Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Investigation took more than 30 days
Consumer Complaint: This complaint is about a company called credit acceptance I begin a loan with them back in XX/XX/XXXX and paid faithfully up until present time. However on XX/XX/XXXX I was in a car accident which was a total loss. I called the credit acceptance people and asked if I could Not pay the XX/XX/XXXX payment since they would be receiving a insurance payout they said that was fine. However now they claim that they did not say that. On XX/XX/XXXX we entered into an agreement for the remaining balance of the vehicle which is about {$6300.00} we agreed that I would pay {$300.00} on the first of each month going forward until the loan was paid off. they also said that if anytime during this time if I came up with {$2500.00} they would except that as a one time payment and clear the loan. The first {$300.00} payment was made on XX/XX/XXXX I have the canceled check the second {$300.00} payment was a little late but the check was cashed on the XXXX XXXX. It was around this time that I noticed they had reported me XXXX and 60 days late on my credit report for XXXX and XXXX. I contacted them and asked why they did this and they told me that I had missed a payment in XXXX but I told them that they told me I could skip that payment since they were getting insurance payout and that they had agreed to that, they informed me at this time that they have no record of that. So I got a written letter from them stating that my payment was {$300.00} and would be {$300.00} going forward however they would not agree to backdate it to the original date we reached the agreement of XX/XX/XXXX they would only date it for XX/XX/XXXX Just another example of them being shady. When I asked them to please fix my credit reporting they said to me thats not their job. I submitted disputes to all three credit agencies but nothing has ever came of it. Credit acceptance just tells themThats the information they have and my dispute is dead. They are the worst professional company I have ever dealt with. They act as if I made all this up after not having one missed payment in 2 and a half years. I also want to point out they where illegally charging me XXXX XXXX interest as a resident of XXXX when you can only charge someone XXXX XXXX above prime for used car loans in XXXX. I also want to point out that they have a website where you can look at your account information. I went on there and it says A bunch of inaccuracies. When I asked them about it they told me dont worry the website is always wrong. They still have the wrong payment amount on their as well.

Consumer Complaint: Credit acceptance appears to have violated the terms of the contract for an auto loan and is reporting a fraudulent balance to all credit reporting agencies. Documentation from Credit Acceptance shows conflicting information regarding the repossession costs, which results in an unconfirmed the balance on the account. In addition, the credit for GAP insurance coverage that was applied to the balance on the account appears to be in violation of the contract and Ohio law. Enclosed document - Page 1 has reference to GAP insurance, Page 2 has reference to repo costs ( which do not match costs on page 4 ), Page 2 has reference to GAP insurance credit, Page 3 has reference to sale of car at XXXX XXXX, Page 4 has reference to repo costs ( which does not match costs on page 8 ) To further investigate the fraudulent balance, I am requesting the following documentation : - Proof of sale of the repossessed automobile from XXXX XXXX XXXX. This means a document from XXXX XXXX XXXX, not a document from Credit Acceptance. - GAP contract issued by the provider for GAP insurance

Consumer Complaint: XX/XX/2019 I informed Credit Acceptance that this account did belong to me yet they delivered documents that were clearly result of identity theft as the application did not have my signature. Also requested a copy of driver license that was provided yet Credit Acceptance could not provide this as either. Credit Acceptance is continuing to inaccurately report incorrect information on to my credit file. Now I am requesting what date was such vehicle repoed and where was it repoed from. Also what remedies were used to contact me to make me aware of such. I am writing in regard to the above referenced accounts and transactions. This vehicle was repossessed by Credit Accpetance in the State of Texas on or about, a date that I am unaware of due to it was not my vehicle nor the signature on the contact is mine. However under the laws of the State of Texas UCC 9.506 and State XXXX and XXXX statutes a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. Please provide copies of the legal notices and proof of the commercially reasonable manner of the resale of the subject vehicle. If no such proof is provided within 14 days from receipt of this notice, the alleged claim of a deficiency will be considered null and void, and any continued collection activities, or continued reporting of this invalid claim on my credit reports will be considered a violation of the FDCPA and FCRA. In addition, if you singularly or severally fail to comply with the above requests, I reserve the right to seek damages against all parties, under all available State and Federal statutes and UCC - 9 remedies.

Consumer Complaint: Credit Acceptance offered me a horrible loan. This led to repossession of my car. They sent the repossession amount to a law office in XXXX, Ohio. Law office sent me paperwork allowing me to make payments on the loan. The day after I received the paperwork they started garnishing my wages before the date stated on the paperwork. Ive paid at least {$3000.00} off of the loan. This is not reflected on my credit report. Ive disputed the amount with XXXX. Credit Acceptance is reporting to XXXX that the amount on my credit report is accurate. This is not true and I have court documents stating otherwise.

Issue: Problems at the end of the loan or lease
Subissue: Unable to receive car title or other problem after the loan is paid off
Consumer Complaint: I have made multiple calls to Credit Acceptance at XXXX to obtain the release of a lien on my deceased mother 's car. She died in XXXX and I have provided them with her SSN, the letters Testamentary and my appointment as executor from the Court in XXXX. The car was paid off many years ago. My mother 's name was XXXX XXXX. XXXX, and the account number was provided by Credit Acceptance as XXXX. The company called me in XX/XX/XXXX while I was out of the country, and and said they were mailing the lien release. It did not arrive, even though they had my address. When I contacted them after the first of the year, they claimed to have mailed it to my deceased mother 's address ( the family sold the property and we do not receive mail there. ) Then On or about XX/XX/XXXX, Credit Acceptance promised to mail the item to my address in XXXX, VA. When it did not arrive by XX/XX/XXXX I contacted them again. They admitted sending it to an incomplete address in XXXX. I called them the next day and provided a fax number. They company alleged they sent the fax on XX/XX/XXXX at the end of the business day. They did not provide a confirmation number, and the fax was not received. This is causing a real hardship, because without the lien release, I can not sell my deceased mother 's car. I think this company is engaged in deceptive practices and they have been provided sufficient information to comply with my request on multiple occasions. My auctioneer who sold my mother 's personal property also had 0 success dealing with Credit Acceptance. At the time of her death my mother was XXXX and suffered from XXXX. There is no way that any person with any kind of impairment ( or even without impairment ) can get this company to provide requested information even when all the necessary information is provided.

Consumer Complaint: This particular account situation that is lately filing on my own credit document has a seriously unfavorable relation to my personal ability to obtain a present loan application. I highly recommend you generate verification that Credit Union has been reported completely in accordance with the Fair Credit Reporting Act regulations, it's really a serious problem to misreport. More confirmation of the aforesaid item too. My proper request must over, I was never 30 days/60 days/120 days late in any of my payments and I'm not greatly tuned in to the date opened so I prefer to ask you be investigated as soon as possible and confirmed to be correct. Thanks!
