Consumer Complaint: XXXX XXXX XXXX XXXX XXXX XXXX XXXX, pa XXXX XXXX XXXX Subject : Request to Remove Inaccurate Late Payments from Credit Report Dear experian I hope this letter finds you well. I am writing to raise a serious concern regarding the inclusion of inaccurate late payments on my credit report. It has come to my attention that experian has erroneously reported late payments on my account, which is a clear violation of the laws and regulations governing credit reporting. First and foremost, I would like to bring your attention to the Fair Credit Reporting Act ( FCRA ), which is a federal law designed to protect consumers ' rights and ensure fair and accurate credit reporting. Under the FCRA, Section 623 ( a ) ( 2 ), consumers have the right to dispute any inaccurate information contained within their credit report. In the case of late payments reported by Experian, I must express my strong belief that these entries are not a reflection of my credit history. Upon thorough examination of my payment records, I have found no instances of late payments during the period indicated by Experian. Therefore, I assert that by reporting such inaccurate information, Experian is in violation of the FCRA. Furthermore, I would like to draw your attention to the Fair and Accurate Credit Transactions Act ( FACTA ). Under FACTA, Section 605B ( b ), creditors are mandated to provide accurate and complete information to credit reporting agencies, ensuring the fairness and integrity of credit reports. By falsely reporting late payments, [ Creditor 's Name ] is violating this critical provision of FACTA, which undermines the trust and reliability of credit reporting. In light of the FCRA and FACTA violations committed by experian, I kindly request your urgent assistance in rectifying this matter. I am enclosing supporting documentation comprising bank statements, payment receipts, and any written correspondence with experian during the disputed period. These records substantiate my claim that I have consistently maintained a timely payment history on my account. I request that you take this evidence into careful consideration during your investigation and subsequent rectification process. As a responsible consumer, it is my duty to ensure the accuracy of my credit report. Therefore, I once again emphasize my request to have the inaccurate late payments promptly removed from my credit report, as mandated by the FCRA and FACTA. I further request that you provide me with written confirmation once the necessary corrections have been made. Lastly, I would like to be informed of the steps you will take to address Experian 's unlawful actions. It is imperative that appropriate action be taken against [ Creditor 's Name ] for their violation of federal laws and to prevent the recurrence of such unjust reporting practices in the future. I greatly appreciate your attention to this matter and your commitment to upholding the principles of fair credit reporting. Please do not hesitate to reach out to me at XXXX or via email at XXXX if you require any additional information or if I can assist you in any way. Thank you for your prompt and thorough investigation into this dispute. I eagerly anticipate a swift resolution and the removal of inaccurate late payments from my credit report.
