Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: I have been approved into the Service member Civil Relief Act program in XX/XX/2017. Since the time of my approval has not updated my account to reflect my new percentage rate or adjust how much I owe. They also have not been reporting to the credit bureaus properly. I have called them several times and each time they have said that they were going to correct it and get back to me ; but they have not.

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: I am on auto pay and pay my entire lease bill through the autopay feature directly through my checking account monthly. Each month for the past several months, GM Financial has sent me a bill for {$32.00}. Each month I call and sit on hold waiting forever to get through to the call center because they are experiencing, " Unusually high call volume. '' Each month, they tell me they're going to remove the amount. Each month, they tell me it will not happen again. Then, the next month comes and I get a bill for {$32.00}. This is attempted theft. I have no doubt that there are people out there paying this erroneously billed amount. This month, my bill for {$32.00} came with an additional " PAST DUE '' amount of {$380.00}. I called again and learned I'm not past due ... that it is my vehicle 's " property tax '' and I have a year to pay it.

Issue: Improper use of your report

Subissue: Credit inquiries on your report that you don't recognize

Consumer Complaint: I have noticed that I have a hard credit inquire from your company on my XXXX XXXX and XXXX XXXX credit file that I did not authorize to acquire. As you probably know, Credit Reporting Agencies treat inquiries as a statement of fact and will not allow a consumer to dispute them. Since it is against federal law ( Fair Credit Reporting Act15 USC & 1681n ( a ) ( 1 ) ( B ) for an entity to view a customers credit report without a permissible purpose, I am writing to inquire as to your alleged purpose for doing so since I did not apply or request credit from your organization. Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the understandable language of the law. 15 USC & 1681n ( a ) ( 1 ) ( B ) states, in part, in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer because of the failure or {$1000.00}, whichever is greater. I have filed a police report with the Sheriff 's Department XXXX XXXX XXXX on XX/XX/2018 with a report number # XXXX for identity theft, Name and unit of Reporting Deputy XXXX XXXX XXXX XXXX. This is informing you that this was a fraudulent application and I did not authorize your company to pull my report. I do hope that we can settle this matter amicably. Please remove this hard inquiry from my credit report upon receipt of this letter to avoid further damage to my credit. Your immediate attention is appreciated regarding this matter. Please contact me if you have any questions. Sincerely, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, LA XXXX Email : XXXX XXXX

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: I called GM Financial on Monday XX/XX/XXXX to cancel my auto pay for my auto loan. The representative I spoke with said the system was down but would submit the request and it would be updated within a couple days. I called back on XX/XX/XXXX to confirm the request had been made and when speaking with the representative she advised me that it hadn't but told me she would get it done and assured me the payment would not be drafted from my checking account as I had contacted them in enough time to have it stopped. On today XX/XX/XXXX i accessed my online account to see if the auto had been stopped and i discovered it was still active, which means the payment would be drafted out of my account on the scheduled due date of XX/XX/XXXX I immediately called GM Financial and spoke with a Representative about the issues she then advised me that it would take 10 business days to get it cancelled which contradict everything the previous associates told me as well as what is stated on the company website. I asked to speak with a Manager after 10 mins of hold I spoke with XXXX who acknowledged that i was told it would be cancelled but since it wasn't it was nothing she can do and advised me to put a stop payment on it through my bank which will cause me to have additional fees. my bank is going to charge me XXXX dollars to put a stop payment on my account. TOTALLY UNACCEPTABLE

Issue: Communication tactics

Subissue: You told them to stop contacting you, but they keep trying

Consumer Complaint: In XX/XX/XXXX/XX/XX/XXXX my account was updated to reflect that I did not want any calls from this company to my job or any phone numbers that I am associated with. I have recently received 3 phone calls to my job from this company. The 1st call was on XX/XX/XXXX at XXXX XXXX. The next call was on XX/XX/XXXX at XXXX XXXX. I told the agent that there is already a cease and desist on file and his company should not be calling this number. He stated that he would update the account and I would not receive anymore calls. On XX/XX/XXXX I received a call from this company at XXXX. I am now feeling harassed by this company because I have asked them to stop calling and they have refused to do so. They are calling about a XX/XX/XXXX vehicle that I have traded in. The payoff has already been sent to this company by the dealership. My employer does not allow any personal calls and this company continues to call. I want all calls to stop immediately.

Issue: Problems at the end of the loan or lease

Subissue: Unable to receive car title or other problem after the loan is paid off

Consumer Complaint: I turned in my leased vehicle early inXX/XX/XXXX. I returned it to the dealership where I leased it from -- XXXX XXXX in XXXX, CA. The lease was turned in approximately 20 months early. I paid off the remaining payments owed on the lease to GM Financial -- the leasing company. At a rate of $ XXXX/month, the approximate lease payoff to turn the vehicle in early was {$2100.00}. I paid {$2200.00} to GM Financial as a payroll -- slightly overpaying to cover any small interest amounts that accrued. Since then, I've attempted to get the lease fully settled and a refund of approximately {$30.00} issued to me. In XX/XX/XXXX, I called GM Financial and spoke with XXXX XXXX to request the small refund. XXXX advised me that a final bill wasn't generated yet however he would request one. He did however generate a letter for me saying I owed {$0.00} on the lease. I never heard anything from GM Financial since. Today, onXX/XX/XXXX, I called GM Financial again asking for a refund. They advised me there wasn't a refund due. I asked for a final bill showing how the {$2200.00} was applied, and they advised me that one wasn't generated yet. The representative on the phone advised they would request a new one however couldn't at all tell me how long that would take. Lastly, I received a new car registration in the mail dated XX/XX/XXXX issued by the State of California. The document shows me still as the registered owner despite turning in this vehicle back in XX/XX/XXXX. It's clear to me that they still haven't updated DMV records to reflect them taking the car back

Issue: Problems at the end of the loan or lease

Subissue: Unable to receive car title or other problem after the loan is paid off

Consumer Complaint: I purchased a vehicle from XXXX XXXX in XXXX, PA. I purchased the vehicle in XX/XX/XXXX. As of XX/XX/XXXX, my lender ( GM Financial ) has not received the title on this vehicle and I have not been able to register or drive it. I am filing this complaint because my friend XXXX XXXX bought a vehicle from this dealer in XX/XX/XXXX and never was able to license her vehicle either. She had to turn it back in to the lender and they are now showing it as a repossession on her credit. I want to be proactive in my complaint filing. This dealership is now gone from the location and I am paying for a vehicle I can not drive. My loan is with GM Financial Acct. # XXXX. I want to get out from under this untenable situation but do not want to end up with a repossession on my credit file.

Issue: Threatened to contact someone or share information improperly

Subissue: Talked to a third-party about your debt

Consumer Complaint: Team leader XXXX XXXX at GMFinancial ( ph XXXX fx XXXX email XXXX ) Sent me a email on XX/XX/18 informing me that they see my auto loan is delinquent and informed me of the loan will be charged-off and vehicle repossessed, so I need to call to workout the loan. I emailed back and informed that I will call her the next day and what is the best time to call. So, today I get a text from my mother ( who is not a authorized party and her number has never been a contact number of mine ) stating that a person from XXXX XXXX phone number called and told her that my loan is past due and they will be repossessing my vehicle. I then called XXXX on the phone who was very rude and asked her why did she release my information and she tried to pass me to another person. Her actions really upset me and this turned into a bad conversation. I asked her a few times why she emailed me to work it out and calling my family but won't talk to me about it. She replied " she is a manger and don't talk to customers '' Then she ask where to pick up the car and she isn't going to help any further then she hung up the phone. Then 30 mins later my fiance 's mother who lives in XXXX, Co. ( my mother lives in Georgia ) called and told my fiance that XXXX from GMfinanical called and told her that I am over 100 days past due and they are repossessing my car and to call XXXX at XXXX. I called XXXX back and asked her why is she calling people and releasing my information after you just spoke with me and that is against the law. Then she said " please hold '' and never came back tot the line. I called back over 12 times and she didn't answer. Overall, they are calling 3rd parties that are not authorized and releasing my information without my permission.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: My daughter leased a car and I co-signed through a dealership. GM Financial financed it. When the lease was up we went to the dealership and she decided to purchase the car. The lease was paid off by the dealership and she financed through a bank. More than a month later we both realized that our credit scores plummeted. Come to find out GM financial had reported a late payment. Through many calls and emails between the dealership and GM, after GM tried to blame the dealership it was discovered and proven that it was a mistake that GM made. Every time I try to find out why our credit is still not fixed after 2 months GM basically said it was fixed. They also said they were sending a letter for us to use if necessary admitting their mistake but it has not been received in the past 20 days. When I called they said it must have been lost in the mail. This company has the worst customer service I have ever dealt with and lying seems to be the norm. After looking at all the reviews online at consumer affairs I dont understand how they can still be in business.

Issue: Incorrect information on your report

Subissue: Information is missing that should be on the report

Consumer Complaint: For over 9 months now i have been calling between the credit bureaus and GM financial to have my GM financial account reporting to the credit bureaus. GM financial has repeatedly told me it would be taken care of. Repeatedly i have had to inquire as to why it is not reporting still. Repeatedly i am told that one single.person in GM Financial deals with this. This is a person i can never be connected to. Supervisors at GM have been supposedly emailed repeatedly. I have left numerous voice messages. Three days in a row for eg i called the number i was given, 25 x, no answer except a vm. I have tried extensively to correct my credit and this issue has prevented me from getting a few health assisting loans i have greatly needed. I have flatly been informed if my auto loan was reporting i would have excellent credit
