Consumer Complaint: I received a phone call from XXXX XXXX this afternoon. She stated that she was from the Executive Offices of XXXX XXXX. Although it sounded like a telemarketing nightmare, I spoke to her on a recorded line. After careful consideration I am going to contact my Attorney in this matter to submit a Letter of Representation and move forward with legal action. The total amount of fees that have been fraudulently charged to my account is {$81.00}. I have attached a copy of my personal banking information to reflect that my XXXX Checking account was never charged or attempted to be charged during the time I was actively enrolled in XXXX XXXX " Auto Pay ''. I also will be addressing that what is reported on my Credit Report is incorrect and that when I asked XXXX XXXX to not contact me every day, they then out of retaliation reported on my Credit File the incorrect information of payment late the very same week. I have also attached a screenshot of my XXXX XXXX XXXX XXXX as of today which states in LARGE RED LETTERS " Prevent a 30-day delinquency report to the credit bureaus PAY {$160.00} by XX/XX/XXXX '' TODAY IS XX/XX/XXXX... which is false advertising as XXXX XXXX has already reported delinquency and incorrect information to my credit files ( total of XXXX ). If XXXX XXXX would admit their part in this matter and correct the {$81.00}, I would be glad to pay the {$78.00} today and then they can correct the fraudulent reporting to my credit file. I was laid off of my job for several months and still managed to keep my car payment made. I am in the middle of purchasing a house and because of their illegal practices this is being taken away from me. In XX/XX/XXXX I wrote a letter to address these issues ( see attached ) and received no response. I did however get harassing phone calls every day about making another payment even when I had clearly just made a payment. I have also asked that if XXXX XXXX receives any funds over the regular payment amount it needs to go towards my principal, and this went on to be ignored as well. I made a payment of {$600.00}, and it ALL went towards interest. This is not fair, nor legal to do to a consumer.

Consumer Complaint: I called XXXX on or around the time I XXXX XXXX XXXX and my job was affected. In XX/XX/XXXX I spoke with 2 different supervisors on a recorded line about the billing error and was told that if I made consistent on time payments for 6 months, they would remove my late payments. My credit report has been adversely affected by my lost of employment due to the XXXX XXXX XXXX. After being assured by the management at XXXX that the erroneous late payments would be removed, I've been caught up and consistent an entire year since finding stable employment. I called XXXX today XX/XX/XXXX and The representative refused to submit my dispute for the erroneous late payments and refused to transfer me to a supervisor. ThIs information on my credit report is preventing me from purchasing a home. I would have never been in this position if i wasnt assured that the late payments would not affect me after keeping consistent payments. I feel like this is some form of extortion. If i would have known that XXXX would be this shady, i would have went to another finance company.

I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' it is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' I have not given financial institution written instructions to report these account on my credit report. Last but not least these credit reporting agencies are violating the Privacy act of 1974 ( 5 U.S. Code 552a ). This act states that no agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, unless disclosure of the record would be ( 12 ) to a consumer reporting agency in accordance with section 3711 ( e ) of title 31. Please force all XXXX reporting agencies to delete all of the above accounts immediately.
