Consumer Complaint: After reviewing my credit report, I noticed I have 1 late payment being reported by XXXX XXXX I notice the late payment was reported in XX/XX/2023. Please note I have excellent payment history with is company and has never been late. From my history of never being late, this is an oversight on behalf of the client. Please note this report is a violation of my consumer rights. Please understand as a consumer my rights were violated by the reporting of these late payments. Consumer Complaint: As per the Fair Collection Act ( FCRA ), specifically 15 USC 1681 section 1681 ( a ) ( 1 ), the stability of the banking system relies on fair and accurate credit reports. This emphasizes the importance for customer reporting agencies, such as Experian, to carry out their responsibilities with fairness, impartiality, and respect for consumers ' privacy rights. As a consumer, I am entitled to ensure that my private information is not shared, as supported by 15 USC 6801, which states that each financial institution must respect customer privacy and protect the security of nonpublic personal information. I did not provide consent for the credit agencies to furnish my personal information. Caused mental anguish and harm for me and my family when I was denied/ unable to use the extension of credit do to these late payments when Congress states in U.S Code 1666 ( b ) that a creditor can not categorize an account with open-end credit plan as late payments for any purpose. 12 CFR 1022.3 defines fraud as committing or attempting to use the identifying information of another person without authority, which is considered identity theft. The Family Education Rights and Privacy Act of 1974 prohibits the disclosure of records contained in a system of records without the written request or prior consent of the individual to whom the records pertain. Per 15 USC 1681 section 604 ( a ) section 2, a consumer reporting agency can furnish a consumer report only in two circumstances : with written instructions from the consumer or in response to an order from a court with jurisdiction. I am unaware of any consent given to report transaction history involving other parties on the consumer report. According to 15 USC 6802 ( b ) ( c ), a financial institution can not disclose nonpublic information to a nonaffiliated third party without explaining to the consumer how they can exercise the nondisclosure option. In my case, the furnisher of information to credit agencies did not inform me of my rights to exercise this option. Furthermore, 15 USC 1681C ( a ) section 5 prohibits consumer reporting agencies from including certain adverse information in a consumer report, especially without authorization. The reporting of adverse items without my permission, as in the case of this account, violates the law. According to 15 U.S. Code 1691-2 ( A ) ( 1 ) A, it is unlawful to furnish inaccurate information to consumer reporting agencies, Experian are not maintaining reasonable procedures as required by 15 U.S. Code 1681e. Finally, 12 CFR 1016.7 allows consumers to exercise the right to opt out of any reporting services at any time. I am hereby choosing to opt out of your reporting services.

Consumer Complaint: XXXX XXXX XXXX, No agency shall disclose any records, which is contained in a system of records by any means of communication to any person, or to another agency. ( Privacy Act 1974 ). Obligation policy states it is the policy of the Congress, that each financial institutions have affirmative and continuing obligation to respect the privacy of customers and protect the security and confidentiality of those customers non-public personal information ( FCRA, 15 U.S.C. 6801 ). Canceled debts states that a charge off is considered a certificate of indebtedness which means it is income that can not be reported to consumer reports ( IRS Publications 4681 ). A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate ( FCRA, 15 U.S.C. 1681 ). Yet again, Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers ( FCRA, 15 U.S.C. 1681 ). Any person who willfully fails to comply with any requirement imposed with respect to any consumer, is liable to that consumer in an amount equal to the sum of any actual damages sustained by the consumer as a result of the failure of damages of not more than {$1000.00} ( FCRA, 15 U.S.C. 1681 ( n ) ( a ) ( 1a ) ). A non-affiliated third-party that receives from a financial institution shall not directly or through an affiliate of such receiving third-party, disclose such information to any other person that is a non-affiliated third-party, unless such disclosure would be lawful if made directly to such other person by the financial institution ( FCRA, 15 U.S.C. 6802 ( c ) )
