Consumer Complaint: In XXXX of 2019, I purchased my own vehicle from XXXX XXXX XXXX XXXX in XXXX, CA and conducted business with XXXX XXXX XXXX and his wife XXXX XXXX ( Owners ). All went well and I left with my car. In XXXX of 2019, I referred my daughter 's father to the same car lot for his own car purchase, in a good faith attempt to return business to what I thought to be a solid car lot as appreciation for my own smooth car purchase. Later in the month, I get an alert that my name had been added on to a joint car loan agreement for the purchase of my daughter 's father 's car as a co-signor. I attempted to contact XXXX XXXX and his wife to inquire as to why my name had been added on to the agreement, as I was not present for the purchase of his vehicle nor was I a party to his loan agreement. My only involvement in anything having to do with that situation was the simple verbal referral I had provided to my daughter 's father and his mother prior to their purchase of his vehicle. Upon trying to contact XXXX and his wife, I was met with aggressive and threatening messages telling me that I am not involved in the purchase of the agreement and that I am harassing them with my inquiries. My inquiries were only regarding seeking an answer as to why my name had been added to the purchase agreement/loan for his car when I did not authorize my consent to be added on as a co-signor to any car loan other than my own. From that point on, I was not contacted by anyone again after numerous phone calls to speak with someone about having my name taken off the car loan agreement that I never agreed to be added to. Other than in XXXX of 2019 when I purchased my own vehicle, I had not been back to that lot for anything whatsoever and should never have had my name added on to a financial agreement without being physically present for any transactions involving money or without physically providing my signature with the car salesman as a third party witness. I was never present for any business agreements or financial arrangements or even the overall purchase of the vehicle that I was added on as a co-signor for. My attempts to contact the car lot went unsuccessful and I found out shortly after that that the car lot had been shut down for multiple lawsuits involving other consumers suing for bad/fraudulent business practices and breech of contract. When I contact the loan originator for the vehicle ( CREDIT ACCEPTANCE CORPORATION ) to request being removed from the fraudulent loan agreement they claim that they have a signed document that consented for the car lot who submitted the car paperwork at the time of purchase that authorized their use of my " ELECTRONIC SIGNATURE '' which I never signed for this car loan. If there is a signature there, it was added fraudulently by XXXX XXXX and his wife at the time of the purchase for this car, as I was not present for any dealings with this car agreement. I have requested they furnish a copy of this agreement to me multiple times with no correspondence and no copy of the document substantiating my agreement to this loan and refuse to remove me from the agreement. I have contacted the credit bureaus and provided my identity theft reports and had the line item removed from my report for all but 1 reporting agency who I am in dispute with now. I just want my name removed from this account as I never agreed nor authorized anyone from either company to use my signature to be added on as a co-signor or joint account. XXXX XXXX XXXX, XXXX is no longer an operating business as they were shut down and forced to close due to multiple lawsuits involving bad business/fraudulent business practices. Credit Acceptance Corporation refuses to work with me and remove my name from this loan after numerous attempts to contact their fraud/complaint department and provide information regarding this fraudulent loan XXXX Credit Bureau hasn't removed this account from my credit report after numerous disputes providing substantiating evidence and documentation of the issue and proof that the account does not belong to me.

Consumer Complaint: CREDIT ACCEPTANCE CORPORATION keeps marking my complaints as duplicate because what they're doing is committing fraud and unfair practices. I will keep filing a complaint until my lawsuit is processed. Let the record show, I do not care about an " arbitration clause '' because I've tried solving this matter before Federal court. Now, XX/XX/2021 I spoke with the legal assistant XXXX from CREDIT ACCEPTANCE CORPORATION, which is a violation pursuant to 15 USC 1692e false and misleading but okay. I informed her that CREDIT ACCEPTANCE CORPORATION did not provide any forms nor disclose I had 3 days to rescind the signature or contract. Since CREDIT ACCEPTANCE CORPORATION did not disclose this, the time frame went from 3 days to 3 YEARS! I inform XXXX from CREDIT ACCEPTANCE CORPORATION that my automobile was paid in full, by my Credit Card pursuant to 15 USC 1602 ( l ), before leaving the car lot via a CONSUMER CREDIT TRANSACTION pursuant to 15 USC 1605. I also asked XXXX from CREDIT ACCEPTANCE CORPORATION if the call was being recorded, which she stated yes, and I read out loud to her the Federal law that states a CONSUMER CREDIT TRANSACTION took place. I read XXXX from CREDIT ACCEPTANCE CORPORATION the Federal law 15 USC 1635 that states 3 days to 3 years notice of rescission if forms was not disclosed. I told XXXX from CREDIT ACCEPTANCE CORPORATION I emailed my notice of rescission to XXXX and XXXX stated she, XXXX, will look at the documentation in XXXX email. That sounds skeptical but okay. I inform XXXX from CREDIT ACCEPTANCE CORPORATION on XX/XX/2021, I mailed CREDIT ACCEPTANCE CORPORATION a Bill of Exchange which they received XX/XX/XXXX, XXXX CREDIT ACCEPTANCE CORPORATION had a time frame to send it back but did not so they accepted it. I have green return slip, as well as a copy of the Bill of Exchange. XXXX XXXX stated they did not accept it but CREDIT ACCEPTANCE CORPORATION did not mail my Bill of Exchange back. Also, according to UCC 3-603 TENDER OF PAYMENT ( b ) If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, there is discharge, to the extent of the amount of the tender, of the obligation of the indorser or accommodation party having a right or recourse with respect to the obligation to which the tender relates. XXXX XXXX stated, Credit Acceptance provided you with the ability to purchase a vehicle that you may not have otherwise been able to afford. In exchange for Credit Acceptance helping you purchase this vehicle, you have a contractual responsibility to make payments to Credit Acceptance towards your account balance. I didnt fill out a loan application, it was a CREDIT application. According to the contract it clearly states, FINANCE CHARGE The dollar amount the credit will cost you. Not to mention, the Security states, You are giving a security interest in the Vehicle being PURCHASED. So what ability or loan did CREDIT ACCEPTANCE CORPORATION give? How would I not be able to afford a vehicle when Im the one extending credit pursuant to 15 USC 1602 ( g )? Since CREDIT ACCEPTANCE CORPORATION claim I did not pay anything then this alleged debt do not exist. I informed XXXX from CREDIT ACCEPTANCE CORPORATION of the emotional distress, identity theft, and defamation of my character CREDIT ACCEPTANCE CORPORATION are doing. I stated I will not pay this alleged debt and informed her I will be filing a Suit into Federal court if this matter does not get resolved soon as possible. CREDIT ACCEPTANCE CORPORATION is continuing to cause harm, damages, and injuries to my consumer report and life. XXXX admitted repeatedly that CREDIT ACCEPTANCE CORPORATION will continue to report inaccurate information to my consumer report without my consent. Ive sent CREDIT ACCEPTANCE CORPORATION two cease and desist which they ignored by still indirectly communicating with reporting agency regarding my consumer report. CREDIT ACCEPTANCE CORPORATION are doing unfair practices and stealing my identity pretending to be me. I dont care what any of the employees say, they cant speak for a dead corporation. I am enforcing my right as a consumer and natural person, pursuant to 15 USC 1692a ( 3 ), CREDIT ACCEPTANCE CORPORATION remove my private information from every consumer report agency, mail my car title, return my previous payments pursuant to 15 USC 1692h, and monetary relief for the injuries and damages. I will not stop until I get my remedy. CREDIT ACCEPTANCE CORPORATION claim they honored my cease & desist but have yet to do so entirely. Yes, I made payments because I wasnt aware of my rights as a consumer so I am enforcing them now. Otherwise, redirect any positive balances in excess of {$1.00} to I, the Federally protected consumer in fact. At this point, it is harassment and unfair practices. I have been severely injured, emotionally distressed, damaged and I will be heard.

I'm am currently in the process of purchasing a home and they are also going to pay the vehicle off as to why I haven't paid my current balance of XXXX but both stated that it still isn't 30 days late because my due date is on XX/XX/XXXX and it's only 7 days late due to being paid off when I close on my home. I asked for something in writing just to inform my mortgage company that this was an error and they stated that they were not able to put anything in writing because they don't have the proper format to write a letter and that I would have to dispute it. Another thing, this was an illegal repossession followed by illegally reporting on my credit report ; this should have been investigated and corrected immediately. I tried contacting XXXX and XXXX Credit Bureau requesting a complete payment history with this account for me to review the exact date on which the late payments and repossession were posted. Consumer Complaint: Bad Warranty Car Vehicle was bought /signed for the amount of {$8300.00} from used car lot. My name was copied and pasted unto more paperwork stating that I would pay back double that amount. No way would I have signed for that. Within 1 month of purchasing the vehicle the car started acting funny. I took it back to the place and the one who sold me the vehicle no longer worked there. I do know " Lemon Law. '' The North Carolina Lemon Law, also known as the New Motor Vehicles Warranties Act ( N.C.G.S. It requires manufacturers to repair defects that affect the use, value, or safety of a new motor vehicle within the first 24 months or XXXX miles ( whichever comes first ). I was told that the car was sold " AS IS '' but I asked them where was the paperwork saying " As Is ''. I called Credit Acceptance and they said they couldn't do anything about the issue as well. 5 months down the line, the vehicle gave out at work. The car wouldn't start, the wheel wouldn't turn and also the wheel locked up. I called Credit Acceptance right than and there. As you look at my paperwork, how my name is signed, that's not my handwriting. Back in 2016, Credit Acceptance went through XXXX of lawsuit loans. Meaning their loans were bad. Credit Acceptance didn't tell the truth to the investors when loans were given out.
