Consumer Complaint: I have struggled with LexisNexis over the plainly incorrect information on my XXXX Report since early XX/XX/XXXX for over XXXX months now but to no avail. The XXXX XXXX XXXX XXXX XXXX XXXX, and past XXXX XXXX XXXX XXXX in my XXXX Report belong to a person of a similar but different name, of a different gender, with a different driver license no. in a different state. While I have explained to them over phone XXXX times the name is similar but different, and I just moved to the U.S. in XX/XX/XXXX so the current address is my first residential address in the U.SXXXX and my driver license is also the very first driver license I have in the US since XX/XX/XXXX. So there is no way I would have all those policies and claim records etc in another state before. LexisNexis filed an investigation application for me by early XX/XX/XXXX, but since then I received different reports per investigation item with results " unverifiable '' or " data is accurate '' ... ( each time a letter takes XXXX days to reach me while there is no online update/alert available ) I called their Customer Service XXXX times ( sometimes they still could not locate my driver license copy which I have uploaded XXXX ). I explained the error again and again, that they might be drawing data from the sources under the wrong name so XXXX time they got investigation reports saying the " data is accurate '' under that person 's name. But it is another person 's name with another driver license no. in another state, how could that be " accurate ''? Each time the Customer Service personnel just insisted that they or their supervisors ( even if I talked to XXXX ) could not correct the info for me but they must go through the " dispute '' procedure to submit my case to the source providers ( e.g. the insurance companies that provide the claim records ) and let them clear the records for me. However if LexisNexis keeps using the wrong name to " dispute '' with the source providers, they would never get my records correct. This is such a simple problem but they insisted on the " dispute '' procedure. Not until I finally reached a supervisor in mid XX/XX/XXXX that she realized they might need to re-establish the report under the correct name for me instead of going through the " dispute '' procedure. By end XX/XX/XXXX I called and they said things were still in progress. On XXXX XX/XX/XXXX I received a letter with subject " State Privacy Act Request - Confirmation of Receipt '' ( letter dated XX/XX/XXXX ), which I do not know what request it is, and which says " we will verify the information you provided '', " we may not be able to comply with your request if we are unable to confirm your identity or to connect the information you submit in your request with personal information in our possession ''. It is absolutely frustrating as over the XXXX months during the many times I called, I uploaded all the documents they requested even more than once. I asked them many times what other documents needed to prove my identity and 'I am not that wrong person ', they said no.

Consumer Complaint: In pursuant to 15 USC 6802 ( b ) I called and explained to the consumer service rep that my consumer report and personal information is federally protected. I advised them of my rights per FCRA 604 ( 2 ) and also my federally protected right to " opt out '' as explained in 15 USC 6802. They told me that they can not allow e to " opt out '' thus is a violation of federal law. This section also states as a disclosure to the consumer that a CLEAR and CONSPICUOUS disclosure is to be made in writing and also authorized with the consumers signature before any consumer private protected information can be used or reported. In violation of FCRA ( A ) ( i ) you have furnished a consumer report without my written consent and have fail to to produce evidence of said disclosure as described within the FCRA.
