Consumer Complaint: I would like to file a complaint against XXXX Credit Reporting Agency. Ive contacted the company several times and have filed numerous disputes about items reporting negatively on my credit report. I even had a suffix adding to my name and spent months trying to get the matter corrected only to have my credit score to drop in place of the suffix being removed. My score dropped XXXX points because of there negatively reporting practices and not fairly investigating disputes and not requesting information properly upon consumers request. I advise the company of the error and I was denied access of my own credit report and was told that my report had fraudulent activity only to report items back on my credit files that already had been paid, and resolved. They are also reporting items over 7 years old, items paid and discharged through bankruptcy as negative items. XXXX does not investigate items being reported before placing on and individual credit report or do they investigate after a dispute is filed, I have inquiries buy the same company placed repeatedly on my file and when brought to the attention of the Agency nothing is done about it. I feel that individuals scores would not be on the downside if credit reporting agencies will do there part in reporting correct information and making sure that what they are reporting is in fact correct information and not just report information from companies just because they receive information on a individual. Either they investigate and report accurate information or not report it at all. I want my report reviewed for the information Ive stated above and recalculated or for XXXX not to report anything about myself at all. Its not fair!

The basis of my dispute was that my privacy rights are being violated. XXXX XXXX XXXX XXXX XXXX As per the Fair Credit Reporting Act ( FCRA ) under 15 USC 1681 section 602 ( a ), it emphasizes the importance of ensuring that consumer reporting agencies, such as XXXX, XXXX and Experian, carry out their significant responsibilities with fairness, impartiality, and a regard for the consumer 's right to privacy. As a consumer, I have the right to safeguard my private information, as reinforced by 15 USC 6801, which states that financial institutions, including furnishers of information to credit agencies, are obligated to respect the privacy and protect the confidentiality of customers ' nonpublic personal information. Under 15 USC 1681 section 604 ( a ) ( 2 ), it is specified that a consumer reporting agency may only furnish a consumer report in accordance with the written instructions of the concerned consumer. I want to highlight that both the financial institution ( furnisher of information to credit agencies ) and the consumer reporting agencies, XXXX XXXX, XXXX and Experian, lack my consent to furnish this information, and they certainly do not have my written consent. I hereby revoke any and all forms of consent, be it verbal, non-verbal, written, implied, or otherwise, given to XXXX XXXX, XXXX, Experian, and the furnisher of information to credit agencies. 15 U.S. Code 1681b - Permissible purposes of consumer reports Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other ( 2 ) In accordance with the written instructions of the consumer to whom it relates. They need your written consent to add anything to your consumer report if you did not give this authorization that is a violation of the Fair Credit Reporting Act P.L 90-321 ( 82 Stat. 146 ) which is law law that backs the code is even stricter as it states that any agency can only get your report in response to a request by the head of a State or local child support enforcement agency ( or a State or local government official authorized by the head of such an 15 U.S. Code 1681a - Definitions ; rules of construction. The term consumer reporting agency means any person which, for monetary fees, dues, or on a cooperative nonprofit basis, regularly engages in whole or in part in the practice of assembling or evaluating consumer credit information or other information on consumers for the purpose of furnishing consumer reports to third parties, and which uses any means or facility of interstate commerce for the purpose of preparing or furnishing consumer reports. The term consumer means an individual. The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living ( 2 ) Exclusions ( A ) ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; Reporting Transaction history is illegal As outlined in 12 CFR 1016.7, I am exercising my right to opt out of the reporting services provided by XXXX, Experian, and the furnisher of information to credit agencies at any time. Finally, Privacy Act of 1974, as amended, 5 U.S.C. 552a ( b ) Conditions of Disclosure No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, unless disclosure of the record would be : ( 12 ) to a consumer reporting agency in accordance with section 3711 ( e ) of Title 31. This entry violates the Privacy Act of 1974 and must be removed.

Consumer Complaint: Ive contacted the bank in regards to this matter. They claimed its been resolved. Ive contact the law enforcement agency and filed a report and affidavit. They claim they identity theft report is valid. And lastly, Im contact the credit reporting agencies. Both XXXX and XXXX have removed the accounts per legal requirement. But for some weird reason Experian feels Im not following all the steps. XXXX XXXXXXXX PLEASE DELETE!!! XXXX and XXXX have already removed this account from their records. I know the consumer laws and the courts are very lenient with the banks and credit reporting agencies so filing a lawsuit is a waste of energy. They make some absurd claim that the documents Ive submitted are not valid. Id like the CFPB to honestly look closely at this case because it seems this is a lack of their legal requirement to process the identity theft report.
