Issue: Incorrect information on your report
Subissue: Account status incorrect
Consumer Complaint: I most recently spoke to a representative from credit acceptance on XX/XX/2020. She confirmed that my initial past due balance was about {$3200.00} but could not explain how it has gone up to over {$4000.00} since then even after agreeing to pay more each month to reduce that amount. My account still shows as either XXXX or XXXX depending on who's reporting and none of the payment history is consistent across the 3 major bureaus. Even if I was 180 days past due my balance at worst with late fees would be around {$2600.00}. Its likely the total balance owed is incorrect as well because of this. It almost as if there are hidden fees or interest being added that was never discussed with me because my payments are not improving the past due status and this is affecting my credit more than it should be.

Issue: Getting a loan or lease
Subissue: Problem with signing the paperwork
Consumer Complaint: In XXXX of 2017 my wife and I were purchasing a vehicle XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX. Tx XXXX. The installment agreement says XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX, Tx XXXX. The issue is that the finance company, Credit Acceptance Corporation, XXXX XXXX XXXX XXXX XXXX. XXXX, MI XXXX, and the dealer did not allow me to sign the original paperwork. I was out of town and the paperwork was pushed through without our consent and without my signatures. I complained to the Texas Attorney Generals office. The only result was that the finance company placed a computer generated contract on my account portion of their website. I noticed that the downpayment information is fraudelent. They entered a dollar amount higher than we actually put down. They refuse to acknowledge this situation. I believe they committed fraud with my application.

Consumer Complaint: I reached out to XXXX and XXXX several times via certified mail, with proof, that the Credit Acceptance account on my credit report was reporting inaccurate information ( last payment, past due balance, late payment time ). Nothing was done and they kept claiming the information was accurate. Date of last reported is later on XXXX than XXXX. Yet, the past due is lower, " date of last payment '' is wrong, Additionally, the State of New Jersey asked these type of lenders to waive late fees, defer and skip payments, as well as delaying delinquency notices. Credit Acceptance refused.

Consumer Complaint: Credit Acceptance Corporation is fraudulently resurfacing debt on my credit reports that showed as charged off for years as a now open account with late payments to purposefully lower consumer credit report and to fraudulently re-age the debt. This is obvious because the payment amount is showing as XXXX but it continually reports as late every month.

Consumer Complaint: I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. In the event you transfer this account to an attorney without providing proof of contract, and proving your claim, he/she will be immediate reported to the America Bar Association and Professional Liability Fund for code of ethics violations.
