Consumer Complaint: XXXX XXXX XXXX XXXX XXXX XXXX, NY, XXXX Date : XX/XX/ Dear Consumer Financial Protection Bureau, I am writing to file a formal complaint against LexisNexis concerning an unresolved issue that necessitates immediate attention and resolution. On XX/XX/2023, I corresponded with LexisNexis regarding a recorded bankruptcy on my credit report. My sole intent was to seek clarification regarding the verification methods employed to validate this entry, rather than dispute the account itself. To ensure transparency, I provided a copy of my New York State ID and recent utility bill as proof of address. Despite my initial inquiry, followed by a subsequent letter dated XX/XX/2023, I encountered a delayed response from LexisNexis on XX/XX/2023, which exceeded the 30-day FCRA timeframe by six days. In my XX/XX/2023 letter, I indicated my previous challenge of the accuracy of this account with the credit bureaus. LexisNexis responded by asserting verification through their procedures. However, my personal visit to the courthouse contradicted this claim, as they confirmed their non-engagement with LexisNexis, providing a formal statement to that effect. I urged LexisNexis to furnish any documentation outlining their verification process within 30 days or delete the bankruptcy item from my credit profile. Enclosed were documents reinforcing my address, the courthouse letter, and my communication with PACER. Subsequent letters dated XX/XX/XXXX and XX/XX/2023, yielded generic responses from LexisNexis, citing verification through PACER. However, upon reaching out to PACER directly, they confirmed their non-verification of this bankruptcy item with LexisNexis. Both the courthouse and PACER explicitly stated their lack of communication with LexisNexis. On XX/XX/2023, I reiterated this information to LexisNexis, revealing inconsistencies in my credit file. Their record indicates my residence as XXXX XXXX XXXX, XXXX NJ, which starkly contradicts my true address documented in my New York State ID and utility bill provided since XX/XX/2023. This discrepancy raises doubts about the accuracy of LexisNexis 's data or the veracity of their claims. I included copies of my ID, utility bill, courthouse and PACER communications, and issued a 30-day ultimatum for a response or faced with a formal complaint to the CFPB. Despite these communications, as of XX/XX/2023, I have yet to receive written confirmation from LexisNexis regarding the deletion of the bankruptcy item from my file. This ongoing refusal to rectify the error constitutes a violation of FCRA and has inflicted undue stress, anxiety, and an impediment to my ability to purchase a home. Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX, XXXX XXXX XXXXXXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates.XXXX XXXX, XXXX XXXX XXXXXXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX the financial institutions and the Consumer reporting agencies XXXX, XXXX and XXXX do not have my consent to furnish my private information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, XXXX and XXXX XXXX, XXXXXXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX XXXXXXXX whether it be verbal, non-verbal, written, implied or otherwise is hereby revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure optionXXXX XXXX, XXXX XXXXXXXX, XXXX XXXX XXXXXXXX, XXXX XXXX, XXXX XXXX never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. You are hereby put on notice that I am opting out of your reporting services! Additionally you are hereby put on notice that I elect to invoke my rights under the Copyright Act of 1790, the Title is copyrighted and held in trust, any and all unauthorized use will follow with an invoice for copyright infringement.
