Consumer Complaint: Despite previous notifications and attempts to rectify the situation, XXXX has failed to conduct a proper investigation and continues to report the account XXXX XXXX XXXX XXXX inaccurately. On XX/XX/XXXX, I sent a letter to Experian detailing the specific errors associated with the account in question, which involves the collection agency XXXX XXXX. I provided evidence highlighting the inaccuracies, and I expected a thorough investigation and prompt correction in accordance with the Fair Credit Reporting Act ( FCRA ). XXXX has since removed this account. To my dismay, Experian has neglected to remove the inaccuracies from my credit report, demonstrating a clear violation of FCRA regulations. Furthermore, this debt is uncollectible. The statute of limitations in the state of Texas is 4 years. This account was opened in XXXX. It is now XXXX. The continued reporting of unverified information not only damages my creditworthiness but also constitutes defamation of character. Given the persistent non-compliance with FCRA guidelines, I must inform you that I am left with no recourse but to pursue legal action against XXXX to seek relief, damages, and corrective measures. I urge Experian to address this matter promptly and rectify the inaccuracies on my credit report within 14 days. Failure to do so will leave me with no option but to initiate legal proceedings. I have documented our communications and the specific instances of non-compliance, which will be presented as evidence in any legal proceedings. It is my sincere hope that Experian will take immediate action to rectify this situation and prevent the need for further legal action. I have attached the dispute letter, which is dated, and time stamped as well as the credit report with clear inaccuracies such as the date last active and the XXXX payment history.

Consumer Complaint: I took out a secured loan ( refinance of another XXXX XXXX ) with XXXX XXXX in XX/XX/XXXX. Around XX/XX/XXXX, I ran into financial troubles and was not able to make my monthly payment on time for the next two months. After missing the two monthly payments, my account was sent to a law firm for collections. In XX/XX/XXXX, I received a collection notice from the attorneys office and I called XXXX to try to make an agreement to catch up on my payments directly with them as opposed to working through the law firm. At this time I also noticed on my credit report that the account was noted as a collection account and also with a closed status. The representative I spoke to at XXXX, said that once an account is sent to legal it is noted as collections and there is nothing she can do about it. Nevertheless, at that time ( XXXX XXXX ) I was able to set an agreement with her to make two months of payments on my account to catch up with the payment still being due for XXXX. To note those payments were made directly with the local XXXX representative, and not through a collection agency or other legal representative. At the end of XXXX I made two monthly payments to get my account completely back on track ( payments for both XXXX and XXXX ) At that time I asked the local XXXX XXXX again if they would be willing to update my account status as the account is now back to an on time status, not closed or sitting with a collection agency. The representative at the local office again responded there is nothing she can do, and I must talk to corporate. I then submitted a dispute to Experian, protesting the listing of the account as closed and collections, to no avail. In XX/XX/XXXX, I called the corporate headquarters to try to once again dispute the account status and the representative informed me that the account is actually not showing as closed on her side ( it is on my Experian credit report! ) but confirmed once again that the account is listed as and will remain as a collection account until the account is fully paid off. I believe this is an incredibly unfair business practice to the consumer, particularly on a loan with a term that has multiple months ( in my instance, the term is more than 20 months! ) and thus will have a negative impact on my credit for more than two years while I am still actively making payments with the creditor and the account remains in an on time status despite it being listed as a collection account ( and closed nevertheless! ) understand there was a point when my account was past due, but I have since returned my account to a positive status and dont understand why a creditor would be allowed to continue to report a debtors account as a collection when that is not the case. It seems XXXX XXXX has elected to put in place a policy that is incredibly unfair to the debtor which will cause undue long term financial harm to me given the impact of the collection status of the account on credit which other creditors will surely view as derogatory and thus prevent me from qualifying for other credit.

Consumer Complaint: My account with this company was never authorized with my express written or verbal consent to report any adverse information in relation to credit card with them. Per the FCRA, as a federally protected consumer, I am now opting out of any and all authorization I, the consumer, may have given you written, unwritten, verbal and non-verbal per 15 USC 6802 to report any adverse information in relation to my account. That includes balance information and missed payments. Please also see this code for the penalties associated with not respecting my request to opt out of the reporting of adverse information. Please also refer to 20 USC 1232g ( b ) on student rights pertaining to privacy. the reporting of my balance and payment information relevant to my XXXX loan accounts is a violation of my privacy which I did not authorize.
