Consumer Complaint: I received a loan to purchase my truck from M & T Bank. I tried to go on line to set up automatic payments, but in order to schedule online payments I had to go into an actual branch and complete paperwork. On XX/XX/22 I went into my local M & T Branch located at XXXX XXXX XXXX, XXXX, VA XXXX, ( XXXX ) XXXX. I completed the paperwork, but because my XXXX payment was due on XX/XX/XXXX I was told I would still need to make that XXXX payment because the paperwork that I just completed would not go into effect until XXXX/XXXX/22. I went online and scheduled my XXXX first payment for XX/XX/22 for the full amount of {$680.00}. On XX/XX/22 there were XXXX transactions of {$680.00} charged to my account. Only XXXX were taken out from my bank account. I contacted the bank immediately when I noticed this. I spoke to the branch XXXX, XXXX, and she said that the money would be deposited back to my account within XXXX business days. It took them until XX/XX/XXXX to finally deposit the money. This put a financial hardship on me. I had to borrow money to make ends meet. When I contacted the corporate office and told them the situation, I spoke to a XXXX XXXX XXXX on XXXX/XXXX/22. He told me someone would call me within 1-2 days before the week is up. No one ever called me. I received a letter on XX/XX/22 apologizing for the inconvenience. An apology does not help with the struggle I endured to make ends meet.

Consumer Complaint: Someone stole my debit card and other personal information from the mail and used it to make purchases at XXXX XXXX and XXXX XXXX while I was at my workplace. Both purchases were in excess of {$900.00}. I immediately notified M & T Bank that I had not received a debit card and that I did not make the transactions ; and did not authorize any other person to make such transactions. The next business day after I notified M & T Bank it denied my claim because it said the debit card and XXXX were used to make the purchases. I have learned that M & T Bank can not legally hold me liable for transactions I did not make ; despite the fact that a debit card it issued to me ( which I never received ) and XXXX ( which is part of my SSN ) were used. Please see the Electronic Fund Transfer Act. I want M & T Bank investigated and held liable for its denial of my claim in violation of the law. I am in the process of contacting lawyers and getting assistance in filing a case in the DC XXXX XXXX.

Consumer Complaint: It is not possible for me to file a complaint against XXXX XXXX XXXX XXXX, so it is against M & T Bank. I was supposed to have ALL overdraft fees associated with a debit purchase that was unauthorized refunded. They were not. The fee of {$37.00} charged on XX/XX/2022 which was a direct result of a charge that was disputed and refunded was NOT refunded. Had I been accurately refunded in the first place, they would have lost out on SEVERAL of their {$37.00} fees as many were {$20.00} or less. Additionally, they are in breach of their own contract. If money is placed into an account the same day an overdraft fee is incurred, there is not supposed to be an overdraft fee. On XX/XX/2022 I was charged {$37.00} for an overdraft from XX/XX/2022. However, I deposited {$340.00} on XX/XX/2022. The overdraft wouldn't have been charged if they followed their OWN policy. The only reason the account went negative was the 4 {$37.00} fees from XX/XX/2022. I called the banking center and was refused to have even this one fee refunded. They have taken 19 {$37.00} fees in less than a month. If they refuse to follow their own contract, I will take them to small claims court. I would like the FDIC to note that the fees M & T Bank charges are less than XXXX XXXX XXXX, significantly, and they have taken AWAY positive things in my XXXX XXXX contract ( like checks up to {$500.00} being available right away ). How is it legal to take away only the positive things I was offered by my bank and keep the negative ones -- yet I am unable to sue XXXX 's XXXX -- -how is this legal to treat two consumers forced to use the same company so differently? There should be more oversight!! Additionally, while it is subjective -- FDIC states these fees are not allowed to be " excessive ''. Guess what? THEY ARE EXCESSIVE!!!

The undersigned a XXXX XXXX XXXX has been impacted by the Pandemic Covid-19 as all the XXXX XXXX XXXX in the State of New Jersey . It worth noted the above loan a XXXX XXXX XXXX M & TT Bank which reassured the undersigned borrower that they will assist with the modification that the federal government recommended to put the outstanding areas to the back at the loan and extended to XXXX years. In short, the modification process started in XXXX and all the necessary application requirements completed in XXXX. By XX/XX/XXXX the monetary trial period started and the followed to the XXXX. However, the Bank in the middle of the monetary trial period verbally requested the XXXX certificate of the undersigned XXXX XXXX who passed XXXX years ago. Noted it was clearly articulated to the Bank by the undersigned that XXXX XXXX passed in XXXX and the Death Certificate had to come oversees and the time frame was rather unknown because it had to be sent to the XXXX XXXX in XXXX for final stamps. To make a long story short the death certificate was delivered to the MTT Bank in XXXX. However, they had another verbal request the title which it had been provided with first application came back to them cloudy. The undersigned approached the probate officers who needless to say they were laughing at me with the naivete of the inquires. regarding cloudy title. Finally, one of the probate clerks recommended to call the clerk of the XXXX XXXX and have them certify the title and have them certify the title and send it to the undersigned. immediately, it was send to the Bank. however, the Bank denied the Covid-19 modification of the loan and suggested to start another unrelated modification of course with different terms. Despite as the undersigned started the new modification application all the papers application completed but the Bank found another form which had been filed with them XX/XX/XXXX that sections ( 6 ) and ( 7 ) had been checked together upon investigation the forn 45 c only section 6 had been checked twice thus line a and c However, according to XXXX XXXX XXXX XXXX during the last telephonic conference with him on XX/XX/XXXX only one box had to be checked. It should be noted for almost over a year the application for the modification was with M & T Bank and no one sent to the undersigned and correspondence with their requests despite the myriad verbal and written request presented to so my representatives and supervisors pf the Bank such as lately XXXX XXXX on XX/XX/XXXX and XXXX XXXX as late as XX/XX/XXXX very importantly and it bears repeating the undesigned has acted in good faith and the back kepts adding a new hurdle in the process. At this posture of the case it should be noted that the Covid-19 modification was denied although the undersigned completed all the steps including the monetary trial period. Every step of the way through the modification period the Bank may requesting new form to be completed and negate a previous one that it was send before such as the last request of form 45 -6 that it was send on XX/XX/XXXX and no one inform the undersigned after so many months that it was not successfully completed. Accordingly the " crus '' and the status of the above loan remains unresolved despite the copous efforts inquires and requests to fulfill the Banks demands Now they are threatening with foreclosure by XX/XX/XXXX Despite the prompt and written correspondence to their requests. Noted since XX/XX/XXXX when the first monetary trial has paid the undersigned requested all the inquires concerns demands such as the death certificate of my late husband than cloudy probate. the itemized outstanding balance of the XXXX XXXX arrears yearly interest of XXXX, XXXX and everything else to be sent to the undersigned in writing it has to be said, despite the reassurane the undersigned has not received any inquires in writing. It has to be mentioned that the undersigned has been harassed and discrimminated going through the process Care Act. Noted the loan has been paid for 14 years already and Bank demands foreclosure by XX/XX/XXXX thus losing the property due to XXXX

Consumer Complaint: My company XXXX XXXX XXXX XXXX in XXXX, MD has a customer who banks with M & T Bank. We entered into a payment arrangement with the customer whereby she authorizes us to prepare a check from her account and deposit it to our account at XXXX XXXX. To be clear my complaint is not with XXXX XXXX but with M & T Bank. We prepared the check for the month of XXXX as we always have with the proper account number. The check was returned by M & T bank to our account with XXXX XXXX with the notation that the Bank ( M & T ) was unable to locate the account. I contacted the customer and she assured me that the account number had not changed. We were charged {$12.00} by XXXX XXXX as a result of the negligence of M & T Bank. We then prepared a new check on the same account and the check was paid. M & T bank needs to reimburse my company the {$12.00}, I went to the local branch of M & T and they were of no help. I received a call from the manager today. XXXX XXXX. When I explained the situation to her. she said they would need to charge her customer for the negligence of the bank. I said that is not right. She proceeded to hang up on me.

Consumer Complaint: THIS IS NOT A DUPLICATE COMPLAINT. BUT AN UPDATE TO THE BILLING ERROR AND NOTICE OF FAULT/OPPORTUNITY TO CURE. I, XXXX XXXX XXXX, consumer whom in competent and of sound mind and age, is filing this complaint under my own accord. I all statements made are true and accurate to the fullest extent of my belief. I have sent M & T bank an affidavit of truth requesting the original promissory note with my Original wet blue ink signature, the account ledger showing where the funds originated from showing that M & T Bank lended me money, I requested the Generally accepted account practices, proof showing that the deed and promissory note was filed with the county recorder and the original promissory note was not securitized and sold,. In the Affidavit, M & T Bank has not rebutted any other these requests point by point. They have sent me communications with past statements, balances, a bad copy of the promissory note that only has my signature on with an unknown person who " ALLEGEDLY '' signed the note. If this promissory note is suppose to be a bilateral contract, which the definition of a bilateral contract is a promise in exchange for a promise between parties. An implied-in-fact contract is a bilateral contract even though it may be established by an action rather than a verbal promise. The attachments that M & T BANK has senT through the CFPB portal included a copy of the promissory note used by XXXX XXXX XXXX XXXX and not the original. On that copy of the promissory note, there are a few initials that I dispute as as not my own, the signature on page 19 of the note, there is no name of the alleged witness, just a super imposed signature that is not of the original note. Also the notary stamp of this note does not appear to be the same date this note was originated nor does the notary stamp appear to be original to the document. This would be considered fraud if the notary stated I endorsed the note in front of her, when in i Fact I did not. I can not make out whether it was stamped XXXX or XXXX. How do I know the Anonymous signature of some unknown person on the note is an employee of M & T Bank? There is no name or position of this person. Due to M & T Bank 's constant fraudulent activity, I believe that was done after I endorsed the note under the misleading thought that I was borrowing from M & T Bank and they will not rebut any of my affidavits with an Affidavit rebutting these FACTS. When an affidavit is not rebutted point by point, it is implied that the Affidavit is factual and undisputed. when the law states 12 U.S. Code 1431 - Powers and duties of banks a ) Borrowing money ; issuing bonds and debentures ; general powers Each Federal Home Loan Bank shall have power, subject to rules and regulations prescribed by the Director, to borrow and give security therefor and to pay interest thereon, to issue debentures, bonds, or other obligations upon such terms and conditions as the Director may approve, and to do all things necessary for carrying out the provisions of this chapter and all things incident thereto. So knowing that banks can not lend their own money and they can not lend their customers money, How is it that M & T BANK " Lent '' me funds and I am responsible for this debt knowing that 18 U.S. Code 8 - Obligation or other security of the United States defined The term obligation or other security of the United States includes all bonds, certificates of indebtedness, national bank currency , Federal Reserve notes, Federal Reserve bank notes, coupons, United States notes, Treasury notes, gold certificates, silver certificates, fractional notes, certificates of deposit, bills, checks, or drafts for money, drawn by or upon authorized officers of the United States, stamps and other representatives of value, of whatever denomination, issued under any Act of Congress, and canceled United States stamps. I used used Federal Reserve Notes as tender of payment, which according to the Federal Reserve Bank, is considered a promise to pay and not lawful money. According to the 12 USC 411 The said notes shall be obligations of the United States and shall be receivable by all national and member banks and Federal reserve banks and for all taxes, customs, and other public dues. They shall be redeemed in lawful money on demand at the Treasury Department of the United States.The Secretary of the Treasury shall pay interest due or accrued on the public debt. Also 31 usc 3123 ( b ) As the Secretary considers expedient, the Secretary may pay in advance interest on the public debt by a period of not more than one year, with or without a rebate of interest on the coupons. Your company has created the false believe that I, the Consumer is obligated to pay this debt using Federal Reserve Notes or Floating Rate Notes, which is false and is considered extortion under 18 usc 1961. AGAIN THIS IS NOT A DUPLICATE BUT AN UPDATE. M & T has not provided any of the requested information via Affidavit nor have they properly rebutted any of these facts under the penalty of perjury. Consumer Complaint: My credit report shows a 30 days late payment for my M & T Bank mortgage in XX/XX/2021. I made my payment on XX/XX/2021. I was NOT 30 days late. M & T has refused to remove the mark from my credit report stating that they report a month behind. This is not OK. I was not 30 days late making my XX/XX/2021 payment, and my credit report should not say that I was. I attempted to dispute this reporting with all 3 major credit bureaus and was informed that even though I provided the statement showing that I was not 30 days late, they do not actually have an internal team that does investigations. They simply forward it to the company and use the company 's response to the dispute. So since it is the practice of M & T Bank to report a month behind, I have a mark on my credit reports showing that I was 30 days late making my payment for XX/XX/2021 and I was not. This is affecting my ability to get a new mortgage.

Consumer Complaint: XX/XX/2022 - I received a call from an associate claiming to need verification of information in order for my accounts to remain active. I advised that had already been completed these steps. The associate was nonchalant with regards to continuing the call inspite of the threat to terminate my accounts, and without any confirmation of previous step completion. When asked why I was contacted and advised my accounts would be closed, I was told " that's the facts ''. I then asked to speak with a supervisor and was transferred to " XXXX '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX. She then advised she could remove the flags, again without confirmation that the steps were completed, and no reasoning on repeated calls. When I requested to speak with someone in a higher position, she refused and said she couldn't transfer the call. I asked to speak directly with her supervisor and that request was met with lies and deceit. These actions make me question the integrity of the company, and the adherence to regulations in place. XXXX requires that a supervisor be available, or an option to leave information for a callback promptly.
