Consumer Complaint: I am writing to formally lodge a complaint regarding serious inaccuracies present in my MIDLAND CREDIT MANAGEMENT credit report, which I attempted to rectify through your dispute resolution process. Unfortunately, the outcome has left me dissatisfied as the reported account was not adequately verified, and the inaccurate information persists. Background : I discovered discrepancies in my XXXX XXXX credit report, specifically related to payment status, payment history, date opened, and dates of late payments. In an effort to rectify these inaccuracies, I promptly submitted a dispute letter via mail, outlining the discrepancies and requesting a thorough investigation. Unsatisfactory Results : Regrettably, the results of the investigation were far from satisfactory. Despite my efforts, the accounts in question were not verified, and the inaccurate information continues to be reported. This has a significant impact on my creditworthiness and financial standing. Violation of FCRA : It has come to my attention that my rights under the Fair Credit Reporting Act ( FCRA ), specifically outlined in 15 U.S.C. Section 602, have been violated. Section 602 emphasizes the importance of accuracy and fairness in credit reporting, mandating consumer reporting agencies to follow reasonable procedures to ensure maximum accuracy. Right to Privacy : Additionally, I would like to highlight my right to privacy, which is explicitly protected under 15 U.S.C Section 602. The inaccurate information being reported compromises not only my financial standing but also infringes upon my right to privacy, as it misrepresents my credit history. Failure to Obtain Written Instructions ( 15 U.S.C Section 604 A Section 2 ) : Furthermore, 15 U.S.C Section 604 A Section 2 stipulates that a consumer reporting agency can not furnish an account without the consumer 's written instructions. I have not provided such instructions, yet the inaccurate information persists on my credit report. Attached FTC Report : In support of my complaint, I have attached the FTC report with the report number XXXX. This report details the inaccuracies and the steps I have taken to address them, providing a comprehensive overview of the situation. Request for Remedial Action : I hereby request a thorough and immediate reevaluation of my dispute, ensuring that all relevant accounts are verified and the inaccurate information is rectified in accordance with the FCRA. Additionally, I urge MIDLAND CRED to take corrective measures to prevent such violations in the future. Next Steps : If this matter is not resolved promptly and satisfactorily, I may be compelled to pursue legal action to safeguard my rights under the FCRA. I appreciate your prompt attention to this matter and expect a timely resolution. Please provide written confirmation of the XXXX. Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: On or around XX/XX/2023, and XX/XX/2023 I sent letters via certified mail that also included a copy of my driver 's license and a utility bill to verify my identity to Midland Credit Management. I sent the letters after I obtained a copy of my consumer report and I saw that they were reporting a debt. I requested verification that shows it was me who owed the debt. I requested to have the documents with my original signature as I am a victim of identity theft and have identified several names and addresses on my consumer report. Midland Credit Management has failed to provide me with the proper disclosures for verification of this debt however they continued to send letters and call me to collect on a debt that I do not know of.

Consumer Complaint: I am writing to address an ongoing issue that has remained unresolved for the past four months and to express my extreme dissatisfaction with the handling of my dispute. As I have previously notified you, there is an account inaccurately reporting as a collection on my credit report, listing your agency as the debt buyer. This account, with reference number XXXX, is not only reporting different balances to the credit reporting agencies but is also providing inconsistent dates for the " date last active, '' a clear violation of industry regulations. Despite my prior notifications and the submission of a dated and time-stamped dispute letter, your agency has failed to rectify this situation and remove the inaccurate account. This is not only a blatant violation of the Fair Debt Collection Practices Act ( FDCPA ) but also a demonstration of negligence on the part of your agency. This letter serves as my final notice before I pursue legal action against your company for defamation of character and FDCPA violations. The inconsistent reporting of balances, conflicting dates, and failure to address my dispute demonstrate a lack of due diligence and adherence to industry standards. I have attached a copy of the credit report in question along with the dated and time-stamped dispute letter for your reference. I implore you to take immediate corrective action by removing the inaccurate account and providing me with an updated credit report reflecting these changes. Your prompt attention to this matter is essential to avoid further legal proceedings. I expect a resolution within 14 days from the date of this complaint.

Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: There was a credit card debt which was for approximately {$350.00} I was garnished for {$870.00} by Midland Credit Management. I was informed that the total with fees was {$910.00}. This was in XX/XX/XXXX on the XXXX I spoke with XXXX XXXX. I was informed that all monies withheld after the garnishment release would be returned to me the defendant it was not. It was returned to my employer in a untimely manner. The release is dated XXXX XXXX I received a payment from XXXX XXXX of funds that had still been sent to the company after this date. XXXX states that payments received were {$1000.00} my check records shows {$2000.00} was sent to them. I have yet to received the excess money paid to them. As I have spoken with the XXXX XXXX for XXXX the last week in XXXX. I have received all monies returned to them. Several checks were sent to them after the case was supposedly closed. The garnishment release stated these monies would be sent to me the defendant with the exception of the XXXX check for {$180.00} all other monies due and owing was sent to XXXX XXXX. Meaning, I had to wait for it to clear their bank and then they cut me a check. The last one from them being dated XX/XX/XXXX for {$390.00}. This is the total of XXXX out of the XXXX checks that Midland received after the garnishment case was CLOSED, which now they claim they haven't received {$2000.00} in total. This seems to be tactical intended to cause frustration and financial deprivation to the defendant with no consequence to the plaintiff Midland. Only causing financial harm to me the defendant. At this point there is no excuse for the untimely manner in which this was handled. From XXXX to the present they are still issuing out the overage in minute increments. Another check was issued on XX/XX/XXXX for {$12.00} to XXXX and not the defendant. Why? To delay return of funds and tactilely withhold money that was received and punish the the defendant, myself. This could have been solved amicably with the plaintiff, but it was not possible to have a civil conversation with the collectors. The was paid within XXXX weeks we could have negotiated a payment agreement if communications was not lacking. My income was not lacking to pay the debt but civil conversation was not to be had when collectors take an accusatory tone and attitude and one can not gain clarity with an argumentative individual. At this point I am owed a balance of {$510.00}. The company/Midland has XXXX lied and said they only received {$1000.00} the records I have beg to differ. There are still XXXX outstanding checks period.

Consumer Complaint: I asked the debt collection agency for a debt validation letter. A copy of the last billing statement sent by the original creditor, the amount owed when the collector purchased the debt, and the date of the last payment and whether the debt is past the statue of limitations. They had called me in the beginning of this year and i asked for that stuff on the phone and I also only told them to contact me through mail and never via phone again, and I have never received the debt validation letter or a follow up from them since the beginning of this year.
