Consumer Complaint: The car was totaled 2 years ago and my insurance paid for the car. They then tried to sell the debt to a collection company. I finally got the account closed and removed from my credit report and worked hard to build my credit back and they have now put it on bureaus again, without telling me anything. Now they are harassing me with collections threatening to hold this against me. The account shows the age but they make it look as if it is an open account and that I am just late paying, it is fraudulent and the account needs to be closed.

Issue: Getting a loan or lease
Subissue: Fraudulent loan
Consumer Complaint: On XX/XX/2016, I purchased a vehicle from XXXX XXXX in XXXX, Maryland. At the time, I went to purchase the vehicle I was ordered to sign a stack of papers, included in the papers was a warranty for the vehicle. Although, I found it strange that I was asked to sign documents for a warranty considering the car was brand new. I asked for copies of the documents I signed and was told that I would receive them the following day, when I picked up the vehicle. The following day, I received no paperwork. A few days after that I received a certified letter in the mail from the warranty company stating they were refunding the money for the warranty because the warranty was unnecessary. At that point, I begin asking for paperwork regarding my loan. It was only at a later time did I receive the loan paperwork in which stated the car I purchased was a used car. However, the vehicle was not a used car, it was a brand new car. I was the only Owner and it was fresh off of the lot. The monies refunded from the warranty company was put on the back of the loan. Although, it was incorporated in the sales price of the vehicle. The paperwork presented to me was for a new vehicle. When I finally received a copy of the paperwork, the paperwork eluded to the car being a used car. The car was not used. The loan is fraudulent. In addition, to that the bank has been utilizing ill business practices. I have tried to contact my lawyers but they have refused to take my case based upon certain factors.
