Consumer Complaint: XX/XX/2020. I entered XXXX XXXX I extended them via my SSN card, expecting a consumer credit transaction. ( You entered me in a empty and fraudulent alleged contract ) In turn my contract was filled with Truth In Lending Act Violations. See labeled violations 1. 15 USC 1602 wording like US and We isnt defined in Truth In Lending. The wording is intentionally deceitful and misleading in an attempt to confuse me as the original creditor. Also is an attempt to mislead me into thinking Im the debtor. 2. 15 USC 1605 Determination of a Finance charge clearly states the finance charge does not include charges of a type payable in comparable transaction, meaning there is never to be cash need or accepted in a consumer credit transaction items # 2 # 5 # 6 show I put {$1500.00} in cash in the transaction. Also # 4 shows I make monthly payments on a loan from Credit Acceptance Title 15 Chapter 41 does not define a loan I have no idea what that is. Im came in for a consumer credit transaction there is to be no cash involved. 3. 15 USC 1605 Determination of finance charge, also states the finance charge is the sum of all charges. So why wasnt my on insurance ( XXXX, XXXX XXXX etc ) including in my finance charge. Total payments # 3 show cash given out amount, but the finance show lower amount which is the sum of all charges right?. 4. 15 USC 1635 Right of rescission as to certain transactions, say the creditor shall clearly and conspicuously disclose, in accordance with regulations of the Bureau, any obligor in a transaction subject to this section the rights of the obligor in under this section I was never given disclosed of my right see attachments

Consumer Complaint: On XX/XX/2021 I, consumer XXXX XXXX certified mailed Credit Acceptance CEO- XXXX XXXX an Affidavit of Truth along with a Cease and Desist letter informing them of the many violations against me. Credit Acceptance received each letter on XX/XX/2021. In the Affidavit of Truth letter I informed Credit Acceptance of the violations against me the consumer. Inside of my Cease and Desist letter, I informed Credit Acceptance that I'm now exercising my right of rescission, and I will retain possession of the property. Pursuant to 15 USC 1635 : When and obligor exercises his right to rescind under subsection ( a ), he is not liable for any finance or other charges, and any security interest given by the obligor, including any such interest arising by operation of law, becomes void upon such a rescission. Within 20 days after receipt of a notice of recession, the creditor shall return to the obligor any money or property given as earnest money, down payment, or otherwise, and shall take any action necessary or appropriate to reflect the termination of any security interest created under the transaction. Within 20 days after receipt of this notice of rescission by federal law, you are required to return all money to me ( amount included in the Bill of Particulars ), and you shall take any action necessary to reflect the termination of any security interest created under our credit transaction. Credit Acceptance did not disclose my right of rescission which is a violation of 15 USC 1635. Pursuant to 15 USC 1640, any creditor who fails to comply with any requirement imposed under section 1635 of this title, with respect to any person is liable to such person, ( 15 USC 1640 ( a ) ( 2 ) ( A ) ( i ) ) in the case of an action twice the amount of any finance charge in connection with the transaction Pursuant to 12 CFR 226.15 ( a ) and 12 CFR 226.15 ( d ) I've informed Credit Acceptance of their violations by certified mail delivered on XX/XX/2021.

Consumer Complaint: The account was paid in full last year XX/XX/XXXX and the company representative stated I owe $ XXXX.So I asked why she indicating I owe that amount, she stated it was the copay from my insurance company. So I called XXXX ( my insurance ) to send me the proof of the check and my amount of {$250.00} was included since it was filed on uninsurance motorist because the driver left the scene and the car was totaled out that's why my deductible was only {$250.00} and it was included with the payment. So I had to sign my car over to XXXX so the company could be paid. So XXXX now owns the car However afterward when I reach out to the company they indicated that I owe {$240.00} ( XX/XX/XXXX ). Then just two monthsXXXX ago I was told to pay {$100.00}. This is fraud by indicating I'm behind on a car that was paid off a year ago and I also file with OCCC because they are making false and fraudulent claims on all three of my credit reports and I have submitted documents. The inquiry was removed then later it was put back on all three of my credit reports ( late payments ) This is an unfair allegation. This is a predatory lending company ( This company is fraud and adding usurious interest to a car loan that's been paid in full!!!!!

XXXX took it off my credit report by the XXXX of XXXX. I check my credit report again and it's back on my credit report by Credit Acceptance which I paid off through a collection Agency. I am trying to clean my credit to be able to someday purchase a new home or another car. Any assistance from the CFPB is appreciated.

Consumer Complaint: Credit Acceptance XXXX and tin used to financially abuse my credit report by constantly putting on and taking off late payments that were made in compliance with the change of payment date from the XXXX to the XXXX during the pandemic. Within the past 30 days they have made six changes to my credit report as my loan officer has been documenting everything like I have. They have recently blocked my account balance from being shown after they lied to the credit bureau that my balance was over {$2900.00}. I can not speak to this company because their representatives are uneducated disrespectful southern customer service representatives that are trained in collections not customer service. My Exhusband is responsible for this account, I paid two months out of my own money and instead of updating the balance they reported the balance almost twice as much to the credit bureaus. They know exactly what theyre doing it is one lady that handles this account and I would like to know her legal name. Consumer finance needs to investigate this company to the very end.

The creditor filed a claim in XXXX county civil court and my salary was garnished. I went to court and had the interest vacated and the account was settled and removed from my credit report per the decision of the judge. Consumer Complaint: I was looking through my report and noticed a vehicle that I returned to the dealership where it's reporting completely incorrect. I had the opportunity to talk to several lawmakers and friends, and learned some basic laws in regards to voluntary or repossession of a vehicle. Under the laws of MASS and UCC 9.506 as well as State RISA and MVISA statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. PLEASE HAVE THEM IMMEDIATELY REMOVE

Consumer Complaint: On XX/XX/2021 I paid my regular monthly payment of {$370.00} which was due XX/XX/XXXX, XXXX Credit Acceptance reported this payment to the credit bureaus as 30 days late. That information they are reporting is false. That payment I made on XX/XX/2021 was only 19 days late, not 30. I called them several times to get them to remove the derogatory remark from my credit report. As a result of this false 30 day late payment entry on my credit reports, my credit scores dropped 40 points. I have worked really hard to keep my finances in order and this is too much to handle. I sent them a certified letter requesting validation that they have competent evidence that they received my XX/XX/2021 payment 30 days late. They claimed that I have {$50.00} in late charges and they reported the late charges as 30 days late. This is a blatant and total violation of the agreement which I signed. Only contracted payments in the amount of {$370.00} should be considered 30 days late if they are paid 30 days from the due date, not late fees. A late fee in the amount of {$37.00} is NOT a contracted monthly payment. I demand that this false 30 day late payment be deleted from all 3 credit reporting agencies immediately, in accordance to the Fair Credit Reporting Act and the Fair Dept Collection Practices Act.
