Consumer Complaint: Credit Acceptance has been violating my consumer rights under Federal law 15 US Code 1692. They have called my phone more than 10 times, I have asked them to stop and they even tried to make me pay over the phone. They have tried to make me pay an alleged debt with multiple letter and not verifying the debt is mine. Also, I let them know that the character amount is in the positive and I can not pay something that is positive.

Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: I originally sent letters to all 3 credit bureaus regarding inaccurate information I found on my report on XX/XX/21. Referencing an alledged account with credit acceptance and inquiries that were also unauthorized. The letters were all sent certified mail and verified as recieved. 3 weeks later I recieved letters from each bureau. XXXX notified that they have corrected the issue by deleting the referenced credit acceptance account from my account but have yet to remove inquiries. XXXX and XXXX have both claimed to have verified the information with the creditor as accurate. I have sent letters to both bureaus on XX/XX/21 requesting the method in which they verified those accounts and I am still waiting on response. Credit acceptance has not responded at all. I have attached a screenshot of this account on my report where you can clearly see this account has been RE-AGED by the creditor which is a clear violation of law. Obviously the processes and procedures of XXXX XXXX and Credit acceptance are all flawed and are not setup in a way to be accurate and fair to its consumers.

Issue: Struggling to pay your loan
Subissue: Loan balance remaining after the vehicle is repossessed and sold
Consumer Complaint: I have contacted the Agency about my vehicle when I first purchased it in XXXX of 2019. I told them two days after I got the vehicle the transmission went out and they informed me they were not sending the check to the dealership for the car until they fix it or exchange my vehicle. They gave me false information and still funded my account and told me I had to make the payment even though they told me my payments wasn't going to start until my car was fixed or until the dealership exchange my vehicle. I couldn't afford to pay for the vehicle and come out of pocket {$5000.00} to fix the transmission after I just put {$2100.00} down for the vehicle. I was doing really good before I got the vehicle I've always paid my bills on time and never missed a payment now my credit is suffering because of them and I can't purchase a home because of the repossession. When the vehicle gotten repossessed and sold they have submitted different balances on each credit bureau.

Consumer Complaint: I called Credit Acceptance Co asking for Calculation of Deficiency or Surplus, which I never received in the mail. Under UCC Article 9-616, a creditor who fails to provide the letter waives their rights to a deficiency. Also looking over the documents gathered from the previous report my name was entered electronically without knowing. Also how can my trade name be used when my legal name status is XXXX XXXX XXXX. The installment that is listed on my credit report is nothing more than a credit sale which means it is usually sold at auction since it was voluntarily repossessed is usually sold at auction to pay off the unpaid balance. Credit acceptance has been reporting inaccurate information and would like it to be removed from my credit report.

Consumer Complaint: I the the consumer aka the creditor have believe that i am a victim of identity fraud and have been held accountable for other false allegations. I spoke with the company about removing these alleged late car payments off of my credit file numerous times and no action has been taken place. I also spoke on a recorded conversation ( on their behalf ) and was told that I owed this debt. According to 15usc1681 this is a disclosure to the consumer ( me ) and is in fact against the law. I believe this debt falls under 15usc1681j charges for certain disclosures this contract is not signed by me the contract states that all documents are signed by me and the dealership with signature, everything is typed and electronically noted without my permission. Also even on the contract it says that the contract was wrongfully noted i have proof from the contract itself which is also considered tampering which is against the law. Lastly the contract states that I have the ability to dispute or resolve this issue. I am not a lawyer or attorney and neither am i making threats but under 15usc1679g any person who fails to comply with my request as the creditor will be held accountable.

Consumer Complaint: Credit acceptance has been reporting an account from the past as a current account. They are increasing my balance to this date every month for a vehicle I no longer have. The vehicle is at XXXX XXXX in XXXX PA XXXX. There is the phone number to validate this. The shop owner told me I can't have the vehicle because it belongs to credit acceptance. But credit acceptance is not releasing the vehicle to me!! This has been going on for years.. so here I am stuck with no vehicle. That I keep being charged for. This is illegal. If I am being charged I should have the truck!! But I can't get the truck. So which is it here. Give me the truck back if I still have an open account. They can't do both!! This is fraud. They have been found guilty years ago if fraudulent charges. Please help me here. I am also putting a picture of my report to show you my balance is being increased monthly for a vehicle that I don't have anymore that credit acceptance says I have. just call the shop yourself. They will verify all I have said in this letter. These people are crooks. This account should either be closed an placed as a charge off for a repossession or the vehicle should be returned to me immediately.

Issue: Getting a loan or lease
Subissue: Fraudulent loan
Consumer Complaint: THIS IS NOT A DUPLICATE COMPLAINT!! CREDIT ACCEPTANCE CORPORATION HAS COMMITTED CRIMINAL INDIVIDUAL ACTIONS WILLINGLY AND KNOWINGLY as pursuant to 15 usc 1611. Credit Acceptance Corporation has violated my federally protected consumer rights under 15 usc 1692 and 15 usc 1605 during a consumer credit transaction on XX/XX/XXXX for a used vehicle. I am the consumer and original creditor, and NATURAL PERSON i do not validate the alleged debt. As pursuant to 15 usc 1605a the finance charge should be the sum total of everything. In exhibit A there are three different charges, including a cash down payment. Which is also a violation of my federally protected consumer rights as pursuant to 15 usc 1605a, the finance charge doesn't include a type payable in a comparable cash transaction. Which is also clearly stated in Exhibit A, that the transaction was a consumer credit transaction. Yet there was a fraudulent loan that took place.I ask can CREDIT ACCEPTANCE CORPORATION define the term " Loan '' to me under the FDCPA? As pursuant to 15 usc 1692j a false and deceptive form was furnished in connection with alleged debt in the form of a contract, which CREDIT ACCEPTANCE CORPORATION claims is a " Loan ''. I have reached several times to correct this issue with Credit Acceptance Corporation, including asking for validation of debt and as pursuant to 15 usc 1692g Credit Acceptance Corporation has not done so. They have willingly and knowingly been non complaint and have damaged my reputation. Which is also a violation as pursuant to 15 usc 1692d ( 1 ) damaging my reputation. I have reached out to the CFPB and XXXX, Credit Acceptance Corporation has caused so much stress and pain mentally and emotionally in my life that enough is enough. Due to the attack on my reputation and inaccurate reporting, i am unable to provide for my family which is very devastating. Pursuant to 15 USC 1692c ( c ) I have notified CREDIT ACCEPTANCE CORPORATION in writing that I refuse to pay this alleged debt, and I am demanding that CREDIT ACCEPTANCE CORPORATION cease all forms of communication with me through any and all mediums. But CREDIT ACCEPTANCE CORPORATION still communicates with me indirectly about the alleged debt, through false information furnished on my consumer report which violates 15 usc 1692c ( c ). Pursuant to 15 USC 1692c ( c ) ( 2 ) I am invoking my specified remedy as a consumer, and the original creditor I am demanding all of the following : XXXX out the balance on this account. Return all payments made on account as pursuant to 15 usc 1692h. Pay total cost of consumer credit transaction including down payment. Pay the attached invoice and compensate me for every violation labeled in the attached exhibits. Deletion from all consumer reports. I will also be mailing the copies of AFFIDAVIT, CEASE AND DESIST, DEBT VALIDATION, INVOICE to the Attorney General. These documents were also certified sent to Credit Acceptance Corporation XX/XX/XXXX.
