Consumer Complaint: The company. Credit Acceptance doesnt have a charter, functioning illegally and unlawfully. There is no original contact with my or my son, XXXX XXXX, autograph signature. Therefore Credit acceptances representatives collected payment under fraudulent actions. The alleged debt was disputed through notarized letter XX/XX/2021 and sent certified mail, return receipt XX/XX/2021. The company did not prove the alleged debt by satisfying our request for proof. Violation of The Fair Debt Collections Practices Act. The company proceeded on XX/XX/2021 to seize property & through coercion forced XXXX XXXX, secured party to immediately pay to have property released an back to him causing disruption and distress to his livelihood. I filed a complaint to you on XXXX XXXX, undersigneds behalf at the end of XXXX with XXXX XXXX as Additional Point of Contact which is on your website contained in the full complaint # XXXX, STEP 5 ; The companys response was sent to my email and continuously I attempted to open it to no avail. I emailed you, spoke to XXXX, XXXX and Ms.XXXX who the latter two said I am not authorized because my name is not on the complaint. I have print out proof as me being authorized. So your error has prolonged this problem & Credit Acceptance has continue to move forward in fraudulent actions. I have reached out to legal support.

Consumer Complaint: I have faxed in information proving I have made my car payments. XXXX XXXX directly faxed this information to credit acceptance. XXXX XXXX has confirmed payments were made, payments were not returned back into my account. Credit acceptance verified they received this information, but is now asking for more information and bank statements for months I have made payments. What does this have to do with the payments they are claiming I didnt make? They are claiming my payments from XXXX and XXXX were returned in XXXX which makes no sense. XXXX XXXX verified this did not happen. XXXX XXXX verified these payments were made and proof was sent to credit acceptance. They are refusing to update my account to reflect this information. They are reporting my account is not in good standing. This is affecting my credit AND I had to make a payment to stop a repossession on my vehicle! This is ridiculous and it needs to stop!

Consumer Complaint: I am writing with regard to three late payments reported in XXXX, XXXX and XXXX of XXXX. I lost my job at XXXX XXXX XXXX in due to COVID-19. As a result, I missed my XXXX payment. I continued to make one payment as I could monthly, but because of the first missed payment, it shows that I continued to be behind one payment. A payment was made on XX/XX/XXXX ( {$330.00} ), XX/XX/XXXX, ( {$330.00} ), XX/XX/XXXX ( {$330.00} ), XX/XX/XXXX ( {$330.00} ), and XX/XX/XXXX XXXX {$330.00} ). I contacted Credit Acceptance shortly after I lost my job to inquire about payment options due to COVID, and I was told and received a notification that payments would still be due and that nothing could be done. I called again, explaining everything above, and was told by a male representative that I should dispute the missing payment with the credit bureaus. I did so, and the dispute was denied. I called again after this on XX/XX/XXXX, and was told by a representative that my account was placed under the COVID protected status, and that she did not understand why the payments were reporting late because of the status. I have done my research, and have found that many customers are being affected by the late payments being reported while in the COVID protected status. The late payments, reporting with all 3 bureaus, have caused my credit score to drop severely. I have been able to get a better job with a new company, and have been able to get back on track with my auto loan payments. I am in the process of purchasing a new home for myself and my two children, and it has come to my attention that the late marks prevent me from taking full advantage of the best interest rates available. I am requesting that you please give me a second chance at a positive credit rating by revising the late payments. I sincerely hope that there is redemption at Credit Acceptance, and I plead for such consideration.

When I purchased my automobile, a CONSUMER CREDIT TRANSACTION took place, which means, CREDIT ACCEPTANCE CORPORATION didnt loan me anything. I refuse to pay this alleged debt and what CREDIT ACCEPTANCE CORPORATION is doing is illegal. Theyre stealing my identity and half XXXX honoring my XXXX XXXX XXXXXXXX letter. It doesnt work like that! What did you guys loan me? Show me CREDIT ACCEPTANCE CORPORATION account proving it! According to Federal law 15 USC 1605 Determination of finance charge is defined : Except as otherwise provided in this section, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended, and imposed directly or indirectly by the creditor as an incident to the extension of credit. The finance charge does not include charges of a type payable in a comparable cash transaction. The finance charge shall not include fees and amounts imposed by third party closing agents ( including settlement agents, attorneys, and escrow and title companies ) if the creditor does not require the imposition of the charges or the services provided and does not retain the charges. Examples of charges which are included in the finance charge include any of the following types of charges which are applicable : ( 1 ) Interest, time price differential, and any amount payable under a point, discount, or other system or additional charges. Specifically, an event was placed on your account that stopped all telephone and written communication with you. As a result, we have not called or sent you a letter since XX/XX/. However, your cease and desist letter does not prevent Credit Acceptance from accurately reporting your account information to the credit bureaus. Thats INDIRECT communication and IDENTITY THEFT. Did I give CREDIT ACCEPTANCE CORPORATION my consent to report something? CREDIT ACCEPTANCE CORPORATION constantly using profane language against my consumer report and accusing me of owing them something they NEVER gave me. Again, PROVE it! They want me to " pay '' but can't prove anything. I did not give CREDIT ACCEPTANCE CORPORATION my consent create an alleged account with my information or report any XXXX thing to my consumer report! Theyre ruining my reputation, causing emotional distress, and defamation of my character. CREDIT ACCEPTANCE CORPORATION is refusing to settle this and admit what theyre doing is wrong and unacceptable. Even the fraudulent behavior shows in the contract, which dont mean anything, because it was NULL AND VOIDED the moment fraud was discovered. I am attempting to get this matter settled before I file a Suit in Federal court. We all know CREDIT ACCEPTANCE CORPORATION do not have a leg to stand on in court. Furthermore, I have completed the administrative process with proof showing Ive tried to solve this matter prior to taking it to court. This is the last chance CREDIT ACCEPTANCE CORPORATION have to resolve things. CREDIT ACCEPTANCE CORPORATION NEVER rebutted any of my Affidavits so it stands. If Im lying, show me what you loaned me! That contract don't mean anything on CREDIT ACCEPTANCE CORPORATION behalf but it do show I paid my automobile with my XXXX XXXX. Now show me a LAW that says I have to pay this alleged debt. This is a FINAL ATTEMPT : If CREDIT ACCEPTANCE CORPORATION do not honor what I am asking for, there will be consequences. I am demanding Cease all communication INDIRECTLY regarding my consumer report, mail my title to me, refund all my previous payments in a form of a check, and monetary compensation for the injuries you've caused.
