Consumer Complaint: I received an email from a credit monitoring company that a major derogatory was placed on my credit reports. The derogatory was for a stranger, different first name, different last name. I called the collection agency on XX/XX/XXXX and was told that I owed money to an apartment complex in XXXX, TX. I tried to explain that they had the wrong person, was told repeatedly that the debtor used my SSN and date of birth to rent the apartment, they had no answer on why the name was different from my name. The woman I spoke to asked if my identity was stolen, I said it must have been if the debtor used my SSN and date of birth, she emailed me an identity theft affidavit, told me to file a police report, which I did. I researched the XXXX eviction database and called the original creditor and learned that the debtor did NOT use my identity. The collection agency lied to me about that. The collection agency has admitted that they put the collection on the wrong person 's credit report, but did not address my statement that they lied about whose information was used for the rental. I wasted hours of my time, wasted police resources to file a police report that was not needed, have suffered XXXX and XXXX XXXX from the stress. The collection agency lied to me about the debtor using my identity, and they did not exercise reasonable care when they randomly picked my credit report to post the collection derogatory. Different names, different SSNs, different ages, different states of residence. There is no excuse for lying to collect a debt, and I believe some type of due diligence should be exercised before randomly " picking '' a credit report.

Consumer Complaint: After I received something in the mail that informed me about a debt I was being asked to pay. After calling the number provided on the notice, I disputed things. When they sent me the verification they had, it was different than what I had been received from my previous property manager ( the creditor ). After speaking with XXXX XXXX, they asked me to send them what I had showing I did not owe anything. I sent them what I had, that included the more detailed itemized list of what the creditor is wrongfully attempting to collect, as well as a stipulated agreement signed by the courts that states clearly that I would not be held responsible for certain things that is what Im being now billed for. I did recently realize that the date shown as the date that I allegedly moved out by is not correct. The creditor put down that I moved out on the XXXX of XXXX. I actually moved out by the XXXX of XXXX. If I had stayed past the agreed move out date then I assume that something would have been filed with the courts or the sheriffs would have been contacted to remove me. Nothing of the sort ever happened because I was out by the date I agreed to be out by.

They declared I owed {$680.00} in move out fees that will be sent to National Credit Systems if I don't pay in 30 days. They are trying to charge me for normal wear and tear for carpet, blinds, and a drip pan, which is illegal under Georgia Law. They are trying to charge me for rental income I already paid, also illegal. They illegally changed the signed move out date from XX/XX/XXXX to XX/XX/XXXX, then to XX/XX/XXXX. They illegally declared that depreciation on their carpet is 8 years when federal law dictates 5 years for tack down carpet and XXXX years for glued down carpet. They sent the notice 4 days after XX/XX/XXXX, when Georgia laws requires it to be sent within 3 days.

I have done everything that was asked in order to remove the Dept and in the end they told me the owners of the apartment community ask them to proceed with the Dept. The apartment isn't even in my name and they said I was the guarantor. I asked for document showing where I agreed to be a guarantor and they can't provide. the dept is {$10000.00}. Also the other apartment was showed that I owed {$3900.00} which I presented the court documents stating : Landlord agree to dismiss money judgment without prejudice. I have all the documents.
