Consumer Complaint: An auto loan was opened in XXXX of XXXX in the name of my XXXX father with Credit Acceptance Corp. The vehicle was totaled and Credit Acceptance sent the title to my father but it was added to his credit report and mine! They stated the balance owed was {$11000.00} and the account was closed in XXXX. XXXX XXXX I received an alert that the account was open and current. XX/XX/XXXX the account is saying open and the balance has increased by {$4600.00} on an account that was closed 5 years ago! I attempted to contact them several times over the years regarding the inaccuracies and they have refused to comply. This is causing financial duress as it has effected my credit score which is also causing undue emotional duress during a global pandemic. Credit Acceptance is predatory and unethical.

Consumer Complaint: Exactly one year ago, my husband and I purchased a vehicle and have it financed through Credit Acceptance Corporation. We have had our account with CAC set up on auto pay so that payments are automatically deducted from our bank account. We have NEVER missed ONE SINGLE payment. However, back in XXXX, upon the arrival of the COVID-19 pandemic, my husband was furloughed from his job and my work ( I am XXXX ) significantly dried up. As a result of this, we were unable to make our vehicle payments. I immediately contacted CAC and they disabled our auto pay so that no payments would come out of our bank account and they assured me that NO collection activity would occur because of this pandemic. I was told to simply call back when we were able to resume our normal payments and to set up an arrangement for any past due amount that we acquire. I requested that they simply defer the missed payments to the end of our loan, but they outright refused, which made no sense to me. Fast forward to today, XX/XX/2020, I reached back out to CAC to inform them that we are not ready to turn our automatic payments back on to resume our regular payments. I once again asked if they could defer the payment that we missed to the end of our loan and they told me that they " do not have the technology to be able to do this. '' Whatever. I had them add {$10.00} additional to each of our biweekly payments to go towards the past due. After setting our automatic payments back up, I received a response to an email that I had to CAC 's Office of the President. The individual who emailed me is XXXX XXXX XXXX, Senior Vice President and Assistant General Counsel of the CAC Regulatory Compliance department. She informed me that our credit report freeze was only good until XX/XX/XXXX, at which point we would be reported as 60 days late on our credit reports. I'm sorry, but this goes TOTALLY against the federal CARES Act, which states that lenders MAY NOT report consumers who have been impacted by the COVID-19 pandemic as late as long as their payments were current at the start of the pandemic and as long as they work out some sort of payment arrangement, WHICH WE HAVE DONE!!!!!!!!!!!! I have pointed this out to Ms. XXXX, who now absolutely refuses to respond to any of my emails. My husband and I have worked VERY hard to increase our credit scores well over 100 points over the course of this past 10-12 months and we will NOT have it completely sabotaged by these predators, who REFUSE to abide by the laws and regulations set forth by the CARES Act. We have worked FAR too hard to have our finally GOOD credit ratings destroyed by these predatory criminals, who are clearly making up their own rules as they go. We are in the process of refinancing our home and will NOT allows these scammers to ruin that for us. We are a FINANCIALLY RESPONSIBLE couple, who ALWAYS make our payments and IMMEDIATELY contacted CAC as soon as we knew that we were going to have trouble making our payments due to this pandemic. We also VERY quickly ( within about 6 weeks ) RESUMED our payments. It is COMPLETELY unfair, morally wrong, and ILLEGAL to punish hard-working, honest consumers who have been so heavily impacted by this pandemic!!! We WILL be filing a lawsuit against Credit Acceptance Corporation for any damaged that we incur by such negative credit reporting, and a copy of this complaint has also been forwarded to the Maine Attorney General 's Office of Consumer Credit Protection.

Consumer Complaint: Credit acceptance started financing my XXXX XXXX XXXX from XXXX of XXXX at 22 % APR and XXXX $ monthly payment. I have comprehensive insurance coverage on this car with a deductible. On XX/XX/XXXX, I was involved in a hit and run accident. My car was totaled. To XXXX XXXX glory I am alive even though I have taking medical treatment. By XX/XX/XXXX, Credit Acceptance received a check of {$16000.00} from the insurance, bringing the balance I owe on the car down to {$5700.00}. This balance they are required by NY State Personal Property Laws and Insurance Law to collect as Gap Credit for. They confirmed that I can Gap Insurance but refused to apply the gap insurance to the balance. Until recently, it was showing that I am owing $ XXXX on a vehicle I no longer have, they received money from insurance, and they even validated the balance ( of {$23000.00} ) as correct after I disputed the balance with the three credit bureau to be wrong. I mailed with the dispute police accident report, evidence of insurance payment and a copy of payment history ( up until the insurance payment ) indicating the payments were made to THEM CREDIT ACCEPTANCE!!!!!! Yet they lied blatantly that I still owed $ 23,000+ to the three credit bureaus. I can't get better credit ; I can't get new car! The ugliest part is that I have spoken with the supervisors severally, and they lied to me on record, that yes, they have reported to the credit bureaus the payment has been made!!! How dare them lie blatantly! The credit bureaus because they collect money from the creditors refuses to delete the balance even when there are bunch of hardcore verifiable evidences showing the payments were made. The credit bureau collects money from the creditors ( Credit Acceptance ) and accept any report they make on any of their customers even when there are overwhelming evidences indicating that their report is false. When you dispute it, they ( the credit bureaus- the cops ) ask the thief ( credit acceptance ) to update the report correctly ( return the money they stole ) instead of investigating the documents ( the video evidence showing the thief steal the money ) you sent them. The hardcore evidence is right in their face, but they refuse to amend my credit file to reflect the truth because lining up their pocket is more important than the truth!!!! After the first dispute I made with the three credit bureaus- XXXX , XXXX and XXXX , Credit Acceptance lied that the $ 23,000+ balance is correct. I disputed the account and the balance a second time with the insurance payment letter. The three credits bureau brought down the balance to {$3200.00}. I continued to call Credit Acceptance to please updated my credit report to reflect the fact that they received the insurance payment, and that they applied the New York State Gap Insurance which covers whatever my auto insurance company does not cover. They refused. I then went ahead to XXXX and XXXX to make a complaint. Few days after the complaints, a lady who skeptically says she represents credit acceptance left me a voice message with her number. To my utmost surprise, this is the first time I ever received a call from credit acceptance since this who issue started from XX/XX/XXXX of XXXX. I called the lady and she continued to spew lies and lies and deception until the call was over. In retaliation for the complaints made on the XXXX and XXXX platform, credit acceptance began making random adverse, derogatory and negative reports on my credit file with the credit bureaus. My credit score went from XXXX in XXXX to XXXX as today in less than few days ; and XXXX to XXXX in XXXX. They reported that I am owing them $ 7,000+ to XXXX and that I am 60 day late in payment from the thin blue air. I was utterly surprised when I saw that few days ago, they reported to XXXX that I am 30 day late in payment and that the balance is $ 7,000+ two days later, they updated it that I am 90 days late and {$3000.00} in balance. By tomorrow or next, they will dump the whole negative data on my experian in which I currently have XXXX credit score just to mess it up and to destroy me. On top of the pain I am going through from the accident, these heartless destiny destroyers are chasing after me, causing me unimaginable frustration and XXXX. I have barked, begged, yelled, caused to get this resolved to no avail. All these prove a deliberate, demonic and heartless series of actions by Credit Acceptance to frustrate my life and damage my credit file/life. For a perspective, log on to XXXX website and bbb.org. You will see XXXX if not XXXX of heart-wrenching complaints from average American consumers complaining about the same, worse or similar case like mine. No one is holding them accountable and it is bolstering them to continue. I don't have any derogatory data on my credit file except for what credit acceptance is dumping in it. How can I be 90 day late when I had an accident on the XXXX of XX/XX/XXXX and they received {$16000.00} from the insurance company, + the supposed NY Gap Insurance? Their staff and reps are trained to manipulate words, and phrase even legal phrases to lie successfully. So, watchout for a strange term they might coin out in reply. References for Insurance Law, NY Gap Insurance Law, NY Personal Property Law : Insurance Law 1113 ( a ) ( 26 ) New York Personal Property Law 302A ( 2 ) ( McKinney 2006 ) PLEASE AVOID CREDIT ACCEPTANCE. THEY ARE DESTROYERS. ONCE YOU ARE IN, GETTING OUT IS A BIG PROBLEM BECAUSE THEY WON'T WANT YOU TO DO SO. THEY EXPECT YOUR CREDIT TO BE EVER BAD SO YOU CAN BE STUCK WITH THEM AND THEIR RIDICULOUSLY HIGHER INTEREST RATE. ONCE YOU IMPROVE YOUR CREDIT OR WANT TO CHANGE YOUR LENDER, THEY MUST FIND ONE THING OR THE OTHER TO HOLD YOU DOWN AND EVEN USE THIRD PARTIES TO DESTROY YOU. JUST LIKE THEY DID TO ME, MY CREDIT SCORE WENT FROM XXXX TO XXXX IN LESS IN ONE WEEK. THEY KEPT ON REPORTING CONTRADICTING DATA TO MY CREDIT FILE IN DAYS APART JUST TO MAKE SURE MY CREDIT REPUTATION IS DAMAGED. STAY AWAY FROM THEM, YOU ARE WARNED!!!

Consumer Complaint: On XX/XX/2015, I purchased a used XXXX XXXX and financed the purchase via a loan from Credit Acceptance Corporation. Upon review on the loan terms, I noted that the interest rate charged by Credit Acceptance Corporation is above the usury rate for Texas, the state I purchased the vehicle in, originated the loan in, and in which I currently reside. I contacted Credit Acceptance Corporation about this issue ; however, they refuse to acknowledge the fraudulent loan or make any effort to resolve the situation. I believe Credit Acceptance Corporation and its agents have discriminated against me on the basis of race, country of origin / nationality, sexual orientation, age, and gender. Furthermore, I believe Credit Acceptance Corporation is structuring its loans in a way that constitutes unfair, deceptive, or abusive acts or practices, as the loans interest is above my state 's usury rate and is charged as an up-front fee, and therefore prepaying the loan does not result in a reduction of total interest charged. Also, Credit Acceptance Corporation violated the laws of the State of Texas by issuing this loan.

Consumer Complaint: Ok so I went to look at a XXXX XXXX XXXX that was located at XXXX XXXX in XXXX XXXX Florida, everything looked okay with the car so we went in to talk numbers, Loan time etc we got to {$7500.00} was the financed priced and my loan was for 2 years/24 months I would be making a {$250.00} a month car payment with {$2200.00} as the down payment, a few days later the check engine light came on my tire pressure sensor light has come on with the tires being at 35psi ( recommended tire pressure ) a couple weeks later another thing broke and was supposed to be under warranty, I called XXXX ( XXXX XXXX manager ) he said everything was covered on the warranty no worrys bring the car in now while my car is in his shop I get a call from him and he says its just maintenance and I would need to pay {$200.00} but he said since hes a good guy hell do it for {$100.00}, now the main thing that I have a problem with is the fact hes saying I owe him {$500.00} on top of that my car loan is now 4 years/48 months and the loan amount is for {$12000.00} dollars, how did I go from a {$7500.00} 2 year loan to a {$12000.00} loan for 4 years? It was never discussed and I would have never signed anything for a {$12000.00} loan for a {$5000.00} car. The loan was from Credit Acceptance I was also never given my financing agreement which details the terms of my loan
