Consumer Complaint: Buying the car XX/XX/XXXX they sale this Car damaged because one hour later the car is no longer good in XX/XX/XXXX I return the car to the dealer ( No longer interested in the car ) the dealer XXXX XXXX XXXX On the afternoon of XX/XX/XXXX I went to XXXX XXXX which is located at XXXX XXXX XXXX XXXX XXXX XXXX VA XXXX so i get the car is XXXX XXXX XXXX I was running some errands with my children of XXXX, XXXX, XXXX years and XXXX XXXX. Stopped at a traffic light the truck began to shake unstoppably, the engine light came on. I got nervous and very afraid for my children and myself. I called XXXX and told him what was going on with the truck. That same day, XX/XX/XXXX in the afternoon my husband took the truck to the dealer XXXX XXXX XXXX because I was too scared to drive the truck. His mechanic looked at it, they turned off the check engine light, my husband came back home but on the way the check engine light came back on and the truck was shaking when stopped too. The same situation I had in the morning. I called XXXX again the next day, explained what had happened and he told me to bring the truck and that same day left the truck there. The truck kept giving the same problem and he gave me the address of his mechanic which is located at XXXX XXXX XXXX, XXXX XXXXXXXX XXXX, XXXX, VA XXXX. I didn't hear anything about the car until XX/XX/XXXX when I decided to call the mechanic.. The mechanic said that he had already talked to the warranty and that he was working to resolve the problem with the car. He had the diagnosis, the oil pump and the timing band was the vehicle problem. The mechanic told me that the warranty does not promise to repair the problem of the car 100 % and that the other part that the warranty does not cover will be my responsibility, he also told me that we had to wait 2 weeks after the truck was sold from the dealership and I talk to the dealer manager ( XXXX XXXX and he agree with him. But, it does not sound right to me. Today, XX/XX/XXXX, I spoke with the guarantee, they said they received the report that the truck has been in the mechanic since XX/XX/XXXX. And I said to the mechanic Since XX/XX/XXXX, the truck has not been able to drive for a full day due to the problem that it shakes and the engine light is on. The truck XXXX sold me that XX/XX/XXXX is not safe to drive. My purpose of taking a car from a dealer is because I didn't want to go through a problem like this. I wanted the security that a dealer gives when selling a car in good condition. I do not want to be in this situation ever again, I prefer to return the truck and have all of the downpayment I gave in the beginning, the {$3500.00} because is not fair to me, to loose all the money for a car I was not able to drive not even for a full drive and that can not be secured at it wont give a problem in the future. I want this car to get remove from my credit report, with the bank Credit acceptance corporate that Ive been in contact for multiple times and I didnt good resolve. They want me to pay the car even though they know the problem with the car XXXX.

Consumer Complaint: Credit Acceptance is furnishing inaccurate information to the consumer reporting agency, The reporting of inaccurate information has caused severe damages to my character, my reputation and general mode of living and my ability to obtain credit for personal and home purposes-15 U.S. Code 1681a ( d ) ( 1 ) ( A ). Furthermore, Credit Acceptance has obscured the true cost of its loans to car buyers, leading to severe financial distress for borrowers and subjecting them to aggressive debt collection tactics on loans its own systems predicted that borrowers cant afford to repay. Reporting misleading high balance along with inflated interest, borrowers that default on loans, lead to severe consequences, including wage garnishment and an inability to borrow money in the future. A default on an auto loan can also lead to the borrower losing their means of transportation, which can cause job loss and a further spiral of damaged credit and financial distress. According to 15 U.S. Code 1681s2 - Responsibilities of furnishers of information to consumer reporting agencies. ( 1 ) Prohibition ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. person- ( b ) The term person means any individual, partnership, corporation, trust, estate, cooperative, association, government or governmental subdivision or agency, or other entity. Prohibition- the action of forbidding something, especially by law.

Consumer Complaint: First and foremost, Credit Acceptance has been getting away with fraud for so long that you think it is truth and what you say is the Law. I know the law. I am not obligated to do anything regarding any contract when misleading, deceptive, and unfair practices are involved. Therefore, the account in question is invalid, cancelled and paid in advance as I stated in my last letter. Once again, I did not receive a welcome letter on XX/XX/XXXX, from your companies saying anything about reporting late payments, missed payments or other defaults. I have the right to say I do not want to participate in that. CREDIT ACCEPTANCE is a financial institution. Financial institutions need your consent to disclose any non-personal information to any third party. 15 USC 6802 ( B ) ( 1 ) ( B ) clearly states you have to get my consent before releasing non-personal information to any third party. Just to be clear, this goes for the credit bureaus, repossession companies, collection agencies, and this list goes on. The documents you attached about the disclosure I have never seen, witnessed or acknowledged. I do not have copies of those documents, only you and your companies. I should have received every single page of the contract. This is deceptive violation since Credit Acceptance and the car dealership are hiding and not presenting documents and forging my signature onto documents, I had no knowledge of. 15 US Code 1681 ( b ) and 15 US Code 1681 ( a ) ( 2 ) clearly states consent is needed for everything reported on my consumer report, but when did I give you consent? The code also states I have the right to confidentiality and privacy as a consumer. I did not consent on XX/XX/XXXX, and I do not consent now. Therefore, Credit Acceptance will have to correct all of the false reports made on my credit report since I never gave you permission or consent. 15 US Code 1681e ( b ) says everything on consumer report is supposed to report to maximum possible accuracy. Yet the FCRA says transactions, experiences, and approvals of credit arent included in consumers reports per 15 US Code 1681a ( 2 ) ( A ) ( i ) ( B ). Once again, your companies did not give me the opportunity to decline or consent to you reporting experiences or transactions to my credit report. This is a violation, you stated in your letter that sending this disclosure form satisfied your companys obligations for information sharing and privacy, since I did not receive this letter, you mentioned. I do not consent, and I never have consented to your companies sharing my information with ANY and EVERY third party thats exists. CREDIT ACCEPTANCE does need my permission before executing anything involving my all-capital letter name XXXX XXXX XXXX XXXX my social security number, or anything else pertaining to me as the beneficiary. GET THAT CLEAR. Not many challenge your company so Credit Acceptance thinks the corporation can do what they want, but I am here to show you otherwise. How do you respect my privacy if Credit Acceptance Corp did not tell me about XXXX XXXX XXXX, the indentured trustee for Credit Acceptance Corp, that is the vice president of XXXX XXXX XXXXXXXX XXXX You may trick other consumers, but you are not tricking me. You may think that you have all of the power and what you say is law, but I am not obligated to pay this debt. I will not pay this debt. I know the car was paid for in advance per 18 US Code 8, HJR 192 and 31 USC 3123. HJR 192 of 1933 clearly states Every obligation, heretofore or hereafter incurred, whether or not any such provisions are contained therein or made with respect to thereto, shall be discharged upon payment, dollar for dollar, in any such coin or currency which at that time is legal tender for public and private debts. 31 USC 3123 says the secretary of treasury shall pay interest due or accrued on the public debt. 31 CFR 357.13 says A Federal Reserve Bank credits the appropriate amount of interest on Book-entry Securities to a Funds Account maintained at the Bank, or pays it as directed by the Participant. Book-entry Securities are redeemed according to their terms, a Federal Reserve Bank withdraws the securities from the Participant 's Securities Account in which they are maintained, and either Credits the amount of the Redemption proceeds, including both principal and interest, where applicable, to a Funds Account at the Bank, or Pays such principal and interest as directed by the Participant. This means all obligations are discharged and credits will be applied to the funds account as directed by the participant. I would be considered the participant in this case. It also says nothing is required by the participant. Anytime a consumers social security number is used in a transaction it pays the transaction off legally. I know my consumer laws and I know Credit Acceptance Corp has violated many if not all of them. 15 US Code 1692j says it is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. Credit acceptance is not the creditor and is in violation of 15 US Code 1692j, and you should not be sending me bills in the mail claiming I owe a debt that I do not owe. Credit Acceptance has created a false belief in making me believe I owe a debt that does not belong to me. This would be considered a deceptive form. The law tells us all debt, public and private, belong to the United States and are prepaid per 18 US Code 8, it does not say debt belongs to consumers. Credit Acceptance has willingly failed to provide me with full disclosure of my right to rescind the contract per 12 CFR 1026.23. The company has failed to let me know my contract was a financial asset that paid for the car once I got it. Your company also misrepresented the finance charge by not giving me a summary of all charges. Your companies have violated several consumer laws that I pointed out in the last letters, and I will point it out in this one again. I have third party companies created to protect me from predatory lending companies like you when I am out getting approved for things on credit. The contract you have attached is not the same one I received. I am missing several pages. I definitely have never seen the arbitration clause page or the CREDIT ACCEPTANCE CORPORATION DISCLOSURE FORM until now. I know for a fact that my signature was forged upon those 2 documents. I wonder what other documents I have not seen, and my signatures were forged upon using E-signature system. The car dealership specifically told me out of their mouth EXTENDED WARRANTY and GAAP are mandatory. This misleading, deceptive, and unfair once again because it made me confused. Your companies are not supposed to mislead or direct consumers into a direction without full consent and true knowledge. You can not just disrespect and violate consumers rights. I never signed a document stating I would give all I owe under a security interest. Page 4 of the contract that you uploaded shows the dealers signature and my initials at the bottom with an E-signature. I did not sign, agree or acknowledge that, I dont have that page included with the contract given to me. You state I signed documents that I have never seen, with no proof. I also did not agree to that price of the vehicle you stated. Credit Acceptance and the car dealership forged my signature onto other documents using the E-signature system which is a serious felony. Once again, I am not obligated to pay anything your company claims. I am not obligated to do anything and as a consumer I have the right to get out of any contract involving fraud and deceptive acts. I am not trapped in any contract with any corporation as a living flesh breathing soul giving to me by the MOST HIGH GOD. Credit Acceptance is not the most high God therefore I am not obligated to do anything this company tells me. Credit Acceptance and its companies resemble the devil using deceptive, misleading information, and taking advantage of consumers. For me to be legally bonded to a contract there has to be a signature with both involved parties. The law clearly states that. Do you think you can just tell me anything? There has to be a contract with my signature and an agent from Credit Acceptance for this contract to be legally bound. That is a Uniform Commercial Code law. Consumer credit transactions are only cash in hand. I dont remember receiving a check, cash money, or a money order to pay for this vehicle. Where is the proof that Credit acceptance actually loaned anything in collateral for the vehicle. Inside your XXXX and XXXX filings credit acceptance is listed as a borrower, servicer, issuer, but not a lender. What did you lend? Credit Acceptance is not a creditor. I suggest you reread my previous letters sent and its entirety because they still stand and the remedy, I have set in place also still stands. I will attach them again for reference. I am fully disputing this debt that was in paid in full until you update everything I have demanded. Car dealership and Credit Acceptance Corp forged my signature on to many documents because as I have just gotten to the end of this letter and have taken a clear look of the retail installment contract I received from the car dealership ; I am missing several pages. This contract is no longer valid due to the fraud your companies have committed. If you do not understand the seriousness of this letter, I suggest you reach out to your superiors. Lastly, the remedy that I have set forth in the previous letter still stands but instead of cancelling out the securities you earned from my signature and the contract, send or transfer all securities to my XXXX account. I also do not consent to your companies releasing my information to a third-party repossession company and having them attempt to steal my car from my private property ( driveway or garage ). I do not consent to anyone affiliated with Credit Acceptance or its third-party coming to my private property. Any corporation or person who violates my rights and wishes will pay the price. Consumer Complaint: My wife and I purchased a used vehicle and financed with Credit Acceptance Corporation. After 18 payments were made on the vehicle I lost my job and asked Credit Acceptance if I could let the vehicle go back to them because I could no longer afford the payment, and they agreed. The vehicle was returned to the creditor in XXXX and I recently received a court summons in XX/XX/XXXX. Amount financed for XXXX XXXX XXXX - {$21000.00} Includes an extended warranty from XXXX XXXX XXXX XXXX XXXX. Both parties elected to opt out of purchasing any and all extended warranties. These signatures show the exact same time as the signatures to follow on the bottom of page 2 on the retail contract. Time stamped electronic signatures would show a different time stamp for both signatures if this was in fact signed at the time of purchase. ( See Attached ) Extended Warranty price - {$1500.00} All parties agreed to a purchase price of {$21000.00}. 18 payments were made on the vehicle, totaling {$13000.00}, leaving a total balance of {$8800.00} plus interest charges. Market value of vehicle at time of auction was {$14000.00} - {$16000.00} Vehicle sold at auction for 50 % market value - {$7900.00} Total balance ( minus interest charges ) after auction = {$930.00}

Consumer Complaint: During the XXXX Pandemic Credit acceptance was reporting late payments on all three credit bureaus, when it was stated that creditors were not to report late payments due to XXXX XXXX hardship. I was paying XXXX every XXXX weeks on time not knowing that credit acceptance was still marking me as late. I have XXXX late payments on my account that needs to be removed to help my score increase. my score went down tremendously because of all these late payments that were not suppose to have been reported.
