Issue: Managing the loan or lease

Subissue: Problem with additional products or services purchased with the loan

Consumer Complaint: To whom it may concern : On XX/XX/XXXX, I took my leased XXXX XXXX in to XXXX XXXX for service on my brakes because they had become stiff and I almost crashed the vehicle. During this time the Service Rep XXXX XXXX explained that I would have to leave the vehicle. I requested to know if the mechanic working on the vehicle had any idea what was wrong with the vehicle since he had already heard the key complaints. According to Mr. XXXX, XXXX had received a bulletin from General Motors that there had been many cars coming back with serious brake master cylinder issues. Puzzled by his explanation I proceeded to ask Mr. XXXX could he elaborate. To which he said it has to do with the hose and the vacuum pipe. I then asked but if it is the hose and its a leak wouldn't brake fluid and a replacement hose fix the issue?? Mr. XXXX responded with a chuckle " No, its a lot more complicated than that ''. I then proceeded to take the chuckle as I'm a girl so I would not understand mechanic or vehicle repair jargon. Following this response from him I asked for Mr.XXXX to write down the issues so that I can do some further research at home. Upon arriving home I XXXX the term " XXXX Brake Master Cylinder Issues '' and immediately on the first page and site was " XXXX CLASS ACTION LAWSUIT OVER BRAKE MASTER CYLINDER ISSUES '' I proceeded to read the article and jot down the name of the attorney handling the case. It turns out a couple with the same issues as I brought their XXXXXXXX XXXX in to the shop for service for the brakes that were stiffening. Soon after the dealership told them they fixed it. The couple believing it was fixed drove the car got into an accident and nearly got killed. This couple then commenced a Class Action to which inadvertently I guess I will be a part of or not ... Not sure if I am. In any event getting back to my vehicle I called the following day for a status and to explained to Mr. XXXX that I had uncovered something I had not been made privy to. You see approximately several months before I had my brakes worked on by XXXX XXXX and no one let me know that they existed an issue with the brakes. At the very least if this bulletin has been out since XX/XX/XXXX when I leased my car and it is XX/XX/XXXX couldn't anyone notify us that there exist a SERIOUS ISSUE that can kill my entire family??? No instead I nearly get killed, the elderly couple who commenced the action almost get killed and scores of other helpless individuals that own or lease XXXX Vehicles Including the Nations Entire Police Force are forced to play XXXX Roulette with our lives in faulty vehicles and XXXX and General Motors CEO XXXX XXXX XXXX are reluctant to make this apriority and issue recalls on ALL XXXX XXXX, XXXX, AND 1500 TRUCKS!!! There are numerous complaints lodged with the National Highway Safety And Transportation Board and yet nothing has been done to remedy this serious issue. What's more is that if your out of warranty they will not fix it either!!!! I have contacted the General Motors Corporate Division to no avail. No help or assistance was provided. To add insult to injury XXXX XXXX the dealership my vehicle was at after learning I knew forced me to bring back the loaner and take my XXXX XXXX XXXX if I was NOT willing to pay for repairs!!!! When I explained that my husband was not home and I had my kids with me but did NOT want to risk putting in this vehicle they did not care. Not only were they callous but I was forced to go and get the vehicle with my infant daughters and son. When I yelled at the Service Manager out of anger for making take that risk they apparently called General Motors and requested that I service my vehicles elsewhere! A day or two after a rep from General Motors called and I was told never come back to the XXXX XXXX for service because XXXX XXXX had called to complain about me. Now mind you I leased my XXXX XXXX from them. I am outraged at the service from the XXXX Dealership and General Motors and at this point want them to let me out of this vehicle that I continue paying {$730.00} on and CAN NOT USE! its a lemon and will never perform satisfactory or safely. I will not feel comfortable letting anyone in my vehicle let alone drive it myself. Further research showed the XX/XX/XXXX-XX/XX/XXXX XXXX XXXX and numerous other XXXX models have Brakes Master Cylinder Issues, Vibration at Hwy Speeds, Lack of Air Bag Deployment, Air Conditioning Issues and other problems with Front Drivers Side Knocking Noises! I pray you can assist me with this XXXX XXXX!!!!! Thank you. Respectfully, XXXX XXXX

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: My GM Financial account should not be showing any balance as my gap insurance covered this. I have a letter to prove this that has been uploaded. I am actually getting back a credit of {$1800.00} for my Vehicle Service Contract. There should be no balance reporting for GM. Please correct this on my credit report immediately.

Issue: Struggling to pay your loan

Subissue: Loan balance remaining after the vehicle is repossessed and sold

Consumer Complaint: At the time of this loan my name was XXXX XXXX. I got the loan in XX/XX/XXXX. I started off pretty good, but through the course of the loan I lost my job and had to take a lesser paying job in XXXX. My finances decreased and I couldnt really afford the car. GM Financial offered me deferment to get current. Eventually I fell behind again. I had lost another job, I dealt with the lost of my daughters father to XXXX, after while I asked about refinancing and they said they didnt do any refinancing. I tried my local bank and they told me I was upside down in the vehicle. So there I was stuck in a car loan that I couldnt get current in no matter how hard I tried. My loan was for about {$15000.00} and by the time I voluntarily surrendered the car I still owed them {$12000.00}. I was disgusted, depressed, and felt taken advantage of. I couldnt see myself throwing money away to interest and never owning the car. I felt relieved afterwards but still upset because I threw away so much money. Now Im still owing a balance on car I dont have and it is negatively affecting my credit. No one at GMFinancisl every told me that it wAs a simple interest loan or what my per diem rate was. Now I know about these things I feel that this was a ripoff, like predatory lending. I feel this balance should be XXXX and removed from my credit reports

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: My complaint is against XXXX XXXX. They repossess my car after being late approximately 70 days past due. I had spoken to several representatives in order to work out payment options. 8 had been previously laid off and have been playing catch up since recently being employed. I immediately contacted GM Financial on the day they repossess my car on XX/XX/13 and made a payment in full for the balance. In spite this fact, FM Financial has reported a repossession with all three credit beareaus.

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: GM Financial has the worst telephone customer service because they just make excuses and try to place blame on the consumer. They have no empathy and offer no solutions. When asked to speak to supervisors their employees say that their is no one above me. On XX/XX/2018 I was contacted by GM Financial to make a payment that I was 27 days late on an auto lease payment that was due on the XXXX. I did not have my bank account information on me at the time and so I came home and made the payment online and also changed my bank account information. The reason that I was late in the first place is because I changed my bank account and had closed my old bank account that was linked to the lease account on a reoccurring payment plan ( ACH ). I changed the XXXX XXXXk account information to the new bank account that I had established for the one time payment and also for future payments which I also thought was changing the ACH account. I just so happened to be looking at my GM accounts again in XXXX and then noticed that the automatic payment had not been pulling. I immediately made a payment and called customer service. Customer service told me that in order to establish a new ACH account that I would have to send a cancelled check and an automatic payment enrollment form. She was wrong because I successfully set it up without having to do that. I just went online and set it up as I thought I had before. The issue was that the reason it had not gone through before is because customer service first has to remove the original payment account. You would think that as a multi-billion dollar organization they would have a streamlined process in order to change the automatic payment details on your account. Aside from that the customer service representatives make no effort to properly inform the customers of the steps needed to change this as the first representative that I spoke to in XXXX made no indication that I had to do that. My XXXX has gone down from a XXXX credit to a XXXX average XXXX score with the three different credit bureaus and GM Financial gave me a fax number to write to dispute their reporting to the credit bureaus.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: I have had a car loan with GM financial for approx. 4 years, but on my credit report they have large gaps showing no payments have been made. i have made late payments and have had agreements-signed in which payments where moved to the end of my lease in order to no report late payments. i have disputed this with the 3 credit reporting agencies but it has not changed. i understand GM financial has had issues with this and is even facing possible class action. i am demanding they correctly report all of my payments since XX/XX/XXXX and remove the negative entries of XX/XX/XXXX-XX/XX/XXXX-as i have been making my payments. they also need to report the correct balance.

Consumer Complaint: I have tried to resolve this matter with GM Financial since XX/XX/XXXX with no follow up calls to me or any further action taken on their end. Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: In XX/XX/XXXX I received an alert from a credit monitoring service that my score had dropped due to an account change. I logged in and saw that GM Financial had reported my payments for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX as 30 days late. I immediately contacted GM Financial to report that when I log into their payment system, it showed my account has having a balance due of {$0.00} ( screen shots attached ). The only time it would show a balance due was towards the end of the month. I made the payments at that time and then they were considered 'late '. GM Financial customer service stated on XX/XX/XXXX : This is a site issue that we are aware of and our web designers are in the process of updating the system to get it corrected. There are also articles online where GM Financial admits having issues with their payment system when they updgraded in XX/XX/XXXX. I spoke with customer service both on the online chat and over the phone to explain my situation and have my account updated to show that the payments were not late due to an error on their end in their system. Even though they admitted they are having system issues, they said they will not do anything since they only have the date when my payment was received. I am being punished with late marks on my credit report even though their payment system has an acknowledged and admitted error.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: My husband and I took out a car loan with GM Financial. Early this year, XX/XX/XXXX, we noticed that the company was not reporting our account information to the credit bureaus. They stated that they were " switching systems '' and could not report to the bureaus. I called several times over several months trying to find out when this situation would be corrected. The company, finally reported some information in late XX/XX/XXXX or early XX/XX/XXXX because I adamantly requested that they manually update the credit bureau. We thought that this issue was finally taken care of. However, we refinanced with another company at the beginning of XX/XX/XXXX. XX/XX/XXXX is the date that the account, with GM Financial, was paid off. They stated this would be reported on the next billing cycle, which would be XX/XX/XXXX. It was never reported. I have called numerous times in the last month to find out why this has not been reported and when it will be reported. I was told that this would be reported on XX/XX/XXXX. It is now XX/XX/XXXX, and GM Financial stated that they are again experiencing system issues. They are unable to report that our account with them is closed. My credit report still shows that I owe their company a little over {$12000.00}. GM Financial is unsure when they will have a solution to the " system issue '' that is not allowing them to report our closed account. My husband and I are unable to apply for a mortgage or look for another vehicle, because it shows that we are in way more debt than we are. The issues with this company have been ongoing for over 6 months. On top of these issues, the customer service was horribly rude and there was ZERO communication about the lack of reporting or issues that this company was having.
