Consumer Complaint: LexisNexis continues to report inaccurate information. I have not given any authorization to LexisNexis to furnish this alleged bankruptcy. How was LexisNexis able to verify this alleged bankruptcy. Who did LexisNexis speak with to verify this information? LexisNexis is required to report accurate information. 15 U.S. Code 1681e - Compliance procedures U.S. Code Notes prev | next ( a ) Identity and purposes of credit users Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. These procedures shall require that prospective users of the information identify themselves, certify the purposes for which the information is sought, and certify that the information will be used for no other purpose. Every consumer reporting agency shall make a reasonable effort to verify the identity of a new prospective user and the uses certified by such prospective user prior to furnishing such user a consumer report. No consumer reporting agency may furnish a consumer report to any person if it has reasonable grounds for believing that the consumer report will not be used for a purpose listed in section 1681b of this title. ( b ) Accuracy of report Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. This bankruptcy is listed with all of the credit bureaus and here. How did the credit bureaus verify my bankruptcy as 100 % Accurate. Your company did not get this information from any clerk at the courthouse since they do not report. You have violated my rights. They never did a fair investigation according to the 15 USC 1681. 15 USC 1681 section 603 ( 3 ) ( E ) States ; The term investigative consumer report means a consumer report or portion thereof in which information on a consumers character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or who may have knowledge concerning any such items of information. However, such information shall not include specific factual information on a consumers credit record obtained directly from a creditor of the consumer or from a consumer reporting agency when such information was obtained directly from a creditor of the consumer or from the consumer. They also violated my rights numerous times. The credit bureaus violated my given rights under 15 USC 1681. According to : 15 U.S.C 1681 section 602 A. States I have the right to privacy. However, upon attempting to do so and entering the provided PIN, I encountered technical difficulties as the PIN did not work. As of today, XX/XX/2023, a second letter " Dispute and Request for Verification of Bankruptcy Information under FCRA XXXX ( a ) ( XXXX ) '' is being sent via XXXX XXXX Mail with Tracking ID # XXXX. Enclosed are my valid ID and XXXX XXXX XXXX. I am also requesting the unverified information to be deleted immediately. I believe there may be a violation of the provisions outlined in 15 U.S. Code 1681s2 ( a ) of the FCRA by failing to respond adequately to my dispute, requesting unnecessary verification, and providing inaccurate or inaccessible consumer report information. I kindly request the Consumer Financial Protection Bureau to investigate this matter thoroughly and take appropriate action against Lexis Nexis for potential violations of my rights under the FCRA, specifically under 15 U.S. Code 1681s2 ( a ). Consumer Complaint: LexisNexis is the company I am writing to you about. I found an issue with my consumer file pertaining to my criminal history. My criminal record is still being reported beyond the 7 year window that is enforced through the FCRA Seven Year Reporting Window. The accuracy of this criminal information is not in question here today in this matter. However the reporting of criminal information exceeds the reporting of the 7 year period. According to 15 U.S. Code 1679c ( a ) - Disclosures, I must dispute this information with the cfpb. Consumer Credit File Rights Under State and Federal Law You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any credit repair company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported for 10 years. The seven year limit for reporting criminal charges on background checks begins when the charges are filed, not when theyre dismissed, a federal appeals court recently ruled, In the XXXX XXXX XXXX XXXX XXXX XXXX XXXX ruled XX/XX/XXXX that the measuring period for a criminal charge runs from the date of entry rather than the date of disposition under the ( FCRA ). In the 12 states ( California being one of those States ) that limits conviction reporting to 7 years, the disposition/conviction date is the date of the adverse activity and should be used to calculate the 7 years. If needed, a CRA can also use the date of release from incarceration or the start date of parole to bring convictions into scope. 15 U.S.C. 1681c ( a ) ( 5 ) states that no consumer reporting agency may make any consumer report containing certain specified items of information or [ a ] ny other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. California 's Seven-Year Lookback Rule California includes a seven-year restriction on the reporting of convictions within the ICRAA. This law is found at Cal. CONVICTIONS : Go by disposition date. However, for " seven-year states '' that limit reporting convictions to 7 years from " disposition, release, parole, '' you can go by release date from incarceration or start date of parole, even if the conviction date is older than 7 years. Never consider probation to bring something into scope. SEVEN-YEAR STATES : California, Colorado, Kansas, Maryland, Massachusetts, Montana, Nevada, New Hampshire , New Mexico , New York , Texas, and Washington. [ In some of these states, the 7-year reporting restriction for convictions only applies if the applicant does not meet a certain salary threshold. Also note : The District of Columbia limits the reporting of conviction data to 10 years. Please Remove or Delete my criminal information from my consumer file. CRAS ARE PROHIBITED BY LAW to report inaccurate information. Pursuant to the FAIR CREDIT REPORTING ACT 15 USC 1681 ( a ) ( 4 ). I am a federally protected consumer and I have a right to privacy.
