Consumer Complaint: I have had a number of issues with this bank since they acquired my mortgage from XXXX in late XXXX. They stopped my escrow account and stopped collecting home insurance and I had to assume payment of it for a bit. I had to point that mistake out to them. Their Insurance department is totally incompetent. During this time, their insurance department sent me a letter asking me to get the Insurance policy information on the building for them. I reached out through social media and said that I am not doing their job for them. I gave them the contact information for the property management company and told them to do it themselves. I live on the top floor of my building. It is a cooperative building, so I own shares but not the actual unit. I had leaking in XXXX which the building poorly repaired, so I had to pay to fix the repair out of pocket. I reach out them that now in XXXX that I have mold. They told me that the Insurance and Legal department told them that it is not the bank 's problem. I am required to have insurance on the unit while my mortgage is in place and they want the building 's insurance policy but do not care that the building is not being maintained. I am attaching the mold violation that the city put on the unit. They should have at least sent me the building 's policy information so I can file a claim. I want nothing to do with this bank. If I did not care about my credit, I would stop paying the mortgage as I am in a building with mold. I honestly want them to stop having people to call me, just to act like they care. I propose that they sell my mortgage or I will just sell my apartment to end this relationship. It literally makes me sick each month when I have to pay my mortgage to them. They are the worst financial institution that I have deal with in my entire adult life and I am XXXX!

Consumer Complaint: My identity was stolen in XX/XX/XXXX. I recieved an email from M & T bank about a new account being opened. I called them to have the account closed on XX/XX/XXXX. They told me the account would be closed. I recieved an email from them again on XX/XX/XXXX. I called them again to close the account they told me I called them and asked them to reopen the account. I told them I did not and that it was a fraudulent account and I want the account closed. On XX/XX/XXXX I received a statement email from them I called back to demand the account be closed. They told me the account would be closed. On XX/XX/XXXX I received another statement email from them. I called to have the account closed again. They told me it would be closed by end of business that day. On XXXX I received another statement email. The bank account is still not closed. This is a fraudulent account that I did not open. It's not even opened in my legal name. The account is opened under XXXX XXXX XXXX and my legal name is XXXX XXXX XXXX. I told them when I spoke to them in XXXX if the account wasn't closed I was filing a complaint.

Consumer Complaint: I, XXXX XXXX XXXX, consumer whom in cometent and of sound mind and age, is filing this comolaint under my own accord. I all statments made are true and accurate to the fullest extent of my bielief. After reviewing my account, the I notice there was a billing error that occurred in the amount of {$46000.00} for XXXX and XXXX. I am curious to know as to how this may have occurred knowing that M & T Bank is honest and would ensure my account does not have any fraudulent activity. As you may be aware that the my social security number also known as a credit card as mentioned in 15 usc 1602 ( L ) was used to fund this open-end credit plan from my XXXX XXXX account with the US Treasury XXXX According to 15 usc 1692J ( a ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in aconsumerthat a person other than thecreditorof suchconsumeris participating in the collection of or in an attempt to collect adebtsuchconsumerallegedly owes suchcreditor, when in fact such person is not so participating. This is considered fraud According to 15 usc 1666d Whenever a credit balance in excess of {$1.00} is created in connection with a consumer credit transaction through ( 1 ) transmittal of funds to acreditorin excess of the total balance due on an account, ( 2 ) rebates of unearnedfinance chargesor insurance premiums, or ( 3 ) amounts otherwise owed to or held for the benefit of an obligor, thecreditorshall ( A ) credit the amount of the credit balance to the consumers account ; ( B ) refund any part of the amount of the remaining credit balance, upon request of the consumer ; and ( C ) make a good faith effort to refund to the consumer by cash, check, or money order any part of the amount of the credit balance remaining in the account for more than XXXX months, except that no further action is required in any case in which the consumers current location is not known by thecreditorand can not be traced through the consumers last known address or telephone number. I had a balance that exceeded {$1.00} several times over the history of having this open-end credit plan account. I am is also aware that at closing both the note and deed are suppose to be recorded at the county recorder but only the deed has been recorded. The Affiant is also aware the the Original Promissory note was securitized and traded. Once the Note is securities, M & T Bank is no longer the Holder In Due Course. I requested that M & T Bank send me the Original Promissory Note but was sent a copy instead. The copy displayed a notary stamp and signature that was not on the original copy of the Promissory Note, which is deception. According to 3-603. TENDER OF PAYMENT, tendered payment by submitting the remittance coupon that has been signed with the beneficiary endorsement on the back of the remittance coupon for payment but yet the balance remained unchanged. If tender of payment of an obligation to pay aninstrumentis made to aperson entitled to enforcethe instrument and the tender is refused, there is discharge, to the extent of the amount of the tender, of the obligation of anindorseror accommodationpartyhaving a right of recourse with respect to the obligation to which the tender relates. The fiduciary duties of the Trustee has not be carried out at the direction of the beneficiary. According to UCC 3-309 ENFORCEMENT OF LOST, DESTROYED, OR STOLEN INSTRUMENT, you have not returned the instrument which was the remittance coupon, submitted to M & T bank for UCC 3-311 , ACCORD AND SATISFACTION BY USE OF INSTRUMENT of this alleged balance. This instrument is now considered stolen and assumed securitized for its non return. 18 U.S. Code 8 - Obligation or other security of the United States defined The term obligation or other security of the United States includes all bonds, certificates of indebtedness, XXXX bank currency XXXX Federal Reserve notes, Federal Reserve bank notes, coupons, United States notes, Treasury notes, gold certificates, silver certificates, fractional notes, certificates of deposit, bills, checks, or drafts for money, drawn by or upon authorized officers of the United States, stamps and other representatives of value, of whatever denomination, issued under any Act of XXXX, and canceled United States stamps. I used used Federal Reserve Notes as tender of payment, which according to the Federal Reserve Bank, is considered a promise to pay and not lawful money. According to the 12 USC 411 The said notes shall be obligations of the United States and shall be receivable by all national andmember banksand Federalreserve banksand for all taxes, customs, and other public dues. They shall be redeemed in lawful money on demand at the Treasury Department of the United States.The Secretary of the Treasury shall pay interest due or accrued on the public debt. Also 31 usc 3123 ( b ) As the Secretary considers expedient, the Secretary may pay in advance interest on the public debt by a period of not more than XXXX year, with or without a rebate of interest on the coupons. Your company has created the false believe that I, the Consumer is obligated to pay this debt using Federal Reserve Notes or Floating Rate Notes, which is false and is considered extortion under 18 usc 1961. The United States is obligated to tender payment and it is Federal Law that when my credit cardsocial security number was used, it fully funds my account. XXXX has not received any disclosure separate from my billing statements XXXX days before the statement date I am requesting that the full amount be credited back to my account and that any form of tender of payment that has been submitted since the origination of the contract submitted by me, must be refunded to the me in a good faith effort, in the form of a check sent to the address above as according to federal law 15 USC 1666D. Going forward I am requesting that all billing statements with balance in excess of {$1.00}, be discharged by the obligation of the United States as stated above.. As the law states, you have 30 days to do you investigation into this error. Thank you

Consumer Complaint: On XX/XX/XXXX, I filed Complaint XXXX against XXXX, a law firm representing M & T Bank , the lender, on a ELOC that has existed for more than 20 years. By letter dated XX/XX/2022 M & T denied our request for a loan modification but offered a repayment plan that we must answer by XX/XX/2022 together with an initial payment ( Exhibit XXXX ). On XXXX XXXX, we received a certified letter from XXXX, dated XX/XX/2022 that a foreclosure, at XXXX XXXX XXXX will take place on XX/XX/2022, despite the fact that we still had XXXX Week to respond to M & T 's offer ( Exhibit XXXX ). This law firm continues to harass us and act unethically. We are senior citizens and trying our best to resolve issues but letters from XXXX, foreclosure scammers and others " seeking to help us '' causes us XXXX and aggravation. In Exhibit XXXX M & T told us the amount of the repayment for the ELOC but did not say what the monthly, regular payment was. I called an M & T representative she did not know. This was followed by an M & T letter dated XX/XX/2022, and that they will get back to me with that figure ( Exhibit XXXX ). Thus I have a repayment offer without a key part in it and a foreclosure date that is illegal.

Consumer Complaint: M & T Mortgage failed to send the entire tax payment to the tax office from my escrow account. They were sent two tax parcels and failed to make the full payment. They also failed to contact me via letter, phone, or email to inquire or rectify the situation. They admit to receiving the two parcels from the tax office and failed to take any action to contact me. I had no idea they did not pay the full tax amount owed until after it was past due. I received a delinquent letter with late charges from the tax office in the amount of {$300.00}. They instead send me a partial refund way after the delinquent dates. In XXXX, I received a letter after I made a complaint with mortgage company that they do not feel like they are responsible for the late charge and have added the {$300.00} to my escrow account. I filed another complaint with the mortgage company and never heard back. I then followed up again on XX/XX/XXXX and was told they still didn't want to refund the {$300.00} to me for their mistake and inaction. I never chose this mortgage company in the first place. I will never use them again if they do not take the proper corrective again and pay the late charge that was their fault in the first place. I have no problems filing a complaint with the XXXX XXXX XXXX, other financial consumer complaint websites, making sure they get bad reviews for improperly handling this matter.

Consumer Complaint: My mortgage is from M & T bank. I used to have loan modification offer plan from M & T bank, due to Covid 19 hardship situation. The bank offered me to pay {$46000.00} as a trial period. 3 months. Starting from XX/XX/2022 till XX/XX/2022. Also they offer me to drop my interest rate from 4,75 % to 3 %. But, after I finished my trial period, I paid in time, M & T bank called me, and told that they made a mistake and they cancel all deal between us. The bank told me, that I have to pay them around {$30.00} XXXX, otherwise they will take me foreclosure. I have all documents prove my words. I have signed and notarized agreement for this loan modification contract. Please help me. I have never missed any payment to the bank.

Consumer Complaint: XX/XX/XXXX I went online to M & T 's website in order to open a checking account to leave XXXX as M & T held my mortgage after speaking to the mortgage department about offers for mortgage customers and they directed me there as they did not have any info. On their site it stated that I could open a premier checking account without a monthly fee as the foot note states " Maintain combined balances of {$25000.00} or more in eligible personal deposit accounts, loans and home equity outstanding balances, investments, and business deposit accounts. For detailed information, please refer to the Specific Features and Terms for each account, which are available upon request at any M & T banking office or through M & Ts Contact Center. '' Being that my mortgage loan is above that limit, it should have been free. I received a call from a banker ( male ) at the XXXX XXXX XXXX thereafter in which I had questioned why I was charged {$25.00} since they service my mortgage & his response was that it shows a charge but it also shows a credit and that it is not impacting my account. I open a money market as it was an offer on my online banking that could also be waived due to my mortgage balance. I opened that and then I saw a charge and a waiver, unlike the checking. On XX/XX/XXXX I called into M & T bank customer service line to inquire as to why I was still being charged to which I was told I needed to chat with the mortgage department. The mortgage department was the original department to tell me they did not have that info so I declined a transfer and requested a supervisor. After being told to wait on hold I STILL did not receive a super and instead was given more of a runaround. I still requested a super and finally got one. She was a self proclaimed XXXX year veteran of M & T/banking and yet somehow tried to tell me a mortgage is not a loan. I am an XXXX... XXXX XXXX XXXX XXXX. She then went on to say that she sees where on the site it says to reach out to a contact center for more info, however footnote 6 is clearly unfair and deceptive since she stated " it is only for retail loans ''. If that is the case, it should be listed as such and not as " Maintain combined balances of {$25000.00} or more in eligible personal deposit accounts, loans and home equity outstanding balances, investments, and business deposit accounts. '' I then got disconnected but she refunded a couple of fees. I spoke to the branch location because the fees impacted my record keeping and therefore subjected me to overdrafts, returned items impacting me with other creditors, and distress. The banker ( female - XXXX I believe ) was the woman to help me the most by raising this to her manager and was able to refund about 1/2 of my fees due to this. When I asked when I would hear about the rest she said she would try but that was the most they could do. When I raised a UDAAP concern, she then stated she would call me back. The manager then called me XX/XX/XXXX ( XXXX ) and we discussed it and he agreed it was deceptive ( recorded call ) however he was " only one guy in the branch and can only raise this to his boss ''. I find this unacceptable. To not only know there is an issue, but to claim there may be others like you impacted, but this could take months to fix. All due respect, a multi million dollar bank charter should be able to update their web copy and their brochures with ease as soon as the compliance violation is acknowledged.
