Consumer Complaint: I XXXX XXXX. XXXX contacted Equifax via certified mail on or around XX/XX/XXXX and XX/XX/XXXX that there were inaccuracies reporting on my credit profile to do with a late payment from XXXX which is a closed account and also a XXXX record that is reporting inaccurately. I submitted a dispute letter on XX/XX/XXXX to Equifax as follows : Dear Equifax : My name is XXXX XXXX XXXX. This is a letter to request the reinvestigation of the above confirmation number in reference to the XXXX XXXX from a Chapter XXXX XXXX on XX/XX/XXXX. I previously disputed this public record and according to the Equifax credit file dated XX/XX/XXXX, the XXXX Record information is verified and obtained through a XXXX XXXX. The results of your investigation through XXXX are inaccurate because the report that I have from XXXX does not have any bankruptcy records reported under my name. The bankruptcy is still on my credit file from Equifax and this is entirely inaccurate and as such represents a very serious error in your reporting. This is a direct violation of my rights under the FCRA as the information must be reported with XXXX XXXX accuracy. According to the XXXX Credit Report XXXX all information must be reported with XXXX XXXX accuracy. This public record must be deleted from the report as soon as possible or you will be sued to the fullest extent of the law. I further understand that you must complete your re-investigation within XXXX days of receipt of this letter ( 15 U.S.C section 1681i ( a ). ) Once you have deleted this record, please send me a copy of an updated report. Thank you for your assistance. I personally signed and sent this letter. Sincerely, XXXX XXXX Equifax responded on XX/XX/XXXX that as a result of a reinvestigation that a XXXX XXXX remains on the credit file and that the records are obtained through a XXXX XXXX vendor, XXXX. According to my XXXX Report from XXXX there is no XXXX reported in section XXXX of my consumer records. I contacted Equifax to dispute the inaccuracy because in their letter they indicate that they verify the public records through XXXX of which there is nothing reported as far as a XXXX but Equifax is violating my rights as the information must be reported XXXX XXXX accurately and they are continuing to report this on my credit file. I have also disputed the late payment of XXXX which is a closed account and this is not being reported by XXXX or XXXX. My credit file is supposed to be reporting accurately across the board with XXXX XXXX payments and Equifax refuses to correct this late payment status on my credit report.

Consumer Complaint: I have disputed and reached out to this company on multiple occasions regarding this item that appears on my Experian/Equifax credit report. I have sent multiple debt validation letters requesting specific information listed as follow : CREDITOR/DEBT COLLECTOR DECLARATION Please provide the following : Agreement with your client that grants you the authority to collect on this alleged debt. Agreement that bears the original signature of the alleged debtor wherein he/she agreed to pay the creditor. Original contract with original signature of alleged debtor wherein he/she agreed to terms with creditor. Original contract with original signature wherein he/she agreed to enter into terms to pay debt collector. Any insurance claims been made by any creditor regarding this account. Any Judgments obtained by any creditor regarding this account. Name and address of the alleged creditor. Name on the file of the alleged debtor. Alleged account number. Address on file for the alleged debtor. Amount of alleged debt. Date this alleged debt became payable. Original documents related to repossession notification, notice of delinquency, notice to cure, notice of sale at auction, total amount vehicle sold for at auction, and notice of deficiency/surplus from sale of vehicle at auction. Date of original charge off or delinquency. Verification that this debt was assigned or sold to a collector. Complete accounting of alleged debt/ledger from original creditor. Commission for debt collector if collection efforts are successful. Copy of bond and license to do business in my state and state where alleged debt was acquired. ( This is the bond and license that your company filed with the Secretary of State where the alleged debtor resides. ) This company was also informed that this account with the original creditor was fraudulent and a part of a federally documented identity theft case in which a Federal Affidavit of Identity Theft was provided multiple times. Documentation as it relates to this account was also provided. This case was a part of a criminal case in which the person who stole my identity was prosecuted and sentence to a 3yr prison term for this account and several others. This collection agency refuses to remove this item and keeps updating this item on my credit report as to say that I owe this debt. At this point, I have reached out to a Consumer Finance Attorney to fully intend intend to exercise my right sue this collection agency under violating my rights as a consumer under the FCRA and FDCPA, defamation, mental and emotional distress caused by reporting this items falsely, failing to remove inaccurate account of this debt from multiple credit bureau after sufficient proof was given, failure to provide notice of account deletion via postal mail, and wrecking my credit score which resulted in denials for over 6yrs from the date they added the account as a debt to all major credit bureaus. I fully intend to follow through with this federal lawsuit. I only asked that they remove the false and erroneous account from my credit report. There direct refusal to provide adequate proof that this debt belongs to me and refusal to remove this account have made it nearly impossible without taking full legal action. This creditor is continuing to report on an account that was fraudulently opened as a result of identity theft. They are violating several laws under the FCRA and FDCPA. My attorney and I will began filing all petitions to pursue a federal lawsuit against XXXX on XX/XX/XXXX in The United States District Court. The information attached shows that XXXX arrested the person who stole my identity. There are multiple police reports and multiple Federal Identity Theft Affidavits that list XXXX as a fraudulent account. You extended credit to someone who stole my identity without verifying or contacting me in person as my credit report identity theft statement listed. This statement has been a part of all 3 major credit bureaus since XXXX when my identity was originally stolen.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' Equifax, XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX are financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. The financial institutions XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and XXXXhe Consumer reporting agencies Equifax, XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to Equifax, XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Equifax, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. Additionally I do not consent to reporting of transaction history as that is illegal and protected under the Privacy Act of 1974 as well as 15 U.S.Code 1681a. The term record means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, his education, financial transactions, medical history, and criminal or employment history and that contains his name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a finger or voice print or a photograph ; This includes consumer reports!

Consumer Complaint: I received a copy of my credit report and found the following items to be reported in error. Upon doing a thorough research on my reports I found improper inaccuracies on the reports even after they did the thorough verification. By the provision of the fair credit reporting act I demand these items be investigated and removed from my credit report it is my understanding that you will reverify these accounts with the creditor that posted them. Please remove any information that the creditor can not verify I understand that under 15 U.S.C section 1681 ( i ) a you must complete this reinvestigation within 30 days of the receipt of this letter.These entries are in violation of my consumer rights under federal and state laws. Inaccurate Reporting : I have reason to believe that the reporting of this charge-off and collection is inaccurate, and I have not been provided with sufficient proof of the debt 's validity or any prior validation, as required by the FDCPA. Lack of Verification : The debt was never properly validated as required by the FDCPA. Consumer Complaint: I withhold my consent for electronic communication and explicitly request that all responses be conveyed in written form through the United States Postal Service ( USPS ). According to the Fair Credit Billing Act, it is imperative that accurate billing procedures are followed, statements are sent to the correct address, change of address requests are acknowledged, and disputed charges are handled in accordance with legal requirements. Additionally, the Act mandates that you promptly provide lawfully requested information about my account upon my request. In adherence to the FCBA, I request that you furnish a notarized statement on your official letterhead, confirming your compliance with the FCBA in general and specifically with regards to my account throughout my tenure as a customer.
