Consumer Complaint: Subject : Dispute of Unauthorized Negative Reporting Items on Consumer Report Dear Experian, I am writing to bring to your attention a matter of great concern regarding my consumer report. It has come to my notice that several negative reporting items have been added without my consent, which I believe constitutes a breach of privacy and identity fraud. I want to address each unauthorized item specifically : XXXX. XXXX XXXX XXXX. XXXX XXXX XXXX. XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX These items are adversely affecting my credit profile and unfairly damaging my creditworthiness. I assert that these accounts are unverifiable due to the lack of my consent, and no person may furnish transactions between the individual and the consumer, as per the Fair Credit Reporting Act ( FCRA ) Section 623 ( a ) ( 1 ) ( A ) and ( a ) ( 3 ). I draw your attention to the definition of a person under the FCRA ( Section 603 ( d ) ), which includes " any individual, partnership, corporation, trust, estate, cooperative, association, government or governmental subdivision or agency, or other entity. '' Consequently, these entities may not report late payments, which are considered transactions, according to FCRA Section 623 ( a ) ( 1 ) ( A ). In addition, under XXXX XXXX law, violations of consumer protection statutes such as the South Carolina Unfair Trade Practices Act ( SCUTPA ) could be applicable to this situation ( SC Code Ann. 39-5-10 et seq. ). SCUTPA prohibits unfair or deceptive acts or practices, and the unauthorized reporting of negative items without proper verification may fall under its scope. I do not authorize the reporting of any account that tarnishes my reputation. I demand that, effective immediately, these accounts reflect as " paid as agreed never late '' in accordance with FCRA Section 623 ( a ) ( 2 ) and ( a ) ( 5 ). I emphasize that, even in the event of a permissible purpose, the consumer 's consent remains a necessary requirement, which I have not provided, as outlined in FCRA Section 604 ( a ) ( 3 ) ( C ). Thank you for your prompt attention to this matter.

Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: I want to bring to your attention that XXXX has already removed these accounts from their records after acknowledging an error. It is perplexing and disconcerting that your agency, in contrast, appears to have verified these accounts without providing adequate information for verification. This discrepancy raises serious concerns about the accuracy and legitimacy of your reporting. I demand that you immediately delete these inaccurate, erroneous, and unverifiable accounts from my credit report. The persistence of this misinformation not only damages my creditworthiness but is also a direct violation of my rights under the Fair Credit Reporting Act ( FCRA ). I am asserting that you do not have the rights to continue reporting these accounts without proper verification, especially when other credit bureaus have recognized and rectified the inaccuracies. Your non-compliance with my previous requests is both inexplicable and unacceptable, and it appears to be a blatant disregard for the law. The accounts in question, as follows, lack sufficient information for proper verification of the associated debts XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX

Consumer Complaint: Dearest CFPB, I badly needed your help! I am deeply concerned to discover that someone gained unauthorized access to my account and conducted a credit inquiry without my knowledge and approval. This breach of privacy adds to my ongoing frustration with the unresolved issues concerning inaccurate accounts. Despite XXXX deleting these accounts from my credit report last year, both XXXX and Experian have yet to take similar actions. It is upsetting and baffling that different credit bureaus are making varied decisions on what accounts to remove or retain. I believed that if they source information from a single furnisher, their actions should be unified. I request urgent attention to rectify these discrepancies and ensure a consistent and accurate representation of my credit history across all bureaus.

Consumer Complaint: This correspondence serves as my THIRD and FINAL WRITTEN REQUEST, as well as a Pre-Arbitration Notice, regarding the disputed unverified accounts and late payments as well as the unauthorized soft inquiries still found on my credit report. This letter consolidates my previous concerns, signaling my intent to pursue legal action under the Fair Credit Reporting Act ( FCRA ), specifically under Sections 616 and 617 for willful and negligent noncompliance. In addition to the unverified items previously discussed, I have identified multiple soft inquiries on my credit report that I did not authorize. This not only raises concerns about a breach of my privacy but also indicates potential violations of federal law. Alongside my demand for the verification or deletion of the unverified accounts, I request the immediate deletion of all unauthorized soft inquiries from my credit report. Furthermore, I require specific answers to the following questions : 1. Who in your company verified these accounts? 2. How did they verify them? 3. Please provide me with the name of the individual, business address, and telephone number of the person or business contacted during your reinvestigation. 4. Why have you not sent me copies of the verification as previously requested? Under Sections 609 ( a ) ( 1 ) ( A ) & 611 ( a ) ( 1 ) ( A ) of the FCRA, you are obligated to provide any original documentation, such as a consumer contract with my signature. Your failure to provide this information is a direct violation of the FCRA. Section 611 ( 5 ) ( A ) specifically requires the prompt deletion of any information that can not be verified, including unauthorized inquiries. I wish to highlight Section 616 [ 15 U.S.C. 1681n ], which addresses civil liability for willful noncompliance. This section outlines the legal consequences for any consumer reporting agency that knowingly and willfully fails to comply with the requirements of the FCRA, resulting in damages to the consumer. As a litigious consumer, I am fully prepared to enforce my rights through legal action. The responsibility of consumer reporting agencies goes beyond simply echoing information from other sources and necessitates a proactive, thorough approach to both verification and authorization. Therefore, I demand immediate action to verify or delete the disputed accounts and to remove all unauthorized soft inquiries from my credit report. Treat this letter as a Pre-Arbitration demand. Noncompliance will lead me to seek legal remedies as provided under Sections 616 ( willful noncompliance ) and 617 of the FCRA. I expect a prompt and comprehensive response, addressing each point raised and detailing the specific actions you will undertake to correct these issues. Failure to respond in accordance with the legal requirements will result in immediate legal action.
