Consumer Complaint: I am a member of the XXXX XXXX XXXX, and, prior to joining the military, I acquired a loan through GM Financial with XXXX XXXX XXXX for the purchase of a vehicle. Since incurring this obligation, I entered the active military service of the nation in the United States XXXX on XXXX XXXX, XXXX. This entry into active military service materially affected my ability to pay. Under these circumstances, federal law prescribed the maximum interest rate which I was to be charged. The Servicemembers Civil Relief Act ( 50 U.S.C.A. 3937 ) prescribes a ceiling of 6.00 % annual interest on any obligation under the circumstances described above. This interest rate must be maintained for the entire period that I am on XXXX XXXX, even if I default. The percentage cap includes all service charges, renewal charges, and fees. The rate is applied to the outstanding balance of the obligation as of the date of entry into XXXX XXXX service. Any interest charged above this statutory ceiling must be forgiven, not accrued. Any person that knowingly violates this section may be fined and/or imprisoned. Therefore, I have asked GM Financial to amend its records to reflect this statutory ceiling and that any charges in excess of a 6.00 % annual rate are withdrawn. Also, I have asked for a detailed accounting showing the credit I was given for my time of XXXX XXXX service XXXX XXXX XXXX, XXXX to present ) with the 6.00 % interest cap reduction. I asked GM Financial to apply the credit to the principal balance on the loan. They received the letter stating above from me on XXXX XXXX, XXXX, and I have received no response. Instead, GM Financial reported the entire balance ( with no amendment ) to the credit agencies as a write-off, and I am now having problems with my security clearance.

Consumer Complaint: I left a lease early and leased another vehicle with the help of the factory. The finance company assumed a very aggressive estimated future property tax amount. I knew it was too high and told the company I would pay them {$150.00} a month until the actual property tax bill came in. The estimated tax was hundreds of dollars higher than the actual number. I confimed that number with the local municipality. I called the leasing company with this information and they informed me that they would look into it. I never received a call back or letter regarding my issue and the leasing company continues to call looking for the fraudulent amount.

Consumer Complaint: GM Financial, called my mother over and over again, I have written sworn statements from her that I will be using in court since they are trying to sue me. She repeatedly told them to stop calling her and any information that they needed would have to come from me. So they were calling her asking her do so know where the car was, and I was behind in my payments. What 's sad is they went to the measure to tell her that they would give her XXXX XXXX dollars if she told them where the car was. Now remind you my mother is sick and this was happening every single time they called her. Next, the repo man knocked at my door and my family member answered the door and told him the car was n't here then he told her well they going to sue her and start garnishment of her checks. she told him they have to do what they have to do cause it 's not here and plus she do n't work. I just think it 's sad for any company or someone working for the company to tell people in detail your business. I have people coming to court with me to tell the judge what was going on. So I gave the car back and it 's not like the car had to be towed from my house. The repo man drove it away the car was never damage or in accident so tell me how you sell a car for XXXX that 's being reported on there papers. But I have another paper stating that they sold the car for XXXX But XXXX went to the car to make it seem like I made a payment so they could keep it on my report longer I ca n't wait to go to court. I even asked for a payment history and they sent me payments history from XXXX till XXXX mind you I had the car since XXXX Then they sent me paper work with XXXX different amounts for repossession fees for XXXX on one paper XXXX on another paper,XXXX On another paper really which one is it. Then there is a assignment contract which requires Ameri credit and the car company to sign for this to be legal only the car palce sign the letter, which it states that dealer-seller and Americredit must initial well Americredit never signed it at all.

I was at work on those dates but I received a notification that there were changes on my credit report thats why I log in to my account. I saw that there were atleast 7 hard inquiries from different companies that I did not authorize. That is unlawful and that is illegal viewing of my finances. I never gave authority to any body to view my credit, especially without my knowledge. It was for car loan credit inquiries. I went to XXXX car dealership in XXXX and spoke to the manager. I told the manager that they run my credit without my permission and I really wan na complain about it. I told them that its a serious matter for me and I felt very threatened and furious of what happened. It could be identity theft and I was so sleepless for two nights because of that. I was told by the manager that somebody represented me on my behalf and told them that shes my nom. They ran my credit without my consent for several times without even double checking and asking for my ID. I really felt that these companies violated my privacy and rights. I am so afraid and XXXX off right now at the same time and I wan na take this in legal action.
