Consumer Complaint: On XX/XX/XXXX I sent a certified letter to GM Financial, along to the 3 major Credit Reporting Agencies XXXX, XXXX, XXXX ( see attached documents ) .The letter explained how GM Financial has violated my consumer rights! Heres the supporting evidence that was included in the letter : Under 15 USC 1681b - permissible purpose of consumer reports, THE LAW CLEARLY STATES : ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. Furthermore, the FAIR CREDIT REPORTING ACT 15 USC 1681 ( 2 ) ( a ) ( i ) Exclusions from a consumer credit report clearly states : ( 2 ) EXCLUSIONS.Except as provided in paragraph ( 3 ), the term consumer report does not include ( A ) Subject to section 1681s-3 of this title, any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; I demanded that the account be deleted ( see attached ). I received a response back from GM Financial ( see attached ) basically stating they were unable to proceed with my request because no specific item was requested for investigation and there was no supporting documentation ( see attached document ). On XX/XX/XXXX I sent another letter certified mail ( see attached ) that included my consumer report showing that GM Financial was indeed reporting on my file ( see attached ) .Included in the letter was the supporting documentation, that reiterated why I demanded to have this account deleted from my consumer file ( see attached ). GM Financial sent me the same exact response letter from XX/XX/XXXX that was now dated XX/XX/XXXX ( see attached ). At this point I feel GM Financial is disrespecting my rights. Ive never given them written permission to report my GM Financial account/tradeline to any Credit Reporting Agency . Furthermore, GM Financial never gave me proper notice and OPT-OUT information regarding disclosing nonpublic personal information to nonaffiliated third parties as deemed by the Gramm-Leach-Bliley Act.

GM financial has never given me any money. 2. GM financial did not follow illinois laws when repoing the vehicle. They must contact me 3 days after in writing about my options. I was contacted 14 days after. 3. GM financial stated they sold the car in a private sale on XX/XX/23. However the car has not been sold. 4. GM Financial stated they sold the car in a private sale but they are charging me auction fees. 5. Once GM financial violated Illinois laws post repo this was automatically considered a wrongful repossession. 6. Reporting inaccurate information to credit agencies is violating my rights under the fcra.

I WAS TOLD I OVER PAID AND WAS DUE A REFUND. I WAS THEN TOLD I HAD LATE FEES THEN I WAS TOLD I ONLY OWED THE REMAINING BALANCE. GM FINANCE AGENTS SEEMED TO NOT HAVE A CLUE. I PAID MY BALANCE AND GM FILES WITH CREDIT REPORTING COMPANIES I WAS LATE 120 DAYS EVEN THOU I PAID OFF MY BALANCE. I CALLED GM AND THEY WOULD NOT CORRECT THE ERROR SAYING I HAD TO DISPUTE THE CLAIMS MYSELF SO I SENT LETTERS TO ALL 3 CREDIT RPORTING COMPANIES AND I'M ALSO ASKING FOR YOUR HELP I BEEN WORKING HARD TO IMPROVE MY CREDIT TO HAVE GM FINANACIAL XXXX IT UP FOR ME FOR NO REASON. Consumer Complaint: A certified notarized contract rescission/affidavit of truth letter was sent to the dealership XXXX XXXX XXXX XXXX XXXX XXXX CT for contractual fraud in XXXX of XXXX alleging that the contract did not reflect the {$1000.00} down payment as the one I signed did. I received a signed return receipt, and there was no response to the notice by the dealership within the 45 day time period, or nothing to disprove my claim that my consumer rights and consumer laws were violated by them and that the vehicle belongs to me according to the law. GMCs financing legal team was also notified via phone, fax, and certified mail of the contractual problem and was informed that a 1099c debt cancellation was done in XX/XX/XXXX because fraud and deceptive business practices. I also faxed GMC financial a copy of the 1099C and the fraudulent contract. Then on XX/XX/XXXX GMC proceeded to repossess the vehicle and with no payments owed to them refusing to return the vehicle and have plans to auction my truck without my permission and against my will. GMC is still currently billing me for the truck as well when they know it was a consumer credit transaction and have no legal right to possess my vehicle. Also in XX/XX/XXXX a certified notarized letter was sent to GMC financial fraud and legal team once again I received the return receipt but GMC has not yet responded. I called and they said my truck went to auction again the contract had been deemed null and void because of contractual fraud. I am without a vehicle and is currently renting one to get back in forth to work.
