Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: The XXXX XXXX XXXX had to replaced four different times in 2023, due to fraudulent activity three of those times and once when one of the XXXX XXXX XXXX, incorrectly reported one of the new accounts as fraudulently opened. I've had the fourth and final replacemement card and account since XXXX and it's now late XXXX, and the credit line of {$9800.00} has still not been added back in to my total available credit and factored into my average credit age, which would increase it about six months as it's my third oldest account that I've had for fouteen and a half years. XXXX and XXXX still are reporting transactionsnand different closing balances each month, so how could the account possibly be closed if this is happening? Experian doesn't appear to even have the card at all on their report. The statement for the account has closed four or five times since I received the fourth and final replacement card and account number in XXXX, so it's now been in excess of 120 days, let alone 30 or 90. I've spoken to XXXX XXXX, who issues this credit card on at least two ocassions in the past month or two, and they said that they are reporting it correctly and asked the credit bureaus to correct the account status on their reports. My complaint isn't with XXXX XXXX, it's with all three of the creit bureaus for still having it as a closed status, which is wrong, especially when they also report transactions and different closong balances each month, or not having it on its report at all in the case of Experian, when i've had the most recent replacement card and account number more than four months.

Subissue: Reporting company used your report improperly

Consumer Complaint: per the FCRA as a federally protected consumer I XXXX XXXX, am now opting out any & all authorization i the consumer may have given written, unwritten, verbal & non verbal per 15 USC 6802 Obligations with respect to disclosures of personal information, 313.7 Form of opt out notice to consumers ; opt out methods, with said company XXXX XXXX. U.S. Department The Family Educational Rights and Privacy Act ( FERPA ) ( 20 U.S.C. 1232g ; 34 CFR Part 99 ) is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education. FERPA gives parents certain rights with respect to their children 's education records. These rights transfer to the student when he or she reaches the age of 18 or attends a school beyond the high school level. Students to whom the rights have transferred are " eligible students. '' Generally, schools must have written permission from the parent or eligible student in order to release any information from a student 's education record. However, FERPA allows schools to disclose those records, without consent, to the following parties or under the following conditions ( 34 CFR 99.31 ) : School officials with legitimate educational interest ; Other schools to which a student is transferring ; Specified officials for audit or evaluation purposes ; Appropriate parties in connection with financial aid to a student ; Organizations conducting certain studies for or on behalf of the school ; Accrediting organizations ; To comply with a judicial order or lawfully issued subpoena ; Appropriate officials in cases of health and safety emergencies ; and State and local authorities, within a juvenile justice system, pursuant to specific State law. Schools may disclose, without consent, " directory '' information such as a student 's name, address, telephone number, date and place of birth, honors and awards, and dates of attendance. However, schools must tell parents and eligible students about directory information and allow parents and eligible students a reasonable amount of time to request that the school not disclose directory information about them. Schools must notify parents and eligible students annually of their rights under FERPA. The actual means of notification ( special letter, inclusion in a PTA bulletin, student handbook, or newspaper article ) is left to the discretion of each school. Based on the said laws & codes I exercise my rights as an consumer because my personal information is being used unlawfully. Further his is now a " Charge-Off '' considered a certificate of indebtedness per the IRS and income can not be reported. The IRS Clearly defines a charge off as Gross or Ordinary income, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT which in fact makes reporting of this account inaccurate! I provided a screenshot from the IRS website. By Definition, the IRS Clearly says a Cancelled debt or Charge off is Income. The reporting of this account as a debt is inaccurate & unlawful. As well as sharing or selling my personal student loan info per the The Family Educational Rights and Privacy Act ( FERPA ) ( 20 U.S.C. 1232g ; 34 CFR Part 99 )

Consumer Complaint: I lodged a complaint with these Bureaus a month ago, but unfortunately, the inaccurate information on my report still remains. I haven't received any communication from the Bureaus, except for the notification that you sent stating that the company has responded to my complaint. How can I be certain that they have thoroughly checked the inaccuracies on my report? What methods did they employ to validate the accounts? This whole situation is incredibly frustrating! It's been more than 30 days since I filed a complaint with these Bureaus, and yet the disputed accounts have not been updated. If this continues, I will have no choice but to take legal action due to the immense stress this has caused me. Moreover, I am also concerned about the security of my personal data, as it was affected by the XXXX, Experian, and XXXX data breach.
