Issue: Attempts to collect debt not owed
Subissue: Debt was already discharged in bankruptcy and is no longer owed
Consumer Complaint: On XX/XX/XXXX I ordered my credit report, and looked through it thoroughly. I was shocked to learn I had several collection accounts listed on my credit report. I decided to reach out to the collection agencies for clarification on the alleged debt they insisted I owed. Unsatisfied with the outcome from speaking with the collection agency, I decided to reach out to the original creditors. It was then I learned in great detail about the alleged debt, details I either could not get from the collection agencies or when I did receive information from them was totally inaccurate. It was then the discrepancies became apparent, these discrepancies I will list below. I C System is listed on my credit report as the collection agency for XXXX, XXXX merged with XXXX on XX/XX/XXXX. I called XXXX for clarification of the alleged debt I C Systems listed on my credit report in the amount of {$1200.00}. XXXX had no recollection of the debt with I C System. XXXX however has another collection agency XXXX XXXX XXXX ( I wrote a separate complaint for this collection agency ) collecting the alleged debt on behalf of XXXX ( which is now XXXX ) in a different amount of {$460.00}. How can two ( 2 ) different collection agency attempt to collect an alleged debt for the same creditor in two ( 2 ) different amounts? I have had the same phone number for at XXXX years, In addition to this according to XXXX, as evidence by the recorded conversation I attached to this complaint. I C System is Re-aging this fraudulent account. ( IC Systems should not be attempting to collect according to XXXX, as they are NOT the collection agency who is in possession of the debt ). XXXX Date of last activity is XX/XX/XXXX ( as evident by the recorded phone conversation with XXXX ) On my credit report I C Systems has the date of last activity as XX/XX/XXXX on XXXX and XXXX XXXX XXXX XXXX. This is a grave injustice and totally illegal. According to Fair Credit Reporting Act { FCRA } If you are a debt collector furnishing information to a CRA about the accounts of a creditor, you must report the date of delinquency given to you by the CREDITOR FCRA 623 ( a ) ( 5 ) ( A ) This " date of delinquency '' determines how long the debt can be reported on a consumer 's credit report. Generally, a CRA may report a delinquent debt for seven years from the date of delinquency. If the debt was discharged in bankruptcy, however, a CRA may report it for 10 years. I have never had a bankruptcy.

Consumer Complaint: I recently decided to fix my credit DIY style, started by ordering my credit reports and looked at every account as if it was under a microscope. One by one I realized that re-aging of accounts was astonishingly prevalent and running rapid on my credit report. I couldnt believe it! Nevertheless I decided to contact the collection agencies to clarify the debt ( not verification or validation ), I didnt get very far as they could not or would not answer my questions. Thats when I turned to the original creditors for answers, they were able to answer every questions I had but, then another problem arose. The information reported by the collection agencies to the bureaus were different than what I was being told by the original creditors. Surly the original creditors will know Activity date, date the account was open and so on. I C Systems INC is the collection agency for the original creditor of XXXX XXXX XXXX XXXX. According to XXXX XXXX XXXX as evident by the recorded phone call attached as evidence ( I live in a one party consent state- New York ). The Date Of Last Payment XX/XX/XXXX ( last activity date ), the Date Account Was Closed XX/XX/XXXX. According to the collection agency I C Systems the date of last activity is XX/XX/XXXX on XXXX and XX/XX/XXXX on XXXX. I C Systems INC is re-aging the account, this is illegal. I C SYSTEM ( Original Creditor : XXXX XXXX XXXX XXXX ) XXXX XXXX Date Last Active : XX/XX/XXXX XX/XX/XXXX Recording According to the recording the agent of XXXX XXXX XXXX XXXX XXXX states at ( XXXX timestamp of the recording ) that the last payment was XX/XX/XXXX in the amount {$120.00}. This date is the last date of delinquency ( known as the delinquency date or date of last activity ). However the I C Systems Inc is listing the last date of activity as XX/XX/XXXX on XXXX and XX/XX/XXXX on XXXX. Lastly Ill like to discuss how re-aging hurts the consumer, and destroys their credit and reputation. It affects the consumer like myself credit worthiness much longer than it should. Uncollectible collections accounts forces the consumer to reluctantly and unknowingly settle the collection.

Consumer Complaint: On XX/XX/XXXX I had a procedure performed by XXXX XXXX c/o XXXX XXXX XXXXXXXX for XXXX XXXX XX/XX/XXXX I had not received a bill and I reached out to XXXX XXXX XXXXXXXX by phone and spoke to Team Leader XXXX XXXX XXXX I communicated that my insurance company had been billed {$17000.00} and that I had not received a bill. I communicated that {$17000.00} far exceeded the amount I had agreed to prior to the procedure. XXXX told me not to worry about it, that {$17000.00} was an incorrect amount and they just sent that to the insurance company. I requested that a bill be mailed to me. After the call XXXX then emailed me a partial Account Review summary via an insecure email. The Account Summary appeared to be incomplete as the Insurance billing portion was cutoff. No bill came in the mail ever. I called back and I requested no further emails since the email was insecure. They told me a bill would be mailed. XX/XX/XXXX I spoke to a XXXX at XXXX XXXX XXXX, because no bill had been received. I informed him that an insecure email was sent with a partial summary on XX/XX/XXXX, but no bill was received. Called back and spoke to XXXX on XX/XX/XXXX and spoke with XXXX. I informed XXXX I dispute the amount, since no bill had been received, and they had billed my insurance {$17000.00}. Since I never received a bill and it appeared they were billing my Insurance {$17000.00}, which was egregious and conflicted with the amounts initially disclosed. It showed a balance of {$1700.00}, but it was not complete and the insurance part appeared to be cutoff. XXXX A {$200.00} check was mailed with the memo -Paid in Full- I had openly disputed the amount with them on XX/XX/XXXX and mailed the check on XX/XX/XXXX to XXXX XXXX PC of XXXX, IL XXXX This information was obtained from the partial Account Summary I received on XX/XX/XXXX. The {$200.00} payment in full cleared my checking account on XX/XX/XXXX. I received a collection letter from IC System for this account. The {$200.00} payment is reflected as being received and applied to a {$17000.00} balance, showing {$16000.00} as in collection. The procedure never, never was supposed to {$17000.00}. The doctor even apologized to me after the procedure, because he could not keep future appointments and said he had resigned and all of his staff had quit.
