Consumer Complaint: I have a home in XXXX for 15 years with my wife. My wife passed and i had to go get the home changed into my name. M & T bank knew that and after a long court case got it into my name. I was working with XXXX XXXX XXXX XXXX and they approved my claim and was trying to work with M & T bank on a loan modification. We had been talking for 3 months working to get a deal done and M & T bank had a servicing company call XXXX which was supposed to service the loan but XXXX XXXX XXXX XXXX doesn't work with servicing companies only with banks. M & T was to talk with XXXX to keep them updated on what was going on with the deal we were trying to make but M & T never kept XXXX in the loop. XXXX then lied and said they spoke with XXXX XXXX XXXX XXXX on XX/XX/XXXX and stated they got a denial letter from XXXX XXXX XXXX XXXX. I talked with XXXX XXXX XXXX XXXX and they said they never spoke with XXXX and that my case was still pending. Neither me nor XXXX XXXX XXXX XXXX recieved and type of foreclosure notice or even a letter stating forclosure was immenent. On XX/XX/XXXX they forclosed on my home and took away any options i made have had which included short selling. They didnt wait the 20 days they are supposed to and have started to remodel my home. Im looking to get the foreclosure reversed so i can take my home back and either keep or sell. I would love to have help in this dire circumstance

Consumer Complaint: I received a {$250.00} Fee from M & T for not signing up M & T Bank 's Online Banking electronic billing statement program. I was under the understanding that I already was as I was an existing customer and my other accounts where electronic. On XX/XX/XXXX I received a letter warning that if i didn't sign up for auto payments and ebill that I would be fined. That day I called M & T 's customer services line. I informed the rep I was calling from the letter that was just sent. She looked over my account and told me that no further action had to be taken and that I can disregard the letter. The next month I was fined for not signing up, I have called the customer services line and refuted the charge. They keep coming back with that the warning letter was sent and I did not take action. I took action to mitigate my damages and was misled by an M & T rep and now have been charged {$250.00}.

MTB in cooperation and coordination with third parties did not comply with all the conditions precedent to completing a Trustee 's Sale as set forth in Section 22. Acceleration ; Remedies. of the deed of trust. The most pertinent part of Section 22, in the first paragraph, was that, I as Borrower, had the ... the right to bring a court action to assert the non-existence of a default or any other defense of Borrower to acceleration and sale. .... MTB did NOT notify me that I had a RIGHT to bring a court action to assert the non-existence of a default, but that I only had Loss Mitigation options. A copy of MTB 's XX/XX/XXXX loss mitigation letter is attached as Loss_Mitigation_letter.PDF. A literal reading and my interpretation of that part of Section 22 is once a court action is brought it applies to both acceleration and SALE. On XX/XX/XXXX, I filed a Lis Pendens given constructive notice that a Petition had been filed and that an action had been commenced and is now pending in the Circuit Court Of XXXX County, XXXX, Missouri against MTB and other defendants for the Cancellation of Written Instruments, Quiet Title, Declarative Relief, and to assert the non-existence of a default on a loan. A copy of the certified Lis Pendens is attached as Lis_Pendens.PDF. On XX/XX/XXXX, at XXXX XXXX, XXXX XXXX XXXX XXXX AS Trustee FOR XXXX XXXXXXXX XXXX PASS-THROUGH CERTIFICATES, XXXX XXXX ( XXXX ), the alleged legal owner of the loan, was served, by certified mail ( XXXX ), with the Petition referred to in the Lis Pendens giving actual notice to XXXX that a court action had been brought to assert the non-existence of a default and other remedies. XXXX, MTB, XXXX, and XXXX cooperated, coordinated, and decided to continue the Trustee 's Sale process notwithstanding that I had brought a court action to assert the non-existence of a default to acceleration and sale. in compliance with Section 22 of the deed of trust. XXXX, MTB, XXXX, and XXXX cooperated, coordinated, and decided to continue the Trustee 's Sale process notwithstanding that they had constructive notice by way of a Lis Pendens that had been filed six days before the Trustee 's Sale. XXXX, MTB, XXXX, and XXXX cooperated, coordinated, and decided to continue the Trustee 's Sale process notwithstanding that they all had been served with the Petition referred to in the Lis Pendens and all had actual notice of the court action before XX/XX/XXXX. The most pertinent part of the second paragraph of Section 22 of the deed of trust reads as follows : If Lender invokes the power of sale, Lender or Trustee shall mail copies of a notice of sale in the manner prescribed by Applicable Law to Borrower and to the other persons prescribed by Applicable Law. Trustee shall give notice of sale by public advertisement for the time and in the manner prescribed by Applicable Law. The Applicable Law in the State of Missouri prohibits a foreign corporation from serving in the role of a Trustee. MTB and XXXX appointed XXXX of XXXX XXXX, KS as Successor Trustee. XXXX is a foreign corporation. The Applicable Law in the State of Missouri for public advertisement reads in pertinent part ... shall be given by advertisement, inserted for at least twenty times, and continued to the day of the sale, in some daily newspaper, in counties having cities of fifty thousand inhabitants or more, ... XXXX did not comply with Applicable Law as to public advertisement, in that, XXXX did not insert advertisements for at least twenty times, and continued to the day of the sale, in some daily newspaper, but only made a total of four public advertisements on dates XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX in a newspaper that only included LEGALS on Fridays. WE WERE ADVISED THAT MT BANK SENT {$220.00}, BUT {$120.00} WAS SENT BACK TO THEM FOR OVERPAYMENT. XXXX ADVISED US TO SEND COPIES SHOWING WE PAY THE COUNTY TAXES. WE DID. IN XX/XX/XXXX, WE SPOKE TO XXXX XXXX XXXX IN THE MORTGAGE CUSTOMER SUPPORT DEPARTMENT AT XXXX, SHE REVIEWED THE ACCT AND SEEN WHERE WE HAVE BEEN PAYING THE COUNTY TAXES FOR OVER 15 YEARS AND NEVER HAS MT BANK PAID, UNTIL NOW. SHE ADVISED US TO PAY THE {$98.00} TO HER BY CHECK AND THAT WOULD CLEAR THE PROBLEM UP. AND THAT MY MOTHERS ACCT WILL GO BACK TO REGULAR PAYMENTS AND TO WRITE AND ADVISED FOR MT BANK TO NOW OPEN AN ESCROW ACCT, BECAUSE WE PAY THE COUNTY TAXES AND MY MOMS GET A TAX FREEZE ON HER CITY TAX BECAUSE SHE ELDERLY AND XXXX, SO SHE DOESNT HAVE TO PAY THE CITY TAXES. I SENT THE LETTER IN XX/XX/XXXX, AND MT BANK WRITES BACK THEY ARE CONTINUING WITH THE ESCROW ACCT BECAUSE WE THE TAXES FOR XXXX AND XXXX WERE NOT REMITTED TIMELY. THE TAXES IN XXXX WERE PAID ON TIME AND WE HAD ARRGMTS FOR XXXX FOR THE {$98.00} DUE, WE NEVER RECEIVED ANY DELIQUENT NOTICE FROM OUR COUNTY TAX OFFICE BECAUSE WE PAY ON TIME. MY MOM COUNTY TAXES ARE ONLY {$300.00} AND MT BANK IS CHARGING HER AN EXTRA {$150.00} A MONTH. I SPOKE WITH XXXX A SUPERVISOR IN THE TAX CUSTOMER SERVICES CENTER ON XX/XX/XXXX HE ADVSD HE WILL RESEND TO ESCROW. I ASKED TO SPEAK WTH AN ESCROW REP HE REFUSED ADVS TO WAIT UNTIL THEY SENDS A LETTER. I ADVISED HIM IN 15 YEARS WE HAVE NEVER HAD A PROBLEM WITH PAYING THE HOUSE NOTE OR TAXES BUT NOW MT BANK WANTS TO OPEN AN ESCROW ACC WHICH WE REFUSED AND PAY TAXES THAT THEY SHOULDNT PAY. Consumer Complaint: I deposited {$300.00} cash into a vacation club savings account at M & T Bank branch in XXXX NJ. The deposit never went into my account. A copy of the receipt from the teller was emailed to their customer service rep and I have had conversations with the branch manager, XXXX. They have been in contact with their back office and to date my account has not been credited. On XX/XX/2018 XXXX stated sometimes this can take a week or more even if it was a cash deposit that did not post to the account. He said they can only contact the department that makes corrections by email and their is no senior management person he can call to inquire as to why this is taking so long. I want to close the account now as I am so frustrated with all the errors M & T has been making on other accounts as well that we have been having. Those issues have been finally resolved and this remains open. While I know this issue will get resolved eventually, it is mind boggling that cash ( and this could just as easily have been {$3000.00} in cash I would not have access to ) deposits go missing and the customer has to wait for days for a simple correction to the account that is clearly the bank 's error. What is the point of getting the receipt for a cash deposit. It is further distressing that if I had not checked on line that the balance was wrong, M & T Bank did not flag an error from a deposit made on XX/XX/2018. Had I had balanced our accounts as I do monthly, my husband and I, who are both over XXXX years old and have health issues would never have seen this money again. I have spent hours on the phone with M & T Bank, including their corporate offices in XXXX. What do people do who do not have the resolve to do this. How many other cash deposits may M & T posted into a black hole never to deposit correctly. This is the bank that had money laundering issues and could not complete the purchase of XXXX XXXX XXXX Bank in NJ ( who was a great bank ) for over three years because of the money laundering issues.

Consumer Complaint: my issue is two fold 1 ) : XX/XX/2018 XXXX XXXX I wrote the following secure message " Saturday, XX/XX/XXXX we received an Annual Escrow Account Disclosure statement informing us that starting XX/XX/2018 our new monthly mortgage will be {$190000.00} and that we have a shortage of {$640.00}. Further it informed that if we don't pay this amount immediately, the shortage will turn into a payment plan for the next 12 months. I find this to be one of many errors by your institution. In XX/XX/2018 we received our annual escrow account disclosure statement, informing us our monthly mortgage would be {$2000.00} and our shortage was {$850.00}. This amount was paid in full with check # XXXX on XX/XX/2018 and deposited by your institution on XX/XX/2018. Therefore, I am unsure why we are getting a second annual escrow account disclosure statement ( we have always just received one annually ). I have also informed your institution in writing that we have met the criteria for our Private Mortgage insurance to be dropped as of XX/XX/2018. I was assured it was but have yet to receive a formal letter verifying this. I would greatly appreciate it if someone from your institution can explain the annual escrow account disclosure statement discrepancy and provide us with a written formal letter that the PMI has been discontinued. The reply I received was '' Thank you for your inquiry. I have forwarded your message to the appropriate area as a rushed request. Please be, once the research is complete, you will be contacted and provided the conclusion of the research. We appreciate your patience while we review your inquiry further If you have any further questions or concerns, please feel free to contact our Contact Center at XXXX. XX/XX/2018 I logged on to my bank and noticed M & T Bank withdrew the new amount of {$2000.00} without supplying me with a answer of why I was receiving the second escrow 2 ) XX/XX/2018 XXXX XXXX I wrote the following secure message to M & T Bank : " I am writing to request the cancellation of the Private Mortgage Insurance ( PMI ). As you are aware, Federal law allows for the cancellation of PMI when certain LTV ratios are met through the normal amortization of a mortgage, or amortization coupled with market appreciation. Although the Homeowner 's Protection Act of 1998 calls for the automatic cancellation of PMI when a 78 % LTV ratio has been reached through normal amortization, I also understand that I may request cancellation of my PMI when I have passed an 80 % LTV threshold. I believe that through regular payments and favorable market conditions that I have passed that mark, and therefore should be able to cancel the PMI on my loan. I believe that my payment history also meets appropriate requirements. Please advise me of the procedures for doing so at your earliest convenience. I look forward to your prompt reply. XX/XX/2018 I received the following message From- M & T `` Dear XXXX, Thank you for your inquiry. Please be advised, once the final Mortgage Insurance Premium ( MIP ) has been paid to HUD on XX/XX/18 an escrow analysis will be completed to remove the MIP from the monthly payment. Once the escrow analysis has been completed, a statement will be sent to the address of record advising you of the new payment amount. "
