Consumer Complaint: According to the Fair Credit Reporting Act, our role in the dispute process is to review the accuracy and completeness of any disputed item which may include contacting the furnisher of the information or the vendor that collected the information from a public record source, and notifying them of the dispute and disclosing all relevant information regarding your dispute. When we contact the furnisher or vendor, we ask that they verify all of the information regarding the item you disputed and report back within 30 days of the date that we received your request ( 21 days for Maine residents ). To help resolve the dispute, we will review all relevant documents submitted with the dispute and will forward them to the furnisher if we are unable to resolve the issue. We review and consider the furnishers or vendors response to determine whether to accept it, reject it, or follow up for additional information. If, after processing, we find that the disputed information is inaccurate, incomplete or can not be verified, we then delete or modify that information, as appropriate. If we do not receive a response from the furnisher or the vendor within the required period, we update the item as you have requested or delete the information, and send you the results. In some instances we are able to determine whether the disputed information should be changed or deleted without having to contact the furnisher or the vendor. After we complete our processing, we send you the results. If you question the results of our dispute process, you may also contact the furnisher of information directly. Send copies of any documents you wish to provide to us and always retain your original documents. You may also submit your request or documents supporting your claim electronically at experian.com/upload. This was the email I reccevied from Experian wanting more nonpublic information in order to verifiy my identity but, Experian continuously funrish consumer reports with inaccurate information. How can the infomation in the report be accurate if they need verify the information that they have with proof but there's never a verification process before furnishing consumer reports to obtain proof. This same effort that Experian puts into false reporting and violating federal law, should be the same effort that they should put into producing the signed disclosure between them and I that somehow continues to go ignored. I'm disputing the the unlawful process in which Experian publishes nonpublic personal information. I was excited to see that Experian to intend to use the FCRA as an excuse not to produce this document that would allow " permissible purpose '' according to the FCRA. So I will look at that as that Experian wants the consumer to believe that FEDERAL LAW IS APPLICABLE TO THE CONSUMER BUT NOT THE COMPANY. Experian is in the business of buying and selling nonpublic personal information. Pursuant to Section 604 ( 2 ) of the Fair Credit Reporting Act there is no disclosure with a wet signature that authorizes " permissible purpose ''. Without this this authorized disclosure required by the FCRA, this is consumer fruad and identity theft. Section 604 ( 2 ) of the Fair Credit Reporting Act states that a CLEAR and CONSPICUOUS disclosure be made in writing and also authorized with the consumers signature before any consumer nonpublic personal information can be disclosed. The term nonpublic personal information means personally identifiable financial information provided by a consumer to a financial institution ; resulting from any transaction with the consumer or any service performed for the consumer ; or otherwise obtained by the financial institution. The FCRA prohibits ANY agency from furnishing a consumer report which may include credit information without written consent from the consumer in which it relates to. There is no signed disclosure which would make Experian guilty of consumer fraud and identity theft. Permissible Pupose is the ONLY way to make ANY consumer report that has been furnished lawful. Except as otherwise provided in 15 USC 6802 afinancial institutionmay not, directly or through anyaffiliate, disclose to anonaffiliated third partyanynonpublic personal information, unless suchfinancial institutionprovides or has provided to theconsumera notice that complies withsection 6803 of 15 USC 6803. Theconsumeris given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and theconsumeris given an explanation of how theconsumercan exercise that nondisclosure option. No such disclosure agreements exist and I was never presented the opportunity NOT to have my information disclosed to a third party, so that would make each report that Experian furnished was INCOMPLETE and INACCURATE. Permissible Purpose. If Experian can not produce said disclosure with my signature authorizing the use of my federally protected information, that is a direct violation of FCRA 604 ( 2 ) and all of Federal law. More importantly the would prove that Experian does not have COMPLETENESS or followed procedure to obtain Permissible Purpose. The consumer reports that Experian furnished in regards to me, XXXX XXXX has been a complete disaster to my life and financial situation from loan denials from XXXX XXXX, XXXX XXXX, XXXX XXXX as well several credit cards and auto loans. 15 USC 1681 ( A ) ( B ) ( b ) explains how each of these FEDERAL VIOLATIONS should be handled according and including each violation. Knowing Experian is operating according to the Federal law, Im insured that Experian will handle this issue accordingly. In pursuant to 15 USC 1681 ( i ) in the case of liability of a naturalpersonfor obtaining aconsumer reportunder false pretenses or knowingly without a permissible purpose, actual damages sustained by theconsumeras a result of the failure or {$1000.00}. Anypersonwho obtains aconsumer reportfrom aconsumer reporting agencyunder false pretenses or knowingly without a permissible purpose shall be liable to theconsumer reporting agencyfor actual damages sustained by theconsumer reporting agencyor {$1000.00}, whichever is greater.
