Consumer Complaint: This has been ongoing since my mortgage company was switched from XXXX XXXX XXXX to M & T Bank. M & T Bank has started to harass us none stop. They also increase our mortgage for various reasons and when asked why we can never receive a direct answer. They also call our phones at least 2 and 3 times a day. The first problem started when our company was switched about 5 or 6 years ago. They immediately increased our mortgage from XXXX to XXXX and when we asked about it they stated it was a short in escrow. The threaten to foreclose our home if we didn't pay a little over 7k. After we became current for a while our mortgage maintained at XXXX, but around XX/XX/2016 after the birth of my daughter we went through a loan modification and had to pay at least 3 payments on time to receive the modification. Once in the clear we were able to go back to paying XXXX. About 6 months ago we received another letter stating our escrow was short and we would have to XXXX instead of our XXXX a month. When we ask for documentation or clarification we get told they will send it in the mail, but on numerous occasions we have not received anything. We became current by paying online and they are now stating they are not receiving the online payments. Now we have 2 different confirmations and once we tell them the confirmation numbers they state they can't pull the confirmation numbers up. It has lead to us having 2 to 4 mortgages coming out of our account and having to pay overdraft fees to our banks in regards to it. We have also asked if we could separate our escrow and they state they couldn't do it. Just recently they listed us as foreclosed because they told my wife that I was deceased, and that she will have to be removed from the house if she couldn't afford the mortgage. As of now we have paid 2 mortgages back to back and every time we get current they state we are behind again. We are confused and are asking for justice to be served. They should not be able to harass and discriminate against their customers.

Consumer Complaint: I fell 3 years behind in payments due to severe XXXX injury & hospitalization from the XXXX war while on XXXX XXXX in the XXXX XXXX. I paid only XXXX for the home in XX/XX/2007. This date and the original purchase amount is also reflected on ALL of the original financial documents ( deed, etc ). M & T bank took over the loan and literally ADDED each and every payment ( plus interest ) that I fell behind on to the XXXX original purchase price. They, as a result, fraudulently ballooned the Home loan to almost {$590000.00}! M & T bank then put my payments from XXXX/month to almost $ XXXX/month and literally erased all 8 years of equity ( on time payments ) that I made on the loan. M & T bank then claimed that I must sign the agreement to pay almost $ 4000/month or face absolute & certain foreclosure. M & T bank ALSO INCREASED the number of years to pay the loan back to 30 years! I could not keep up with these payments and M & T filed foreclosure. This is fraudulent predatory lending. The length of the 30 year loan should have been extended by only 3 years in order to keep the monthly note the same, $ XXXX/month. The 8 years of equity ( 8 years of house note payments ) should be credited towards this loan in full. The original purchase price of XXXX for this Home should not have been changed.

Consumer Complaint: I had paid off a loan on XX/XX/XXXX with a certified bank check. The bank check had a balance of {$18000.00} after the loan was paid, and this balance was to be returned to me after the check cleared. I received a letter from the bank on XX/XX/XXXX stating the loan was cleared, and a manager told me the check " was being cut '' and would be mailed out to me.I never received the check. I contacted the bank to inquire about the check on XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX - and each time I was given a different story as to when the check was mailed. It has been over ( 4 ) weeks, and I still haven't been given a clear explanation as to where my refund is. I feel the employees are being less than honest as to the status of my refund.

Consumer Complaint: On XX/XX/18 XXXX XXXX billed the incorrect account I contacted M & T and explained that I can move the funds from the account that was supposed not be billed, but the fees incurred were not due to my actions. I was told they would be credited they were not and I subsequently got further fees due to low balance. I called back again to explain the situation and was promised it would be fixed. I received more fees. I called back and at asked for some to at least be waived as a courtesy if they were not willing to acknowledge the billing error that started this. To date I have received 6 fees due to the snowball effect of not having prior ones refunded.

Consumer Complaint: My mom died XX/XX/2017. She willed the house to my niece and nephew. We had filed a complaint prior to this one. The mortgage company ( M & T Bank ) was suppose to help my niece and nephew assume the loan. We tried making payments but they sent them back. First they said they had to be from my mom and dad who were already dead. Then as they were sending the payments back they were saying we were in default. Now supposily they are saying my niece and nephew have the loan in thier names they are still following through with foreclosure. How can they foreclose if someone has already assumed the loan. And try to foreclose while at the same time they are suppose to be helping. It's a fraud ... ... ... And all this because my mom died. This is not right and for them to foreclose on a home that they were supposily helping us modify the loan on is very illegal. We need to stop the foreclosure. We are low income and my niece and nephew are on SSI. We can't afford a attorney. Please help us. This is our second complaint.

Consumer Complaint: My name is XXXX XXXX and I have owned my home for 3 years and am in danger of losing it due to servicer negligence and an avoidable foreclosure. I am a veteran of the XXXX XXXX XXXX and was able to refinance this property with a VA loan. Due to a temporary hardship I fell behind on my mortgage payments and have been working diligently to get back on track with my servicer M & T Bank. I made the lump sum payment I thought would get my account current in XXXX, only to find out I was still behind due to all the fees and other charges they had levied on my account ; also, there was confusion due to another change in loan servicers ( there have been multiple changes in the short time Ive had this loan ). I could not pay anything more and decided to try to get my loan modified. I submitted multiple packages for review and after multiple denials I was finally approved for a trial modification. I made the first two trial payments, but then I was alerted that a small lien placed on my property by my homeowners association ( stemming from the same hardship period ) was going to cause M & T Bank to revoke my modification. That happened on XX/XX/XXXX, XXXXand M & T Bank then felt it necessary to set a foreclosure sale date for XX/XX/XXXX!!! I got them to postpone that sale date, but they rescheduled it for XX/XX/XXXX. I can make the agreed monthly mortgage payment but M & T Bank is not giving me a chance to get my mortgage back on track by rushing to sell my home so quickly. I am a XXXX XXXX XXXX veteran and am now a hard working employee of the XXXX XXXX XXXXXXXX. I also volunteer often with my churchs XXXX XXXX XXXX. In other words, Ive served my country in the military, I work now in a XXXX XXXX, and I continue to give back to my communityI do not deserve this treatment by M & T Bank. My hardship was temporary and I am back on my feet and able to afford the mortgage payment.

Consumer Complaint: On XX/XX/XXXX I cosigned for an auto loan through M & T Bank for my friend. I've never been late on paying anything in my entire life. On XX/XX/XXXX I received a phone call stating the account was overdue, and I immediately paid the balance. They kept asking me to verify my address, but would not accept my address, as somebody other than myself somehow changed my address without my permission. I then proceeded to ask how late the payments were and if this was going to negatively impact my credit. I was told that it already had. I pulled my credit report, and it dropped 114 POINTS. I asked how this could even be possible, why they never bothered to try contacting me until it was too late. I spoke with 7 different people, and nobody could answer the question. All I was able to find out was that this loan has been delinquent since XX/XX/XXXX, that my cell phone had been put on a " do not call '' list, and my address completely removed from their files. I am the cosigner on this loan and we are both equally responsible for this debt, so why is it that I was never informed it was delinquent- and for 8 months?! The moment I finally received a phone call from them I paid the balance! The last person I spoke with said he would file a dispute, but said their response would be sent to that address on file which is not even mine!!! I am severely concerned that a bank of this size would allow my information to be changed or removed without my knowledge- this is a HUGE privacy concern! And for them to act like it's perfectly normal is another issue. I am upset that the bank failed to contact me, had no respect for my outstanding credit history, and additionally the fact they never reached out could have been due to a security breach. I am taking this step to avoid further potential legal action against M & T Bank for damages to my credit character.

Consumer Complaint: While applying for new credit, I was informed that M and T bank had reported me 60 days late for the month of XX/XX/XXXX. When I reached out to the M and T, an associate informed me that they did not report my account late but when I checked my credit report, it was shown as late for XX/XX/XXXXwhich is inaccurate. The associates informed me to dispute with the bureaus at which point they will respond. Knowing this can take up to 30 days and most cases require supporting documents, I escalated and requested something in writing. I was informed I would received a letter within three business days and when I called I was informed I was be receiving it shortly. This was not the case.
