On XX/XX/2022, Promissory Note No. XXXX made out to DISCOVER to discharge the entire balance of the the credit card, was remitted for settlement and closure. The Negotiable Instrument was presented under the authority of UCC-2-104 ( c ) and other precedent ( see attachment ). Instructions were given to DISCOVER that unless the Negotiable Instrument is DISHONORED in writing within 10 days of receipt, by the SECRETARY OF THE TREASURY, Claimant 's financial institution was to release the credit on hold to the payee ( claimant ) with the time stipulated by Regulation " Z '' Truth in Lending Act. The amount of this accepted draft was to be ledgered by DISCOVER, XXXX Department, to the designated account for the redemption of this claim ( Regulation Z ). This statement constituted Drawer 's order to pay this instrument upon presentment and endorsement. DISCOVER failed to zero out my account. DISCOVER engaged in unlawful, illegal, and predatory banking policies and procedures. I have attached all the letters and copy of promissory note sent to DISCOVER in good faith attempts to zero and close this account, all of which have been ignored and have gone unanswered.

DiscoverCard, and they are reporting the on record til reporting information directly contradicting other data reported for the same issue and falsity reporting that the debt is to be removed from my credit files on the incorrect date of XX/XX/XXXX. The evidence being provided to you today is proof beyond a reasonable doubt and admittedly by the creditor as seen in their admission and into entry notes to my credit report verifies the remove from record is XX/XX/XXXX. The statement that they provided to you ( see attachment ) claims that the late 30 days initial date of delinquency began XX/XX/XXXX and by their own account, a fact, the expiration of the XXXX rule, would be XX/XX/XXXX. ( Not XX/XX/XXXX as you and the creditor Continue to report inaccurate data The creditor has had also 7 years to get this information right if it were a validated account thus far and the creditor has engaged in other illegal behavior to re-age this account by reporting several months of satisfactory payments to the credit bureaus recently and maliciously and has not yet answered to that complaint. DiscoverCard, The creditor, keeps changing dates and reporting fictitious payments to this account to re-age this collection account.! Also, Discover card tried to extort money from me through a collection agency that impersonates a law firm and had that agency send me a letter recently asking for over {$1000.00} more than the debt as listed by them previously.

Consumer Complaint: I opened a Discover Bank savings account on XX/XX/22. On XX/XX/22, I made mobile deposit of {$16000.00}. On XX/XX/22, the deposit was approved. After notification that the deposit was approved, also on XX/XX/22, I attempted to make a second mobile deposit of the same amount. Later that day, I was notified that the account was suspended due to unusual activity. I called that day and was notified that the account was closed for business decisions, but was not told why. With so little activity on the new account, its difficult to imagine what was unusual. Since XX/XX/22, I have called Discover Bank four times ( XX/XX/22, XX/XX/22, XX/XX/22, XX/XX/22 ), and received three letters in the mail and XXXX emails from Discover Bank. No communications have indicated why the account was closed ; XXXX representative told me that it was his entire job to not tell people why their accounts were closed. In the various phone calls and letters, I was told the account was suspended, closed, canceled, and under review. I was also told that I would receive the balance of my account within XXXX days, then 60 days, and, most recently, after at least 60 days. XXXX representative implied that the XXXX waiting period was an external regulation and not an internal policy. Im concerned about what is going to happen now. I dont know if I will ever see the {$16000.00} that was deposited. I dont feel like I can trust Discover Bank as, every time I called, I was assured that a supervisor would call me back within XXXX business days, and to date no one ever has. In my most recent call, I requested a case number : XXXX. I would like to receive my fund balance as soon as possible. Not having access to my funds and the lack of clarity is making it difficult to save for a home.

Consumer Complaint: I opened dispute on XX/XX/2022 for a failure transaction and I provided sufficient documentation showing I already paid the transaction with another way ( through XXXX XXXX and the XXXX transaction ( {$3000.00} ) was a failure and I just quickly disputed from discover credit profit and let both XXXX and discover know about it. From the day I opened this dispute case before it become closed and till now, I communicated with several agents from both discover and XXXX which is disappointing, XXXX refer me to Discover and Discover refer me to XXXX like an infinite loop without any results and both sides are not taking responsibility to secure my money. XXXX on XX/XX/XXXX deducted the money {$3000.00} from merchant but never recalled to my credit account. Yesterday XX/XX/2022, I communicated with the supervisor of XXXX. He said because the dispute is opened out of XXXX we cant secure your money and now the decision is made by financial institute that the transaction is valid we can not refund the money to your account and you can not even open a dispute from our side now since you already opened a dispute from discover and they make final decisions that is valid and said we cant do anything for you. XXXX supervisor said : " You should directly reach out to merchant or go to court for this case. '' I have a big complaint from discover for the investigation decision that could not secure my money after more than three months and waste a lot of my time, energy and at the end is not compensating for this case. If the dispute is not functioning for the transaction is made by XXXX, why discover provide this option for customer to waste time and energy and at the end the money of customer will be unsecured? If the dispute option will work for this case why customer should communicate with merchant to provide a letter that guarantees the money will back to account? What if the merchant is scam or fraud and the customer does not have access to merchant for communication? I already uploaded the documentation showing I did the transaction in another way and several agents of discover that I talked with them told me it seems good enough for this case. I cant trust if any other problems happen and I need to dispute the transaction, the discover will able to secure my money and I expect discover compensate this frustrating situation for me. My credit score dropped XXXX because of this dispute case, and my history shows I NEVER had a missed balance and I had " very good '' score. XXXX XXXX XXXX XXXX and I spent a lot of time that I should put on my research on this dispute case and spent a lot of energy for communicating between XXXX and discover which seems there is a fight between them that I am a victim of this fight. If I should at the end go to the court or should communicate with merchant to refund my money directly to my credit, then what is the purpose of dispute and why after more than three months discover provided me this solution that the transaction is valid and resolved and if uploading a letter showing merchant will refund money we will accept since I already uploaded emails from merchant showing the money is deducted from their account by XXXX and XXXX was responsible to refund it but discover did nothing and just resolved the case and pit this burden on my side to resolve it. I cant accept the results of discover investigation and the decision they make and even their solution.

Pursuant to 15 USC 1681 ( b ) ( 2 ) In accordance with the written instructions of the consumer to whom it relates As i never instructed XXXX XXXX writing to furnish this report and never consented to this report of DISCOVER BANK ACCOUNT NUMBER : XXXX as well as DISCOVER BANK INQUIRY ON XX/XX/XXXX in the first place as well as pursuant to 15 usc 1681 ( a ) ( 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. So XXXX just assumed that XXXX they could report this and XXXX never had my permission and stole my identity to report on my behalf.. As stated on the back of all billing statements from XX/XX/XXXX to XX/XX/XXXX, Credit Balances. If your Account has a credit balance, the amount is shown on the front of your billing statement. A credit balance is money that is owed to you. You may make charges against this amount if your Account is open. We will send you a refund of any remaining balance of {$1.00} or more after 6 months, or as otherwise required by applicable law, or upon request made to the address in the Contact Us section on page XXXX of your billing statement. Which correlates directly with 12 C.F.R. 1026.11 ( a ) as well as proof that {$4300.00} was the total amount of money I was owed since such amounts were on my billing statements every month. So I was owed this amount as these amounts where owed to me and was credited to my account in which DISCOVER has been falsely reporting with XXXX.
