Consumer Complaint: Experian furnished negative payment history on my credit report without any written consent or instructions from me, and without a subpoena from federal grand jury. - 15 U.S. Code 1681b - Permissible purposes of consumer reports- ( a ) In general - Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : - ( 1 ) In response to the order of a court having jurisdiction to issue such an order, a subpoena issued in connection with proceedings before a Federal grand jury, or a subpoena issued in accordance with section 5318 of title 31 or section 3486 of title 18. Per 15 USC 1681g ( a ) ( 5 ) a consumer reporting agency shall not furnish to any person a record of inquiries in connection with a credit or insurance transaction that is not initiated by a consumer. They reported 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information Per 15 U.S. Code 1681 - Congressional findings and statement of purpose Experian has ASSUMED the role in assembling and evaluating consumer credit and other information on consumers. Per 15 U.S. Code 1681n ( b ) - Civil liability for willful noncompliance Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or {$1000.00}, whichever is greater. I am seeking damages up to {$50000.00} for the 19 negative transactions furnished to my credit report, for the adverse actions that continue to arise because of their negative reporting and for the physical harm it has cause my family and I. I am writing to express my concern and submit a complaint to EXPERIAN regarding the improper use of my credit report and the reporting of inaccurate information on my file. I previously sent a letter to your office requesting an investigation into certain unverifiable accounts. Despite your assurance of conducting a proper investigation, upon reviewing my credit report, I discovered that inaccurate information persists. The discrepancies include but are not limited to, the date opened, date of last activity, date reported, account status, and payment history. It is disheartening to note that such inaccuracies continue to be reflected in my credit report, despite the initial request for investigation. I believe this situation infringes upon my rights as outlined in 15 U.S.C 1681 section 602 A, which emphasizes my right to privacy. Consumer Complaint: Hello, On XXXX I sent Experian the attached disputes. On XXXX Experian sent me a stall letter via email that I have attached not preforming the requested investigation I have requested. On XXXX I responded to Experian with the attached letter and was sent another stall letter via email XXXX still not performing the investigation. The 30 days from my initial request XXXX has pasted. Can you investigate this? Many codes from the FCRA regulations and federal laws are being broken. Imagine how many people they are doing this yet and this should not be allowed to continue. I have also attached the tracking numbers for my documents.

Consumer Complaint: Ive noticed that several deviations from mandatory reporting standards therefore the data in my report can not be accurate and complete! With that said, I deny your allegations and I challenge you to provide proof that you have the right to report this incomplete negative information on my credit report. Per 15 U.S.C 1681e Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. According to 12 CFR Part 1022 ( Regulation V ) requires furnishers to : Furnish information concerning accounts or other relationships with a consumer that has integrity. Furnish information about accounts or other relationships with a consumer that is accurate. C - Conduct reasonable investigations of consumer disputes According to CRRG, in order to make a lawful report, you must follow the Metro 2 compliance standards. Also as stated in the CRRG Any Deviation From These Standards Jeopardizes The Integrity of The Data. This means that any mistakes in reporting claims can make the information less accurate and it affects the accuracy of any federally regulated reports. Therefore, I am invoking my rights to challenge these inaccurate and non-compliant items. Neglecting my demand will only prove that you DO NOT care about my rights as a consumer. Its NOT FAIR for you to report information that isnt confirmed to be ethical and meets the standards of certified reporting. Again, I am challenging these claims and asking for proof of the proper reporting standards. You are violating my rights! I have listed the concerns about your reporting in this document. It's not complete and does not meet my standards according to law, you must certify all aspects of required FCRA/ Metro 2 compliance which is done truthfully, correctly ( in a timely manner ), completely AND accurately as well - or else I would have to escalate these issues to the CFPB XXXX FTC and my Attorney General.

A lot of information doesn't connect, match and align with each other, thinking that youre only acquiring this information from one source or creditor. How can that meet the Standards of Accuracy if the reports from each bureaus differ from one another? This is the main reason why I have reason to believe that this account was incorrectly reported under my name. I never authorize any individual or entity to add this item on my file. So this must be automatically removed and deleted as promptly as possible. While I was scanning through my credit reports. This one particular account named XXXX XXXX with account # XXXX XXXX All three credit bureaus have different interpretation of each categories and descriptions : 1. Account Type - Detail > XXXX said it was a deposit related but Experian said it was UNKNOWN and XXXX has no comment 2. Account Status > XXXX XXXX XXXX said Derogatory but Experian said PAID 3. Date Opened > XXXX said XX/XX/XXXX but Experian XXXX XXXX declares XX/XX/XXXX. XXXX. No. of Months ( terms ) : Experian says ONE but XXXX and XXXX says ZERO 5. Date Last Active > in XXXX was on XX/XX/, Experian says XXXX and XXXX was XXXX 6. Date of Last payment : XXXX XXXX Experian has NO Records, while XXXX declares XX/XX/ Thus, I demand that this account must be deleted.

Yet Experian is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. Experian and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211 : Application For Award For Original Information Overview with the Internal Revenue Service against ALL entities involved.
