Consumer Complaint: My account at XXXX recently went negative {$8.00}, XXXX on XX/XX/XXXX due to an M & T Bank check that I deposited into my account on XXXX the XXXX 2023. That would be 4 months ago. XXXX informed me that they found out M & T Bank would not be fulfilling this check on XXXX the XXXX which was roughly 120 days later keep that in mind. I have reached out to my bank and I've reached out to M & T Bank and I reached out to the check writer. It comes from a car dealership who has informed me that they've never had a check not clear nor have they ever had XXXX bounce. Being that I deposited almost a half a year ago now I don't even remember the guy 's name that personally sent me that check unless someone's able to read his handwriting off of the actual physical check. But that's besides the point because right now my issue is with M & T Bank and M & T Bank should have an issue with the check writer if they say they can't get the funds. I want to be clear also this check didn't bounce the only excuse they gave you XXXX was they weren't going to fund it that could mean a XXXX different things and I don't know what it really means I just know it means that they took that check back out of my account and did so 100 % illegally according to the law and regulation written by and for the board of governors for the Federal reserve system. I also called M & T Bank and got them on a recorded line now three different times consecutively each teller or banker telling me when I specifically asked if I deposited a check over {$5000.00} into my account When can I expect M & T Bank to contact my bank to let them know it would be fulfilled or not, what are the legal time limits you have as a bank at M & T Bank to let my bank know that and each one of them has told me no more than 10 days which according to the law is incorrect it's less than that but regardless none of them has gone above 10 days. Again mine was pulled back out of my account after 120 days. Any sensible person in their right mind especially after waiting the initial XXXX weeks after deposit to receive my funds, would expect that those XXXX weeks are utilized for seeing if the check is good or not because if it wasn't good then you wouldn't give me the money that is XXXX the depository bank. Now according to Federal regulation section XXXX notice of non-payment reads as follows and I quote : states that paying banks are required to provide notice of non-payment to the depository bank on all returned checks of {$2500.00} or more. This notice is to be received by the depository bank no later than XXXXXXXX XXXX. on a second business day following presentation. So the law reads second business day after I've handed them a check yet someone thinks it's okay to say they're not going to fund the check and debit it from my account after 120 days nearly half a year. XXXX XXXX collection of checks XXXX paying banks responsibility for return checks. TO DECREASE THE RISK TO A DEPOSITORY BANK THAT A CHECK WILL BE RETURNED AFTER FUNDS HAVE BEEN AVAILABLE FOR WITHDRAWAL, REGULATION CC REQUIRES " EXPEDITIOUS '' RETURN OF CHECKS. A PAYING BANK RETURNS A CHECK EXPEDITIOUSLY IF IT RETURNS A CHECK TO THE DEPOSITORY BANK WITHIN XXXX BUSINESS DAYS OF PRESENTATION. ( There are no longer checks subject to the XXXX day test because they no non-local checks ) alternatively, a bank returns a check expeditiously if it sends a check in the same manner as it would have sent The check for forward collection. Now I have XXXX other pages of law that all explain how that money needs to be deposited back into my account because what happened was illegal according to law timelines and regulation. I need this to pay my bills I still haven't even paid my rent and wherever I paid any of my bills because I can't when it's negative {$8400.00}. There's also a timeline which this needs to happen according to law and if this doesn't happen expeditiously I will be getting a legal team together and this will end up costing M & T Bank much more than {$8400.00} as I will also be asking for lawyers fees and court costs on top of all the fees I have with every other bill I'm not able to pay now and any other damages I have thus gone through to this point because of someone doing something illegal at M & T Bank damaging my account my character my ability to pay my bills and causing undue stress, lack of sleep, in a sense of unease about everything because it's the only thing on my mind. I can assure you as these sections in the law that I have that I will provide you with as well we're pointed out to me by lawyers And I've been informed if I can't get you guys to just follow the law and try to push it off onto somebody else as if it was their fault when this was between XXXX banks and it's not because of a bounced check it's just because the funds wouldn't be fulfilled for whatever reason The reason which I was not given nor was XXXX all sounds too fishy to me. And at that point I will then go ahead and have my lawyers reach out to you from the XXXX XXXX XXXX XXXX XXXX office. I truly need this handled immediately I have no time to waste and I am already roughly 10 days or more into my XXXX window of sending in an official complaint which will undoubtedly get me funded through this complaint process so long as I follow it steps so I can go about it XXXX of XXXX ways This is just my first attempt with you guys to do it sensibly. I assure you you've never heard somebody's check not being fulfilled 4 months later that's unheard of that's not expeditiously that's not second business day and even the law states they got rid of the four-day waiting period nowhere does it say anything above 4 days. And although there are exceptions, even though we're still well outside the time frame for exceptions if they were made, certain things need to have taken place that did not take place like in writing me receiving when I would be finally seeing the money or when I wouldn't be there needs to be a time frame written down as well as multiple other things that did not take place that I will provide You with in the regulation. Lastly I definitely need this handled immediately and I do not have 60 days to wait on this. Again I'm trying to do a sensibly maybe it was a mistake maybe somebody working up there did something they weren't supposed to it could be a multitude of things but I know XXXX thing it's not my fault the money was there and is there and I just need this money back because I'm not going to file bankruptcy and ruin my life because somebody wanted to do something illegal at M & T Bank. That's what the laws are put in place for they're not to go by every once in awhile they are to be followed and adhered by at all times. Not just by me but by you also.

Consumer Complaint: I contacted M & T Bank in XXXX and again earlier this week. In XXXX, I requested available options to lower my monthly payment to avoid delinquency. The representative I spoke with was so dry, unprofessional, and non-empathic that I disconnected the call. It was clear that she was not interested in helping me. In late XXXX, the company I had just began employment with in XXXX began layoffs. I have now been unemployed since XX/XX/XXXX and recently declared bankruptcy. I contacted M & T Bank this week after receipt of a letter offering options to modify my original note and reduce my monthly mortgage payment through on of their loss mitigation programs. Again, I got a representative that was not at all interested in helping me. I explained to him that I was unemployed and his only response is that he couldn't help me, no other alternative options were provided. Today I received a letter from them again. This time, the options are listed as : repayment plan, unemployment/special forbearance, loan modification, short sale, and deed in lieu of foreclosure. Why hasn't any of these options or alterntatives been offered to me by the two preceding representatives? It is customary in service to exhaust all options available to best help the consumer. M & T Bank has done nothing to try and help me. Considering I am now unemployed, the male representative I spoke with this week could have offered the unemployment/special forbearance. Additionally, they do not explain the options to you or take time to work with you on best fit. I want to keep my home, but a little assistance in trying to do so would be greatly appreciated.

Consumer Complaint: XXXX XXXX, Director, Consumer Financial Protection Bureau Attn : XXXX XXXX, Complaint Per the FCRA as a federally protected consumer I am now opting out of any and all authorization. I, the consumer may have given you written, unwritten, verbal and non verbal Per 15 USC 6802. Effective immediately ; indefinitely. According to my credit reports, there are third party reporting agencies reporting my private information to all three credit bureaus, which is a violation of my Privacy Right, ( Privacy Act of 1974 ) Also, there are charge offs listed on my credit reports. A charge off is considered a Certificate of Indebtedness, which means it is income and has to be removed. Income can not be reported to my credit report. The law says it's illegal to report transaction history. All bank accounts are insured per 15 USC 1681, I have not received any interest or payment. I gave them a security 16 CFR 444.1. There are Inquiries ( Promotional Inquiries ) 15 USC 1681 Permissible Purposes, {$1000.00} fine each occurrence. ( sent to the address listed above ) Lastly, I've been suffering tremendously because of these issues listed above. Ive been humiliated from being denied cars and homes, credit etc. Brokers/banks/lenders not accepting my applications. Telling me I need a XXXX deposit. I've been homeless because of this. For pain and suffering, humiliation, emotional damage etc. A {$20000.00} XXXX XXXX Dollars payment can be sent to the address above. Also, all negative reports should reflect good standing. Consumer Complaint: Back on XX/XX/2010 I deposited {$100000.00} into account # XXXX with XXXX XXXX XXXX on XX/XX/2010 I took a passbook loan against that account in the amount of {$30000.00} ( which they deposited {$40000.00} ) into Savings Account # XXXX. I never received a passbook for these funds. They Bank kept it as collateral. I never received any information with respect to the {$60000.00} that was left in account # XXXX, I thought all the money was kept in the same account. Over the years, XXXX XXXX merged into XXXX XXXX XXXXXXXX XXXX and then merged into M & T Bank. Recently I went to the bank with a question regarding my balance as it did not seem right and was working with them to try and find the {$60000.00}. I was told by a teller at the bank that on the same date as XX/XX/2010 there was an account opened for {$600.00} which I think was the {$60000.00} but was a typo on their part and that account was closed ( not by me ) I am now being told that I have to prove to the Bank that I did not take the money out- which I did not and therefore would have no proof of. I was told that their bank records go back 7 years and they have no record of this.

Consumer Complaint: M & T Bank - XXXX Funds Frozen On XX/XX/2023 the day that I receive my XXXX check as I am a XXXX XXXX XXXXXXXX XXXX XXXX all of my accounts were frozen under suspicion of fraud. I went to the local branch to verify my identity and confirm there was no fraud activity on my account. My wife deposited a XXXX car insurance check for {$3400.00} as our parked car was hit and the second action was my wife sent me a XXXX for {$1300.00} dollars. My mortgage was declined due to my accounts being frozen. I requested to please at least give me access to my XXXX check for my mortgage as I am on a repayment plan and if payments are not meant on the schedule provided I will face immediate forclosure. They have denied this request as of XX/XX/2023. Even though I have given all documents to show and dispell any fraudulent activities, they are holding my XXXX check XXXX and forcing me into foreclosure if this isn't rectified immediately. I explained that XXXX months of my XXXX payments are off limits. ( Look Back Period ) At this time I feel I am being targeted and discriminated against because I am a minority XXXX veteran.

I contacted the branch XXXX and was instructed on what were the necessary items to be provided in order to receive this money. My brother had no wife, no children, and both parents are deceased, so I am his next-of-kin. I provided a certified death certificate, a copy of the paid-in-full funeral home invoice for cremation and graveside services, and a letter of intent stating my reason for claiming my brother 's funds with my notarized signature. I can't remember the exact date that I called M & T Bank, but it was some time in the middle of XX/XX/2023. The last correspondence I received was a piece of paper requesting a notarized signature along with boxes to check stating various facts, but I disagreed with XXXX of them, so I called the branch XXXX many times to tell her this, and she refused to answer my phone calls or return my calls. Specifically, I did not want to check the box which said that I acknowledge receipt of {$1500.00} because I have not received any money.

I was not made aware of this claim initiated. The insurance check received included my name as XXXX of the payees. The check cleared shows that it was endorsed by a " XXXX XXXX XXXX '' with either M & T Bank and/or XXXX XXXX XXXX XXXX XXXX XXXX. The check cleared XXXX XXXX XXXX on XX/XX/2023, however I never received these funds. XXXX XXXX XXXX knowingly cashed a check bearing my name without proper authorization, constituting an act of check forgery. I sent certified mail letters to XXXX and M & T Bank on or about XX/XX/2023 requesting all documentation related to the Citizens Property insurance claim, but to date, I have not received a response to these letters nor have I received the insurance claim funds. Furthermore in late XX/XX/2023, it appears that M & T Bank realized what may have happened and began altering my payment records. Apparently the insurance claim funds were applied to my loan balance without my knowledge. The misrepresentation of mortgage loan transactions led to falsified and inaccurate payment history. This deliberate manipulation of records mislead me about my actual payment obligations and affected credit ratings and financial standing. The evidence presented demonstrates a clear pattern of deceptive practices by XXXX XXXX XXXX XXXX M & T Bank, including check forgery and deliberate misrepresentation of mortgage loan transactions and payment history. These actions not only breach fiduciary duties but also violate established consumer protection laws.

Consumer Complaint: On XX/XX/23 I went to my local branch M & T to get a medallion stamp. The branchs Manager questioned the form when its a Fiscal Form from the Treasury. This particular Branch has been known for discriminatory behavior, Lying to their customers about only notarizing statements because their not familiar with the customer. The unprofessionalism and discrimination will not be tolerated at this Branch. This particular form the manager stated she has to check with her legal team as she can not sign on behalf of the bank when the Bank is the Trustee! It was explained the nature of the form and she shouldnt be questioning me about it when it clearly states the purpose of the form. The last page just asks for a stamp. The manager had no issue with stamping any of my other forms except this one! As the Trustee of said Bank its her duty to fulfill its obligations and leave her personal discretion out of business. The staff at this location displays unprofessional behavior when customers of color enter the branch! Notarys are only to identify the persons signature as well on the Fiscal Forms! Its contents unless otherwise specified the notary shouldnt read due to privacy. These practices will not be tolerated by its customers who is making money for this institution!
