Consumer Complaint: This is a complaint against Credit Acceptance Corp. This complaint will outline several federal violations made by the financial institution. 1 ) violation 15usc6802 ( b ) of the FCRA : A financial institution may not disclose nonpublic personal information to a non-affiliated third party unless ( A ) Such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) The consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) The consumer is given an explanation of how the consumer can exercise that nondisclosure option. 2 ) Violation of The Gramm-Leach-Bliley Act 3 ) Violation 15usc6802 ( b ) ( 1 ) of FCRA : A financial institution may not disclose nonpublic personal information to a non-affiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ( B ) The consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party. 4 ) Violation 15usc6802 of the FCRA : Obligations with respect to disclosures of personal information. Consumer Complaint: In XX/XX/2019 A car loan for {$19000.00} was taken out in my name fraudulently ( wasnt me or nor did I give anyone permission to do so ) with Credit Acceptance Corporation ( Loan Account # XXXX ). During the time this loan was taken out I was incarcerated ( see attached ) there is no way I would of able to take out this loan. Ive submitted a police report, identity theft report, jail release papers, and commitment paper to show I was incarcerated.

Consumer Complaint: In 2018 I had my truck towed in to shop for repair ( XXXX XXXX ) during this time I lost my job and called credit acceptance to ask if they could work with me while I find work.. they was very nasty and said that they needed to pick the truck up on repo... I told they that I surrender the truck and where the truck was located, which they knew because the truck had a tracking system on it ... they call me a year later asking for truck I replied you said you was picking it up, far as I know they did pick it up at some point. However they send me letters every month asking for balance that was remaining on truck in XX/XX/2018, they report in to credit agencies every month that I'm late and passed due... I tried taking with the credit reporting agency and credit acceptance about this, however you can't talk to credit acceptance they are not nice at all and credit agencies will not truly investigate and fix the reporting errors .... I paid and still pay credit repair company but they same to get same response .... I done research a this is an ongoing problem with credit acceptance... aswell as credit agencies allowing this type things to happen over and over by same company... .this has be going on for 4 years, haven't had that truck that long and it still being reported as if I have it and late pay every month... that fraud within itself ....

And according to 15 USC 1692h- they violated your rights when they told you that a down payment was required. Redirect all past payments. 15 USC 1662d ( 2 ) - the advertising of a down payment is illegal. 15 USC 1635, 12 CFR 1026.23 & 12 CFR 226.23 is how you rescind transactions!
