Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I received an email from my credit monitoring service that informed me that my credit profile was adversely impacted. I found that I C SYSTEM had illegally posted an alleged collection account to my credit report. I have never started nor an opened account with this company. My report shows that I C SYSTEM open account was opened XX/XX/2023 with a balance of {$270.00}. By federal law, a debt collector is supposed to make contact with an alleged debtor and give them 30 days to validate or dispute before they move forward with collection attempts. I never received a letter in the mail that gave me 30 days to validate or dispute this account. I never received a letter stating that I have an alleged debt with this company and owe a balance on that account. I, a consumer defined under 15 USC 1692a ( 3 ), understand that, under the FDCPA guidelines for collection agencies, they have to provide ( 1 ) legitimate proof that they are the original holder of this debt and can legally hold me responsible for paying this debt and ( 2 ) contractual proof of obligation or an assignment SIGNED from an officer from the original creditors corporation that I am supposed to pay them. 15 USC 1692g Sec. 809 ( b ) of the Fair Debt Collection Practices Act ( FDCPA ) grants me the right as a consumer to request validation of this alleged debt they say I owe. I fully understand 1692g. Validation of debts ( a ) Notice of debt ; that states within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. ( b ) Disputed debts - If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) of this section that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. ( c ) Admission of liability - The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. I never received a notice of right to dispute nor did I receive any information to verify that the alleged debt with this company belonged to me. If I would have gotten anything in the mail from this company before they illegally reported to my credit report, I would have respectfully requested evidence that I am the person they are asking to pay this debt and a contractual obligation that legally binds me to pay them this debt. Upon them receiving my validation letter by certified mail with return receipt, they would have to legally cease from collection calls, letters, and efforts and delete the account from my credit reports until they can validate this debt. But again, I never received such a letter about this account ever in the mail because it was never sent. In order for them to prove that I received it properly, the proper letter should have been mailed certified mail with return receipt or by some form of proof of tracking that would require my signature. And if the company did mail anything to me, where is the legal proof of tracking or my signature stating that I received it? Where is the return receipt or postage signature showing that I received it and signed for it? But again, I never received any sort of mail or package. They have illegally posted and reported to my credit file without adhering to the FDCPA laws. Im not sure if this company is a scam, but I know that this company has broken FCRA and FDCPA laws by reporting an alleged account to my credit report without informing me through mail and I did not receive notice of right to dispute nor did I receive any information to verify that the alleged debt belonged to me. My credit has dropped tremendously in the middle of making home renovations. Please help me get this account removed immediately. As a consumer, Im publicly publishing this descriptive complaint on www.consumerfinance.gov so that others can learn from my experience and so that this government agency can use this information to help work with other violations and complaints from consumers regarding this company. Under 12 CFR Part 1006 and as a consumer defined under 15 USC 1692a ( 3 ), I'm also preparing to sue under the FCRA and FDCPA because of the numerous consumer law violations committed by this company, damages to my credit and opportunity costs with making a major purchase, and business ventures that must be delayed until this illegal account is removed. It should not be my responsibility to submit proof that this debt does not belong to me. It is the responsibility of the debt collector to submit proof that they can legally collect on the alleged debt, legally report to the credit agencies, and follow all FCRA and FDCPA. As of this date, they have failed to do so. I C SYSTEM XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX

Consumer Complaint: on XX/XX/XXXX, I received a flag on my credit report that I.C. Systems placed a collection flag on my credit report, and as a result my credit score dropped XXXX points. Up to this point I had not been contacted in any form ( postal mail, email or via telephone ) by I.C. Systems, and when I called the contact number from my credit report, they informed me they were collecting on a debt from XXXX for an account that resides in Illinois. I informed them I do not now, nor have I ever lived in Illinois, and they said there was nothing they could do that I would have to file a fraud claim with XXXX which I have done to resolve the issue. I have not ever resided in Illinois at the service address for the collection account, I.C. Systems did not at any time try to contact me to validate that the debt belonged to me, they just matched my name and took a chance that this account belongs to me which it does not.

Consumer Complaint: I was a XXXXXXXX XXXX customer up until XX/XX/2023 when I moved and could not transfer the service. Although I was told by XXXX when I got a new plan that I would not be locked in for 2 years, when I called to terminate the service, XXXX claimed that I had to pay an early termination fee. I already paid the bill [ {$130.00} ] for XXXX so XXXX was to reimburse me for what I paid and send me a final bill. On XX/XX/2023, XXXX took money out of my bank account for XX/XX/2023, billing me for services that had been canceled. I called to have them reverse the charge and to ask again for a final bill. I did not receive a final bill in XXXX or XX/XX/2023, despite providing a forwarding address twice in XXXX and XXXX. I was unaware that once you terminate your services with XXXX XXXX, you can no longer access your online account ; so although I tried to log in and see what the final charges were, I was unable to. I called XXXX in XX/XX/2023 to ask why I could not log into the online account and was then informed that once you terminate services, you can no longer access the online account. I was advised to wait for the final bill which would provide me with the ability to pay the outstanding charges. On XX/XX/2023, XXXX reported the account as delinquent and sent to collections, tanking my credit score by XXXX points. On XX/XX/2023 when I was notified about this, I called XXXX to ask them why they reported the account as delinquent when I never received a bill and was advised to wait to receive the bill. XXXX stated that they would send the final bill out as soon as possible but that the damage done to my credit already was " not their problem ''. I received the final bill a week later [ it was mailed out on XX/XX/2023 ] and promptly paid the balance. I disputed the collections charge to my account and am still trying to get it removed. This has caused major damage to my personal credit as well as my business credit, which pulls from consumer credit reports. My business credit has now been slashed by XXXX as a result of this.

Consumer Complaint: I am writing to file a formal complaint against XXXX regarding highly unjust billing practices and mishandling of my account, which has resulted in unwarranted charges and involvement with a debt collection agency, I.C. System. On XX/XX/XXXX, I engaged XXXX 's online sales services to explore the possibility of switching from my current wireless provider, XXXX XXXX XXXX , to XXXX, seeking to retain our phone numbers and utilize our existing devices. Despite expressing interest in the XXXX family plan, I refrained from confirming a start date as I needed to confirm details with XXXX XXXX XXXX regarding our ongoing contract and the unlocking of our devices. Upon contacting XXXX XXXX XXXX the next day, I discovered that our devices would remain locked for an additional two months until our contract concluded. Immediately, I informed XXXX XXXX customer service of this situation, explaining the necessity to postpone the transfer of numbers and activation of services for this duration. Unfortunately, XXXX XXXX response lacked understanding or accommodation, leading to an erroneous shipment of two phones and two XXXX cards on XX/XX/XXXX, followed by an email on XX/XX/XXXX confirming account activationdespite my explicit communication of the delay. Despite receiving the phones, I did not open or activate any of the devices or XXXX cards. However, two months later, I received a billing statement from XXXX charging me nearly {$1000.00} for services that were never activated or utilizedan unjustifiable and erroneous charge. In an attempt to rectify this issue, I promptly contacted XXXX 's customer service, reiterating the unlocked status of my phones by XXXX XXXX XXXX and my willingness to transfer the numbers if billing discrepancies were resolved. However, XXXX insisted I pay the outstanding balance for services never utilizedan unreasonable demand that disregarded the facts and fair consumer treatment. I called XXXX customer again and was provided the instruction how and where to return the deviced back to XXXXXXXX. Ironically, ddespite returning all unopened devices as instructed, I continue to receive letters from I.C. System indicating an outstanding balance of {$1000.00} as of XX/XX/XXXX. I have made repeated attempts to resolve this matter directly with XXXX but there has been no satisfactory resolution. The recurrence of unwarranted charges and the involvement of a debt collection agency have caused immense frustration and concern. I am reaching out to the Consumer Financial Protection Bureau in the hope of seeking intervention and resolution in this matter. I request an investigation into XXXX 's billing practices and mishandling of my account, with a specific emphasis on the unjust charges and the involvement of I.C. System. I kindly urge you to take prompt action to address these issues and rectify the inaccuracies in XXXX 's billing system. Additionally, I request the cessation of any further contact from I.C. Systems regarding this unjust debt. I appreciate your attention to this matter and hope for a swift and fair resolution to prevent any further distress or inconvenience.
