I went home ( XXXX XXXX ) after I retired from United States Army to visit my XXXX XXXX XXXX brother and my uncles wife who was still alive and admitted in the hospital. After I came back I missed 1 month mortgage payments and on XX/XX/XXXX I received M & T Bank stating : Under the repayment plan, you must pay the regular monthly mortgage payment of {$2100.00}, along with an additional amount of approximately {$710.00} and XXXX of each months. The following payment schedule provides the specific repayment plan terms : Plan 1 Date : XX/XX/XXXX XXXX : $ {$2800.00} Paid Plan 2 Date : XX/XX/XXXX XXXX : {$2800.00}. Paid Plan 3 Date : XX/XX/XXXX XXXX : {$2800.00}. Paid After I paid the last payment plan 3 on XX/XX/XXXX they want me to pay {$2100.00} regular payment. I called the mortgage multiple times telling them Im retired 23 years XXXX and XXXX vet so you know I get paid every end of the month therefore, you cant do this to me. I told them I also have bills to pay and also food, gas and I asked them these 3 plan payments should be able to cover one month missed payment. So the next payment should be XX/XX/XXXX or XX/XX/XXXX. Please HELP they are still calling me telling me Im behind one month payment. Thank you

Anti-Racketeering Act of XX/XX/1934, which Congress initially passed to combat the use of interstate commerce M & T should have never released information to this company without my permission nor should XXXX be Instigating Housing Applicants from Obtaining Housing in a Reasonable 30-60 Window Period. I contacted M & T through their message portal. M & T confirmed that I had opted out prior to these charges but declined to reverse the fees. They did not provide a reason for their failure to reverse the fees. I understand banks are allowed to charge overdraft fees for certain types of charges regardless of opt out status, however these charges do not fall into those categories.

On the same date and time my bank credit card was also charged {$200.00} by a XXXX XXXX XXXX XXXX XXXX This transaction was not authorized. The XXXX employee charged my charged my card on his personal cell phone after he charged my card for the XXXX purchase. I disputed this charge with my bank where they gave me a provisional credit back to my account. I was then notified via letter that my bank denied my dispute stating it was an authorized transaction and withdrew their {$200.00} provisional credit. On XX/XX/XXXX I want to the bank and spoke with an employee who was able to print my transaction history showing both purchased were done at the same day and time. She said she would reopen the dispute on XX/XX/XXXX. After I left the back onXXXX I went to the XXXX location to see if I could handle this issue civilly. The XXXX manager told me I needed to file a police report as I'm not the fist victim this happened to and there is already an investigation into this now terminated employee stealing customers money. My bank should of done their due diligence as it clearly shows on my account both transactions were done on the same day and exact time.

The culture of MTB is to write letters stating that my requests are frivolous and they will not answer similar complaints. I was able to find my original closing documents for other legal reasons and here is the disclosure that they refuse to send upon request or honor. see attached. it is XXXXXXXX XXXX per violation per federal law. Consumer Complaint: I contacted M & T Bank in XX/XX/XXXX and told them my property taxes needed to be paid in full by XXXX. M & T paid the taxes in full. XXXX, I contacted M & T and again told them my property taxes needed to be paid in full by XXXX. On XXXX, I checked my escrow acct and M & T had only paid the first half. I told them again they needed to send the second half prior to XXXX. They told me they could not because there wasn't enough time to send them out. I was very upset that they failed to pay the taxes in full by the date I requested. I told them I would have to borrow the money to pay for the 2nd half. I borrowed the money and paid the XXXX half so I could claim my property taxes when I file my income taxes in XXXX. XXXX M & T sent a check to the XXXX XXXX treasurer for part of the XXXX half. On XXXX they sent another check to the XXXX XXXX treasurer for the remainder.Odd how they couldn't pay them in full by XXXX as per my request. I received a call from XXXX XXXX at M & T on XXXX. He said the XXXX and XXXX payments they sent to the XXXX XXXX XXXX would be returned to our escrow. That money doesn't belong in the escrow. The property taxes have been paid in full because they paid half them from the escrow and I borrowed the remaining portion of the property taxes that they neglicted to pay by XXXX as per my request. There was enough money in the escrow XXXX to pay the property taxes in full. So now the property taxes have been paid XXXX XXXX times. That money should be returned to me immediately, not returned to the escrow. He also said they will reevaluate the escrow. The escrow is fine and the monthly amount I put in escrow is fine. They don't need to readajust the escrow. There was enough money in the escrow. They created the problem because they can't follow simple directions. Had they paid the property taxes in full by XXXX there wouldn't have been a problem. Odd how after I complained that they neglected to pay the taxes in full on time, they sent two checks to XXXX XXXX treasurer after the fact in XXXX of XXXX from my escrow which I still don't understand why they paid that portion after the due date. That overage that was paid to the XXXX XXXX XXXX belongs to me and not the escrow. I am out that money. Leave the escrow alone as it is correct and return the money to me that I have coming. I have NEVER had a problem with any other bank. M & T can't follow directions. I need the property taxes paid in full by XX/XX/XXXX each year as we need them paid in full for our income taxes. XXXX XXXX told me they can't return that money ( which I am owed, not the escrow ) because it needs to be returned to escrow. I am out that money, the escrow isn't. Please help.I am owed the {$2100.00}, not the escrow. I am paying interest on the money I borrowed to pay the remaining portion of the property taxes, and they want to put that money in escrow so they can make interest on my money. Putting it back in escrow will create a huge overage in escrow and cause nothing but problems with my future payments. They need to send me my money back and leave the escrow acct alone. The escrow payments I have been making are correct. They don't have a clue what they are doing.

Consumer Complaint: M & T Bank is attempting to overcharge me for my mortgage and they can not even explain how they arrived at an erroneous tax amount on my mortgage statement. Their customer service is very difficult to get ahold of with wait times over an hour and they never call you back. they just send bills and act without integrity towards the XXXX. The mortgage company erroneously added some imaginary tax amount to my escrow account even though I am exempt from taxes. My mortgage was originated by XXXX XXXXXXXX XXXX who respected my tax exemption that is cared for in the Florida statute below : " Any real estate owned and used as a homestead by a veteran who was XXXX XXXX and has been certified as having a service-connected, XXXX XXXX XXXX XXXXXXXX, is exempt from taxation of the veteran is a permanent resident of Florida and has legal title to the property on XX/XX/XXXX of the tax year for which exemption is being claimed. ( XXXX XXXX ( XXXX ) ) '' I have been part of the homestead exemption program since XX/XX/XXXX. I am registered as XXXX with the XXXX XXXX tax collector on their website that generates tax bills. The M & T tax bill is a human error made up erroneously that is causing undue hardship to a XXXX person on a fixed income. This company is Terrible to work with. Here is one of the letters I sent the mortgage company on both XX/XX/XXXX and XX/XX/XXXX ( word for word ) and they have failed to address my concern. I need to let the CFPB step in and get some executive presence or a hefty fine on M & T for this civil rights violation. Regarding account : XXXX. I called XXXX weeks ago and spoke with the tax department I just got a letter denying my request to have taxes removed, which somebody added. for the first 6 months of M & T servicing, you respected my $ XXXX XXXX tax. What happened. Who messed up. I need answers and accountability. This is absurd and is demeaning to those who have fought and gave all for this country. I am a 100 % Service connected XXXX veteran who is exempt from Property taxes in the state of Florida. I bought the home in XXXX from the previous owner who paid taxes. However with my XXXX veteran tax exemption. I have never paid taxes in Florida and never will. I am on a fixed income and can not afford to pay the proposed increase of close to {$800.00}. My previous mortgage company XXXX did not collect escrow for tax and neither has M & T for the past XXXX billing cycles. I called to correct this issue and you sent me a denial letter because of your lack of research or inability to view a county website showing I am exempt and XXXX and the tax on my home is {$0.00}. M & T Bank are violating my rights as a service XXXX veteran. XXXX XXXX attests on their website at the following link that I am exempt from paying taxes. https : XXXX? XXXX & XXXX Florida statute clearly states that a XXXX veteran, once enrolled in the homestead program ( which I am ) shall NEVER pay property tax. Please update my escrow account and make the corrections.
