Consumer Complaint: My name, birthday, and social security number were stolen in XX/XX/XXXXXXXX due to a data breach of my former employer 's ( XXXX XXXX ) records. Nearly XXXX XXXX ( former ) employees were affected because hackers got into the data of the company that manages XXXX XXXX 's data ; that company is called XXXX XXXX, XXXX. XXXX XXXX alerted me of the data breach, along with the other XXXX XXXX people, in XX/XX/XXXX. Subsequently, I signed up for XXXX XXXX XXXX free credit monitoring service, a service which they advertised in the same letter notifying that the data breach occurred. Today ( XX/XX/XXXX ), I was notified by that credit monitoring service that yesterday ( XX/XX/XXXX ), someone ( not me or anyone I know ) opened a Discover Bank credit card in my name. The associated address is XXXX XXXX XXXX in XXXX XXXX XXXX, UT XXXX, according to the credit monitoring service. I myself did open a Discover credit card in XXXX, but not on XXXX. The account new as of XXXX must be a fraudster who gained access to my name, birthday, and social security number from XXXX XXXX XXXX data breach. My credit score dropped from about XXXX to XXXX due to the fraudster opening this new line of credit.

Consumer Complaint: Against my knowledge or consent, a personal loan for {$4000.00} was made by the on-line Discover Bank on XX/XX/XXXX. I had no knowledge of the loan on my credit report until I tried financing something else on XX/XX/XXXX. In an effort to save my credit, I immediately paid the loan off even though they had written off the loan. I have been in dispute with Discover Bank ever since. I believe the loan was taken out in my name by XXXX XXXX who XXXX a XXXX XXXX He had access to all of my personal information. I have asked the lending company for proof that it was me that took out the loan. Specifically, signature, copy of ID, thumb print or anything else they used to approve the loan other than an on-line application.. To this date, they have furnished me with no copies of proof. I have spoken to them many times and they admitted it was not me as the XXXX XXXX XXXX XXXX tried to take over the loan. However, they will not officially release me from the responsibility of the loan because they know they have wrong information on my credit report and that the may have to reimburse me the XXXX. I have filed complaints with the credit services and the last one was done by XXXX XXXX. I specifically asked them to not just take the word of the financial institution and ask for any form of identification that it was me that took out the loan other than information provided on an on-line application. XXXX did not do that. They stated that the loan company certified it was me that took out the loan but again provided no copies of my identification. I am retired, own my own home outright and have nearly the max amount of money in my checking account alone that the government would insure. I have never taken out any type of personal loan in my life. I have hundreds of thousands of dollars available to me and would have no need to take out a personal loan. This is is case of on-line identity theft and neither the bank or credit bureau seems to be able to understand that. All I have asked for is a form of physical proof that it was me that took out the loan. Signature or copy of government issued ID would be the most logical. They cant do it and the negative event is still on my credit report.

This company has tried some unethical events and stunts in claiming that I am liable and responsible for something that I did not consent to or authorize. I have requested many times for this company to produce such Loan Applications which they have failed to produce. I have requested all rules, regulations, policies, and procedures where I have to consent for this company to get my tax returns. This company called Discover has failed to produce and provide such information. This company has taken my rewards from such program, I was enrolled in which is a breach of any contract such company may wish or want to use or claim. I have all the records to support my act or action for immediate court action into the policies and conduct performed throughout these months. The company called Discover Card Services has made many unethical excuses or claims claiming to address issues or problems or other illegal events and tactics when I have disputed such charges as unauthorized and to cease any further business relations with such company due to these unethical events. Now since Discover Card Services knows so much now produces all the official and legal records from the attached records submitted in this complaint before the Consumer Financial Protection Bureau and its audience. I want ALL OFFICIAL AND LEGAL RECORDS and not just some statement made up to cover and conceal your acts or actions. Attached you will find records officially signed off on by people behind such records. Your ( Discover Card Service ) records should be the same.

Their failure to validate the debt not bars them from recovery and the legal right to report derogatory information, or any information regarding the a debt they have failed to validate. In XXXX of XXXX I was contacted by their attorney XXXX XXXX, at which time I provided him copies of all transmittal 's sent to his client, Discover Credit card, and demanded that they either remove themselves from my trade lines, or sue me for their claimed losses, at which time I would counter-claim and seek damages for their violation 's under the TCPA. I Demand that this creditor be removed from my trade lines immediately and subject to any sanctions or fines that they might be subject to for their violations under the fair credit collections act, and the TCPA.
