Consumer Complaint: I have just been notified that I am being sued by this s collection agency, when I have spoken with them over the phone twice. I spoke to two different men, both of whom I notified of the identity theft that I filed with the FTC and that I had cancelled all of my credit cards upon learning of the theft and was disputing the debts. I am a XXXXXXXX XXXX who is in the process of a lengthy divorce and living solely on the VA payment I receive each month. This has prevented me and my children from moving and has prevented me from being able to accomplish much else in the way of financial services and legal services in regards to the debts. At the time of the identity theft I was current and had a positive balance on all of the credit cards in my name, but when my identity was stolen, they pushed transactions through over the limit, raised and overmaxxed my limits, and then a few of the credit card companies did not cancel the cards when notified of the theft and asked to do so. They just kept them open, furthering the damage to my credit. I would XXXX like to note that these debts are double reported on my credit, furthering harm to me and my children. I receive less than {$2000.00} a month, no other financial support and am now being sued for a debt that on two occasions I notified this collection agency weren't mine. I believe that they even bought out the debts for other credit cards from the same identity theft and fully intend to file suit for those as well.

Consumer Complaint: I was going over my credit report and noticed that my rights have been violated under 15 U.S. Code 1692b - Acquisition of location information Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall ( 1 ) identify himself, state that he is confirming or correcting location information concerning the consumer, and, only if expressly requested, identify his employer ; ( 2 ) not state that such consumer owes any debt ; ( 3 ) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information ; ( 4 ) not communicate by post card ; ( 5 ) not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communicationrelates to the collection of a debt; and ( 6 ) after the debt collector knows the consumer is represented by an attorney with regard to the subject debt and has knowledge of, or can readily ascertain, such attorneys name and address, not communicate with any person other than that attorney, unless the attorney fails to respond within a reasonable period of time to communication from the debt collector.

Consumer Complaint: XX/XX/XXXX. called midland credit to take care of a debt thats on my credit report. The XXXX guy made a payment agreement with me. He had me go on his website and fill out my info to accept the plan. We were disconnected. I called back and explained the plan and that I was disconnected Telling him all this he asked my address. Well I currently do not have an address as I have been staying in truck or hotels. He then tells me he cant take my payment or that he cant give me a payment plan. After all this was just set up. Asked for manger. Spoke to manager and he agreed on payment that is good till XX/XX/XXXX XXXX but wont accept a payment from me because I dont have an address. Im currently XXXX still trying to make a payment so I can improve credit better, so I can get out of my situation. As I was filling this out getting account number. Went back on the website and the XX/XX/XXXX plan was changed to XX/XX/XXXX now. How do I get this removed from my credit if they wont accept a payment? Any help would be greatly appreciated

You and your inaccurate information have damaged my livelihood. 15 U.S. Code 1681 s-2 Responsibilities of furnishers of information to consumer reporting agencies ( a ) Duty of furnishers of information to provide accurate information ( 1 ) Prohibition ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate : ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate ; and ( ii ) the information is, in fact, inaccurate. Duty : a moral or legal obligation ; a responsibility. Accurate : correct in all details ; exact Prohibition : a law or regulation forbidding something. As defined by the IRS : Even if you didnt receive a Form 1099-C, you must report canceled debt as gross income on your tax return. The IRS Clearly defines a charge off as Gross or Ordinary income, INCOME DOES NOT GET REPOTED ON THE CONSURMER REPORT which in fact makes your reporting of this account inaccurate! By definition, The IRS clearly says a canceled or charge off is income. The reporting of this account as a debt is inaccurate. 15 USC 1681 s-2 says you are a furnisher of information to a consumer reporting agency. You ARE PROHIBITATED BY LAW to furnish inaccurate information. I demand you to cease and desist the reporting of incorrect/inaccurate information immediately. 15 USC 1681 s-2 ( a ) ( 1 ) ( A ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate : You are hereby put on notice that you are furnishing incorrect inaccurate information. The lender must file Form 1099-C and send you a copy if the amount of debt canceled is {$600.00} or more and the lender is a financial institution, credit union , federal government agency, or other applicable entity as discussed earlier in chapter 1. The above paragraph is taken directly from the IRS 2021 publication. SEND ME MY FORM 1099-C that you should have sent to when you filed the account as a canceled debt. Consumer Complaint: I received a debt collection notice from Midland Credit Management XXXX XXXXXX/XX/2023. I called MCM XXXX XXXXXX/XX/2023. Spoke to XXXX and he would not let me speak while he kept interrupting me. I then asked to speak to a supervisor. XXXX kept being rude and I said this an alleged debt and I would like to dispute the claim. XXXX said there was no supervisor to speak to. I said please let me know when I could call back to talk to the supervisor? XXXX then said " I will make a note that you ae refusing to pay '' then proceeded to hang up on me. I did record the entire call. I then sent a certified validation letter on XX/XX/2023. XXXX XXXX XXXX XXXX XXXX I have not received a response to my request.
