing. I also have confirmation that the manager of the apartment complex in question ( The XXXX at XXXX XXXX. XXXX XXXX ) both called and emailed with XXXX XXXX on XX/XX/XXXX regarding my account being closed immediately, as I was placed with collections by a clerical mistake on the apartment complex 's part. And they sent a follow up email on XX/XX/XXXX with my account number to make sure the debt company had the relevant information to close my account.
