Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: On or about XX/XX/22, I received an alert from XXXX XXXX stating that a collection in the amount of {$3600.00} had been placed on my account. I pulled my credit report and found that the company reporting the collection was National Credit Systems Inc. out of XXXX, GA. I contacted them the next day and was able to obtain a copy of the bill for past due rent at the XXXX XXXX at XXXX Apartments in XXXX, XXXX. Needless to say, I had never rented and apartment at that complex. I immediately contacted the XXXX, Illinois Police Department and filed an Identity Theft report. I then carefully reviewed by credit report and discovered that another apartment in the City of XXXX was currently being rented in my name. I spoke with the manager at this complex and she suspected that the renter was there fraudulently. She even provided me with the DL # and I shared it with the detective on my case, and it was a fake ID. The XXXX contacted The XXXX at XXXX and obtained the fraudulent information used to rent the apartment. The applications from both apartments were sent to National Credit Systems , Inc. NCS has informed me that they do not make the determination on whether it is a valid debt, and that the apartment complex makes that determination. The apartment complex has told me that the collection company determines the validity of the debt and that it is out of their hands. This has been going on for almost 3 months and the collection is still on my credit report.

Consumer Complaint: On XX/XX/XXXX I co-signed a lease agreement for XXXX XXXX ( my son ) and XXXX XXXX XXXX friend of son ) for an apartment at XXXX on XXXX managed by XXXX XXXX XXXX. The rental lease agreement ran from XX/XX/XXXX through XX/XX/XXXX. On or about XX/XX/XXXX the move out paperwork was signed, keys were returned and all parties vacated the property. I have not received any form of communication from XXXX on XXXX or XXXX Communities XXXX since. On the evening of XX/XX/XXXX I checked my credit report on WellsFargo.com and discovered that XXXX on XXXX had reported a debt to National Credit System and that National Credit System had reported a collection to the credit reporting listing XXXX on XXXX as the original creditor. The next morning XX/XX/XXXX I went to XXXX on XXXX to inquire about the collection and I was told that I owe {$150.00} for carpets replaced in XX/XX/XXXX. I provided the onsite property manager XXXX XXXX with a cashiers check for {$150.00} later that day. She gave me a receipt and admitted that she did not attempt to notify me of this debt because she did not have a forwarding address. I was a co-signer. I did not ever reside at the property. However, I provided XXXX on XXXX my home address, cell phone and email in my co-signer lease application. XXXX verified that the cashiers check was cashed on XX/XX/XXXX. I disputed the collection with XXXX, XXXX and XXXX. XXXX deleted the collection from my credit history. XXXX and XXXX verified that National Credit System reported the collection and closed the dispute without taking any action. On XX/XX/XXXX at XXXX I spoke with XXXX XXXX at National Credit System . I explained that I had not been contacted by either XXXX on XXXX, First Communities or National Credit System about the debt. XXXX XXXX stated that National Credit System sends notifications by mail but they were not able to obtain my home address from XXXX on XXXX. National Credit System notified the credit reporting companies without attempting to contact me, or providing me with a validation notice. I informed her that the debt was paid to the original creditor on XX/XX/XXXX and the check was cashed on XX/XX/XXXX. She stated that she would verify that the debt has been paid, and once confirmed, she would notify the credit reporting companies that the debt has been paid. I asked that she also request that the credit reporting companies delete the collection from my credit history because I was not notified of this debt. She said she was not able to do that.

Consumer Complaint: I received a call this morning from XXXX at XXXX, this person asked to speak with me and I said, " May I ask who's calling? '' because I did not recognize the voice nor did they list a business name. They stated, " XXXX XXXX '' even though it was a male 's voice. Then in a extremely stern voice, said, " Now is this XXXX XXXX '', I said " Yes, may I ask who is calling? '' in hopes that they would give me a business name. I honestly panicked because it was a local number and I thought it might have been one of my children sick at school or something. At this point XXXX raised her voice and said, '' MA'AM I just told you who it was this is XXXX XXXX and I am calling with National Credit Systems ''. I said " yes, and what is this in regards to? '' and She yelled at me again and said " MA'AM I'M TRYING TO GET THERE IF YOU WOULD LET ME ''. At this point, I stated " uh, uh, no ma'am I don't have to take that kind of tone, '' basically asking her to calm down and she hung up on me. I called back twice at XXXX and XXXX trying to speak with a supervisor to report the call and to figure out what the debt was for and both times they continued to try to collect the debt instead of listen to me and the call at XXXX when I tried to escalate, they hung up on me again. Then the call at XXXX, I actually corrected my information that they had incorrectly on file, which goes to show I was willing to speak with them and not irate, but when I mentioned filing a complaint, I was told twice that there was no one I could speak with in regards, to my complaint.

Consumer Complaint: National Credit Systems , INC has put a debt of {$3600.00} on our credit reports and is billing us said amount for an apartment we were not the signed, legal residents of at the date they are claiming the debt was made. On XX/XX/XXXX via XXXX certified mail tracking number hidden National Credit Systems , INC received the information they requested to invalidate their assignment of the debt to us when we opened an investigation to dispute the debt they were reporting to the three credit bureaus. They failed to remove the incorrect information from all credit reports and erroneously claimed to verify the debt. On XX/XX/XXXX via XXXX XXXX mail tracking number hidden National Credit Systems , INC received the information they requested again in a letter dated XX/XX/XXXX to invalidate their assignment of the debt to us when we reopened an investigation to dispute the debt they were reporting to the three credit bureaus. They again failed to remove the incorrect information. On XX/XX/XXXX National Credit Systems , INC sent out the same letter now redated to XX/XX/XXXX requesting the information we have already provided twice and that they are in possession of with proof that they have incorrectly assigned this debt. We are now exercising our right to a formal complaint with their failure to comply with the Fair Credit Reporting Act, Under section 609, 610, and 611 and understand that this issue entitles us to a sum of {$1000.00} per individual as outlined in the FTC Fair Debt Collection Act section 1692-1692p. 812 and 813. The proof we have sent them is as follows : National Credit Systems, INC provided a statement of account from Registry at XXXX XXXX XXXX The date listed as a move-out date is XX/XX/XXXX. We sent back the copy they sent us circling the information that proves the debt is invalid. National Credit Systems , INC provided the signed and dated move-out inspection form from Registry at XXXX I XXXX with our signatures and the signature of the apartment manager dated XX/XX/XXXX. The balance due at move-out was {$0.00}. We sent back the copy they sent us circling the information that proves the debt is invalid. National Credit Systems , INC provided a copy of our signed lease that clearly shows our lease term was XX/XX/XXXX to XX/XX/XXXX. We moved out 8 days before our lease was up. We did not sign a new lease nor did we sign an extension. National Credit Systems , INC has not provided proof of either. We sent back the copy they sent us circling the information that proves the debt is invalid. National Credit Systems , INC failed to provide a signed and dated lease or lease extension showing that we were residents of the named apartment themselves as they already have the proof we were not the legal residents at the date provided. The evidence they already have and keep submitting as proof clearly shows we were not the occupants at the date provided and that this debt and the account belongs to someone else. We moved out months prior and were already in another lease in another state.

Consumer Complaint: My former landlord XXXX XXXX XXXX, is claiming I owe a debt of {$300.00}. A charge they made up out of spite, after several disputes we had that caused them to refuse to renew my lease. I lived there for 3 years and had never committed a lease violation. We did however have many disputes while I was living there, mostly due to XXXX prejudices claims. They really abused their authority by not renewing my lease for that reason. They despised the fact that I had no problem exercising my freedom of speech. When I moved out of my apartment and left it clean and completely free of trash or clutter, in fact I even swept the floors before I left. I then receive a made-up charge of {$300.00} for trash removal simply because of their pettiness. There was no trash to remove from the apartment, yet they charged me after I was gone a trash removal fee. That again was created out of their spite and pettiness, just like every other interaction with them. They could not and can not provide there was any trash to remove.

Consumer Complaint: On XX/XX/XXXX I was made aware of an adverse collection on my XXXX credit report as I sought unrelated credit. The item purported to show {$2400.00} due to National Credit Systems. After researching, I determined that collection originated from an apartment building in XXXX, Maryland owned by XXXX XXXX ( the Residences at XXXX XXXX XXXX ), which I had moved out of in XXXX of XXXX. I contacted the apartment building on XX/XX/XXXX to dispute the charge, as I had no record of an outstanding bill and, in fact, had a record showing fully paid at the time of moveout, except for a minor utility bill of {$45.00} that was customarily paid later ( which occurred ). The building management informed me that the property had been sold and that it had no records from that time. It then advised me to contact XXXX XXXX directly. Also, on XX/XX/XXXX, I contacted XXXX XXXX to dispute the charge. I provided the statement from XX/XX/XXXX that showed full payment, except for a {$45.00} utility bill. Capital properties responded that the amount had been sent to collections and that I should pay the collection agency. It further stated that almost all of the charge was to replace carpet. Capital properties provided no evidence that the carpets were in fact damaged, let alone damaged because of my tenancy. That is because the carpets were in good condition when I left. In addition, I can attest that from XX/XX/XXXX to now that I am not aware of any attempts by Capital Properties ( or National Credit Systems for that matter ) to contact me about the supposed charges and the reason for the charges. They have also made no attempt to provide any evidence of actual harm to the apartment or that connects the damage to my tenancy. In fact, I only found out about the delinquent item because of an unrelated credit pull on my records. Finally, on XX/XX/XXXX, I received a letter from XXXX that indicates that it completed its investigation into my dispute, and it found the credit item as accurate. It did not appear to provide any evidence to support that finding.

Consumer Complaint: I left an apartment complex in 2019 where rent was XXXX dollars per month. I left 4 months before my lease was up which totals to XXXX dollars. The apartment complex XXXX XXXX Apartments and the debt colelction company National Credit Systems have increased the debt nearly 300 % and put it on my credit report. From what I have read this is a violation of the FDCPA because it is a grossly increased debt amount. I tried disputing the information with the credit bureaus but when they tried to validate the information National credit systems and XXXX XXXX apartments stated it was accurate. I was not given an itemized receipt of the charged and they kept my deposit. I feel that this is a violation of Federal Law by allowing a grossly increased and incorrect dollar amount to report to my credit report. It has prevented me from my life goal of getting a home loan. I am not opposed to paying the debt, just opposed to something that has been increased by 300 %

Consumer Complaint: I am XXXX XXXX a federally protected consumer and I am making another complaint against National Credit Systems regarding an account that they purchased from The Alcove Apts. I have sent your company several correspondences, however, your company 's response is always a computer-generated letter stating there is not enough information to validate my claim, and this alleged debt continues to remain on my consumer reports with no regard to how this affects me. First, I would like to state that I have never given National Credit Systems any permission to use any of my identifying information to commit aggravated identity theft by contacting me about an alleged debt they claim that I owe. After several correspondences and a previous CFPB complaint I have still not validated any alleged debt with National Credit Systems and while I have not validated such claim of debt this, in turn, can not be constructed as an admission of liability. As of XX/XX/2022, I have not received any documentary evidence such as a TRILATERAL CONTRACT between, The Alcove Apts, NATIONAL CREDIT SYSTEMS, and myself, giving National Credit Systems any right to collect on this alleged debt. It is my belief that National Credit Systems is attempting unlawful fraud activities and theft by deception by attempting to furnish false and deceptive forms and continues to commit several violations under the FDCPA especially when an eviction NEVER occurred. Please see attached documents.
