Under section 604 of the Fair Credit Reporting Act ( FCRA ) explains that the permissible purposes listed in FCRA section 604 ( a ) ( 3 ) are consumer specific, and it affirms that a consumer reporting agency may not provide a consumer report to a user under FCRA section 604 ( a ) ( 3 ) unless it has reason to believe that all of the consumer report information it includes pertains to the consumer who is the subject of the users request. The Bureau notes that disclaimers will not cure a failure to have a reason to believe that a user has a permissible purpose for a consumer report provided pursuant to FCRA section 604 ( a ) ( 3 ). This advisory opinion also reminds consumer report users that FCRA section 604 ( f ) strictly prohibits a person who uses or obtains a consumer report from doing so without a permissible purpose.

Consumer Complaint: I am again reporting my deep dissatisfaction with the ongoing disregard for my rights as a consumer under the Fair Credit Reporting Act ( FCRA ). Despite my previous dispute attempts, it appears that my concerns have been ignored, and the reported violations persist. This dispute serves as a formal dispute and reiteration of my rights under the FCRA. Unauthorized Disclosure of Information : Under 15 USC 1681b, consumer reporting agencies are required to furnish consumer reports only under specific circumstances and with the written instructions of the consumer to whom they relate. I have consistently communicated my explicit denial of consent for the disclosure of my private information to third-party agencies. It is disconcerting that this violation persists. Failure to Provide Opt-Out Information : According to 12 CFR 1016.7, a c onsumer has the r ight to opt out of credit reporting services at any time. Despite my explicit request to exercise this right, the necessary information on opting out has not been provided. This failure to comply with the law is unacceptable. Inaccurate Reporting and Lack of Verification : Section 1681s-2 ( A ) ( 1 ) A of the FCRA mandates that information furnished to consumer reporting agencies must be accurate. I have previously disputed inaccuracies in my credit report, yet these discrepancies persist without proper investigation or correction. This is a clear violation of my rights. Noncompliance with FCRA Sections 1681c and 1681e : Consumer reporting agencies are obligated to maintain reasonable procedures designed to avoid violations of FCRA sections 1681c and 1681e. The failure to do so, as evident in the persistence of inaccurate information and the lack of response to previous disputes, is a direct violation of the law. I hereby request the following actions : Immediate cessation of any further disc losure of my personal information without my explicit, written consent. A thorough investigation into the circumstances surrounding the unauthorized disclosure, inaccuracies, and lack of compliance with FCRA regulations. Prompt removal of any inaccurate information and a comprehensive report detailing the corrective measures taken to prevent similar incidents in the future. I expect a written response within a reasonable time frame of 14 days detailing the actions taken to address the violations mentioned above. Failure to address these concerns promptly may necessitate further legal action to protect my consumer rights. Your cooperation in rectifying these issues is crucial to upholding the principles of the FCRA and ensuring the accuracy and privacy of consumer credit information. I trust that immediate attention will be given to this matter.
