Consumer Complaint: 34 CFR 682.208 ( 3 ) Due Diligence in Servicing a Loan : " Upon receipt of a valid identity theft report as defined in section 603 ( q ) ( 4 ) of the Fair Credit Reporting Act ( 15 U.S.C. 1681a ) or notification from a consumer reporting agency that information furnished by the lender is a result of an alleged identity theft as defined in 682.402 ( e ) ( 14 ), an eligible lender shall suspend consumer reporting agency reporting for a period not to exceed 120 days while the lender determines the enforceability of a loan. '' As a result of attempting to communicate with XXXX over a year on my loan, I ultimately stopped payment on my loans in XX/XX/XXXX in order not to ratify any modifications to my contract after discovering identity theft in the form of an unauthorized XXXX application in XX/XX/, which XXXX now admits was not applicable to my account. ( Notably, had XXXX pushed my payments ahead due to all of the overpayments, I would be years ahead at this point. ) I provided proof of identity theft ( attached ), yet my credit reports have not been updated in accordance with the foregoing section. I am a small business owner and unable to obtain favorable interest-rate loans for the continued operation of my company as a result of the effect of this identity theft and failure to properly service my loan.

Yet Experian is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. Experian and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. Consumer Complaint: Dispute letters were sent to both XXXX and Experian regarding XXXX Accounts. These accounts were closed and charged off. They were reporting vary inaccurately as well illegally because they were showing Balances and Late Payments on a charged off account, inaccurately matching status on dates, as well repeat info of reporting it being charged off month after month, as well as no data reporting in gaps. I've sent XXXX dispute letters asking for remediation of these inaccurately reporting accounts. However, it appears obvious, that no true action is being taken to make all corrections needed because they totally ignored 90 % of my request. This Has been complete negligence on their part. If an account has been charged off, it should not be reporting balances, past due, etc. because the Creditor has reported 1099-c to the IRS. As it stands in accordance with the FCRA, the inaccurate and incomplete reporting by XXXX and Experian are in direct violation of 15 USC 1681 e ( b ) as well as15 USC 1681 s-2. I have reason to believe XXXX is not properly using the procedures put in place by the FCRA for verification with maximum accuracy. I am attaching the letters and screen shots of the credit reports etc. The first letters were sent via certified mail and I do have receipts verifying the received it. The remainder of the correspondence has been directly via bureaus online portal.

Per XXXX, I was told to look online for this information and there no available information. Neither of the reporting companies have given me a valid source of proof to report those disputed accounts.

In accordance with the Fair Credit Reporting act. The List of accounts and addresses below has violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. 15 U.S.C 1681 section 602 A. States I have the right to privacy. 15 U.S.C 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions 15 U.S.C 1681c. ( a ) ( 5 ) Section States : no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. 15 U.S.C. 1681s-2 ( AN ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.
