Consumer Complaint: Dear Sir or Madam, I am writing to file a complaint against XXXX, XXXX, and XXXX for potential violations of the Fair Debt Collection Practices Act ( FDCPA ), specifically 12 CFR 1006.34 ( d ) and 15 USC 1681-S2 ( 7 ) ( A ). I am writing to you today because I believe that XXXX, XXXX, and XXXX have engaged in unfair and deceptive reporting practices against me. Specifically, they have continued to publish the full amount of debt owed to Credit Acceptance despite a court ruling in XXXX XXXX XXXX on [ XX/XX/2024 ] that reduced the amount owed from {$3200.00} to {$1700.00}. Evidence : A copy of the court ruling reducing the amount owed. I believe that XXXX, XXXX, and XXXX 's actions violate the FDCPA because : 12 CFR 1006.34 ( d ) : This regulation requires debt collectors to provide written validation notices to consumers within five days of the initial communication. The validation notice must include the amount of the debt, the name of the creditor, and other important information. In my case, I did not receive a revised validation notice reflecting the reduced amount owed after the court ruling. 15 USC 1681-S2 ( 7 ) ( A ) : This section of the FDCPA prohibits consumer reporting agencies from using unfair or deceptive practices to collect debts. I believe that continuing to publish the full amount owed after a court ruling reducing the debt is unfair and deceptive.

Consumer Complaint: I incepted this loan with Credit Acceptance Corp last XXXX of XXXX. I made 10 payments on time with the assurance that I would be able to refinance the loan with a cheaper interest rate. The purchase price of my XXXX XXXX XXXX XXXX was XXXX dollars. It was sold to me as original with very low miles. However, the truck is not original and has been modified and the vehicle history report does not reflect that. Also the dealer is misrepresenting 'limited warranty ' from this lender when it is in fact a very limited 'vehicle service contract '. 'Gap insurance ' was also placed onto the loan with other unknown products and the actual value of the loan is about 195 % of the purchase price. I have attempted to refinance the truck but because of the modifications and its age no other 3rd party lender will touch it. As such I am having to surrender the truck to Credit Acceptance Corp under threat, duress and coercion. Upon researching Credit Acceptance Corp I have discovered that this company has several active cases in other states, and has settled an action in the state of Massachusetts with CFPB, therefore I contacted you via this portal.

Consumer Complaint: Credit acceptance corporation and XXXX XXXX XXXX XXXX attempt to contact last time on XX/XX/24 to request original debt contract and to state that it has been over 10 years since the debt occurred and have delt with negative credit hardship for 10 years now with a repossession on credit even though the truck was supposed to be a cash sale and owned clear. Dealer ship closed and when I was incarcerated this credit company repossessed this truck illegally as the truck had been paid for and when I was released I tried to get the truck back and was told I couldn't do anything as the truck was sold at auction for the amount owed and now years later they have served a notice to seize the property and garnish my wages to my place of business.

I paid the {$2100.00} with XXXX XXXX but nothing changed, not even the amount or payment on my credit report. Now I have a judgenet against me filed 6 days later stating I owe the whole amount prior to the payment made and it claims I defaulted for failure to appear but I'm not sure what I did not appear to. Consumer Complaint: I got a car from a dealer ship buy here pay. XXXX XXXX At the dealership I was told I would pay total {$17000.00}. For a XXXX XXXX XXXX XXXX that had XXXX thousands miles on it. After several attempts to refinance my car because the payments have been hard to maintain. So I stopped trying to refinance my car. Just so I knew I checked Credit Acceptance who has the account. On that app it says that I owe {$32000.00} total. And I have {$22000.00} left to pay. Which what confuses me because I check the value of my car with the miles of at what I bought it at. They are only worth {$9500.00}. I've had to fix the starter twice. I had to maintain everything that happened to.

Under 15 USCS 1666B : A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose.
