Consumer Complaint: On XX/XX/XXXX, my vehicle was repossessed by GM Financial, who is a third party debt collector, and not registered with Texas to collect debts in Texas. After filing a lawsuit in state court for theft and conversion of my property, I find out that XXXX XXXX XXXX is using the name of GM Financial to collect its own debts. GM Financial shows on my credit report, and so does XXXX XXXX XXXX. GM Financial paperwork states this is an attempt to collect a debt on its paperwork. On or about XX/XX/XXXX, I tendered two payments to GM Financial and one to pay the vehicle off. One payment was a money order from the XXXX XXXX and one payment was from private sources. On or about the last of XX/XX/XXXXI received a release of lien on my vehicle, and then a copy of the Title was sent later. Approximately two to three months later, my vehicle was repossessed by GM Financial. I received a couple of letters, stating that no payment had been made, and thought it was a mistake. After the vehicle was picked up, I questioned what GM Financial used to repo the vehicle since I had the original title and a lien release letter. I filed in state court a restraining order to stop the sale of my vehicle from the illegal repo. It was at this time I found out that the money orders had a problem. The XXXX XXXX money order was never credited to my account, and checking with the post office, the money order had been cashed. The private source money order had an incorrect number, and I was never made aware of this. By law, GM Financial should have notified me of any defects so that it could have been corrected. The XXXX XXXX money order was never returned, nor the private funds money order. There was no reason for me to know that my vehicle was going to be repossessed.

Issue: Problem when making payments

Consumer Complaint: I have two leases through GM Financial ; which both are linked to my account. My XXXX has a {$460.00} payment and my XXXX has a {$390.00} payment. Approximately 10 months ago, I was contacted by GM Financial that my XXXX was past due. This was impossible because the money had been debited from my credit union checking account. Problem was GM Financial was applying my XXXX payment to my XXXX, so my XXXX had a two payment of {$460.00} paid ahead. The gentleman I was talking to told me he could see the problem, and that I 'd be assured he would reapply the payments correctly and would " fix '' the auto payment transfer. He did reapply correctly, but did n't fix the transfer as promised. At this point, I thought I was good to go. Not yet, a few months later I get a call that I 'm past due again. I tell the GM Financial representative that this whole situation should have been resolved. Well, I had to explain the whole situation again ; which they redirected the payments for the second time. The representative told me that my account will transfer as it 's suppose to and I was n't charged any late fees and was promised my credit was good. For the third and final time, I receive a call a few months later that my XXXX is past due. These guys did n't correct my transfer as promised, and my XXXX payments were being applied to my XXXX again. I explained the situation for the third time, and they assured me that everything was fixed and that my credit would n't be affected. Because it was the third time, I told the gentleman that GM Financial staff had lost my confidence and that I wanted to cancel all of my automatic transfers and I would send a check each month - which is inconvenient in today 's modern world. However, this representative was confident and he told me that this will not affect my credit report because he would make sure of it. Low and behold, GM Financial marked me 30 days past due on my credit bureau. I have credit bureau monitoring through my credit union - where I 've been a member since XX/XX/XXXX. I 'm attaching my credit bureau for review. I 've been in the bureau since XX/XX/XXXX, the year I graduated from High School. Out of approximately 50 loans, I have never been late on one loan - until GM Financial. My credit score dropped from over XXXX to XXXX because of this. The score is n't a big deal with me, what is a big deal, is that all future loan applications, finance companies and my credit union will think I 'm having financial troubles and that I pay late ; resulting in them charging me a higher interest rate and not trusting me. I 'm XXXX years old, a husband of XXXX years, a father of XXXX young children, a XXXX of a medium size organization, and have fallen victim to a large corporate entity where my voice is not being heard of. At this point, what do I do? The representatives are incompetent. My only two retaliations are to file this complaint to see if this will work in them reporting me on-time for that payment ; and not purchasing another GM product. I feel GM Financial may have done this to drop my score so they can charge me higher interest rates for future leases and purchases.

Consumer Complaint: On XXXX XXXX 2017, I purchased a car from XXXX XXXX which resulted in receiving two hard inquiries on my credit report. One from GM financial and the other from XXXX XXXX. However, I noticed a month later that XXXX is showing a second hard inquiry from GM Financial on XX/XX/XXXX2017. I contacted GM Financial and after several hours of speaking to numerous reps, I was told that this inquiry was never done by them and that I would need to contact XXXX. I contacted XXXX and was told to get a letter from GM financial in order to remove this inquiry. This is complete fraud and I have become a victim of inaccurate reporting. GM financial will not send me a letter Because they 're saying they did n't request my credit report on that date. XXXX is not removing the inquiry stating that I need a letter from GM Fianncial. Their next excuse to not remove the inquiry is that more than 1 hard inquiry reported within 30 days for an auto mobile does n't effect my credit score. This is complete fraud. I want the hard inquiry from GM financial on XXXX XXXX 2017 to be removed right away from my credit report whether it affects me or not. Under FCRA, I should be protected from being punished for something I did n't do. No other credit reporting agency is showing this hard inquiry. I need your help to have this inquiry removed as I have worked so hard to keep my credit report clean. Thank you.

Consumer Complaint: Lender never sent me a lien release letter as required under Missouri law after the loan was paid off under bankruptcy discharge and payment plan completion. I am trying to trade in the vehicle and requested a lien release letter which lender stated they mailed by US Mail on XXXXX XXXXXXXXXXXXX XXXXXXXX/XX/XXXXX/span>. As of XXXX, the lien release letter has not been received. I called and tried to verify the address it was sent to ( which was correct ) and to request an overnighted replacement lien release letter on XXXX. Lender stated they would not replace the lien release and would not overnight. They however have no tracking information to support the claim they have mailed the document. I gave the lender 48 hours to overnight a replacement and they refused. I was referred to a manager who never returned my call to follow up. I need this document to sell a vehicle I no longer need. There has been every opportunity given them to deliver but they did not send a lien release.

Consumer Complaint: Upon receiving my credit report today, I noticed many bank/car dealerships had my info and I have no idea nor did I give my approval for my credit to be run not once but twice a piece in 2 days. 38 hard inquires!! This issue has dropped my score tremendously and it needs to be taken care of. As follows Also attached photos. I have written to all places and received no response on getting it taken care or proof of reason to run my report. The {$1600.00} included loan payments, deferment payment {$150.00}, repo facility fee {$100.00}, repo fee {$390.00}, late fee {$230.00}. Payment of {$1600.00} was paid by XXXX XXXX and copy of receipt sent via email to XXXX XXXX XX/XX/XXXX. However, XXXX XXXX has not released the vehicle and has further used deceptive methods to maintain the vehicle, the payment, and cause further emotional distress, mental anguish and financial damage. Which leads me to believe that the reinstatement arrangement agreed and paid upon was false and misleading representation on the part of GM Financial/Americredit. ( 3 ) Violation of FCRA provisions ( a ) failing to correct inaccurate and derogatory information to credit reporting agencies ( b ) failing to follow up on credit reporting disputes ( c ) failing to refrain from continuing to submit information that you know to be inaccurate, and ( d ) providing results of the investigation of the dispute within five ( 5 ) business days after the investigation is completed ; ( 4 ) Violation of FDCPA of phone contact attempts by XXXX XXXX after he was notified multiple email exchanges to communicate in writing as XX/XX/XXXX ( 1XXXX XXXX ) ; XXXX XXXX required phone contact as a requirement to secure the vehicle AFTER the reinstatement arrangement Monday, XX/XX/XXXX and payment XX/XX/XXXX which was emailed to him with copy of the insurance policy. Consumer Complaint: In XX/XX/XXXX, I was approved for a vehicle ( XXXX XXXX XXXX XXXX at XXXX XXXX ( XXXX XXXX XXXX XXXX XXXX, TN XXXX ) through Americredit Finance. The monthly payment was around {$640.00}. I provided the necessary documentation-2 current pay stubs, proof of residency ( lease and utility bill ), employment history ( 17 as a XXXX ), etc. I was there with my XXXX daughter and of course was complimented many times about her. I was told that my 1st payment would be around XX/XX/XXXX. In XX/XX/XXXX, I received a welcoming call from Americredit, that provided me with information about my upcoming payment. A few minutes after the call ended, Americredit called back to ask me if I was on XXXX leave ( I found this to be very odd that they knew that I had recently XXXX XXXX ). I said " yes '', and then we hung up. I never received the information about how to make a payment. A week later ( now a month of driving the vehicle has passed ) XXXX ( a lady named XXXX ) called to inform me that the loan was denied because I was on XXXX leave-despite the employment history and my current pay stubs. I wanted to know how Americredit knew that I was on leave. She was n't sure, but that I should n't worry and that XXXX would handle it. They " handled '' it by making hard credit inquiries without my permission- Americredit ( twice ), XXXX XXXX, XXXX XXXX, and XXXX. In XX/XX/XXXX, I sent a certified letter with a signature receipt asking them to remove the unauthorized inquiries within 30 days. Their response was for me to return the vehicle. The signature on the receipt was on XX/XX/XXXX and the 5 inquiries are still on my credit report, my score has lowered, and I am still without a vehicle. I need your assistance in this mattter.

Consumer Complaint: have a new car lease thru GM Financial Making payments to account number XXXX. Monthly payments are {$220.00}. I make payments from my XXXX XXXX checking account. on XXXX XXXX 2017 a payment came through for {$22000.00} and was received by GM Financing but not credited to my account. It appears to me the decimal point was placed in error. I called the bank to stop payment but it was too late. I then called GM Financing to get the over payment returned to me. I seem to get the run-around from these people for two months. My last call to GM Financial was today ; I was pit on hold for 30 minutes and never talked with anyone. It seems like they think they can keep the money. hard to believe GM would do something like this. I simply want my over payment {$22000.00}
