They sent my voucher book to the wrong address in XXXX. Charged me {$25.00} late fee. During the pandemic promised to freeze the late fees but called every week on sunday and harrassed. Until I told them When I bought the car I was rushed by the sales man and nothing was mentuoned about the high interest fee. borrowers were subject to hidden finance charges because of which the companys loans exceeded the usury rate ceiling of 21 %. Credit Acceptance violated state consumer protection and debt collection laws and regulations. It was alleged that Credit Acceptance made unfair and deceptive auto loans to thousands of consumers in NY, provided investors with false or misleading information regarding auto securities they offered, and engaged in unfair debt-collection practices.Healey said in a statement, Thousands of NY consumers, many of them first-time car buyers, put their faith in CAC to help them with an auto loan, but were instead lured into high-cost loans, fell deeper in debt, and even lost their vehicles.Per this lawsuit, since XXXX, Credit Acceptance failed to inform investors that the pools of loans that were packaged and securitized were topped off with higher-risk loans despite claiming otherwise to investors.

Consumer Complaint: Affidavit of Truth There is abundant evidence that Credit Acceptance uses abusive, deceptive, and unfair debt collection practices in an effort to destroy the emotional and mental health of a consumer. Furthermore through your abusive efforts and immoral intent, you trick possible creditors with reporting tactics to consumer reporting agencies. Tarnishing a natural person/consumer character, making them seem as if they lack credit worthiness and character. Pursuing 15 USC 1602 the term credit means the rate granted by a creditor to a debtor to defer payment or debt or to incur debt and defer its payment. Credit is a right, like the right to bear arms. Credit acceptance with your extortionate, false and misleading debt collection practices I can and will prove that your main intent is to punish me for nonpayment, because I was able to expose consumer violations the following : Truth in Lending violations, Fair Credit Reporting Act Fair Debt Collection Practices Act and Title 18 Chapter 41 Extortion and Threats. Over the past year credit acceptance, you managed to re-aged my consumer report 4-5 different times in an effort to report negative, false misleading information over a longer period of time. Credit Acceptance notified me in writing, that my payment of {$1100.00}, to retrieve my vehicle after the XXXX repo in XX/XX/2022, automatically reinstated my contract. Meaning, re-aged my consumer report for further negative abusive and extortionate purposes. Your purpose was to punish men for none payment after I exposed XXXX violations found in your installments contract. I have documentary evidence to prove that all. Credit Acceptance your extortionate intent was clear to start. You intentionally ignored Fair Credit Reporting Act directives. 15 USC 1681c ( c ) Requirements relating to information contained in consumer reports, clearly and adequately acknowledges a 180-day expiration period on reporting of delinquent accounts. My consumer report reads as follows, 30 days late 5 times, 60 days 1 time, 90 late days 5 times, thats a total of 660 days! For an additional, 480 extra days Credit Acceptance was committed to the following, negatively effecting 'my right to credit, destroying my credit worthiness, arrogantly refusing to address my injuries by them, bully me, the consumer/natural person, invade my privacy and demand payments after financing extortionate extensions of credit. The only way to do that was re-age my consumer report, pursuant 15 U.S.C 1681s-2 ( 5 ) ( A ) Responsibilities of furnishers of information to consumer reporting agencies a person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. A person who furnishes information to a consumer reporting agency regarding a delinquent account being placed for collection, charged to profit or loss, or subjected to any familiar action, shall not later than 90 days after furnishing the information, notify the agency of the date of delinquency on the account, which shall be the month and year of the commencement of the delinquency on that immediately preceded the action, pursuant 15 U.S.C 1681s-2 ( 5 ) ( A ). Credit Acceptance I demand my right to rescind this transaction, I notified you of my right to do so over 60 days ago. After notification of my right to rescind this transaction, pursuant 15 U.S.C. 1635 Right of rescission as to certain transactions, you responded with letterhead saying you refused to rescind the transaction without explanation as to why? By refusing my right ; request you violated federal consumer by not doing and not clearly conspicuously disclosing my right in our initial communication. I immediately respond with proof that Credit Acceptance is in the business of Financing extortionate extensions of credit, with this affidavit I have also proven your collection practices are extortionate also, pursuant the following 18 U.S.C. 893 Financing extortionate extensions of credit, 18 U.S.C. 894 Collection of extensions of credit by extortionate means and 18 U.S.C. 1341 Frauds and swindles. I have notified the Consumer Financial Protection Bureau, XXXX XXXX XXXX Fair Trade Commission. XXXX XXXX

Issue: Communication tactics
Subissue: Frequent or repeated calls
Consumer Complaint: Almost everyday from XX/XX/2022 Credit Acceptance has called 4 or more times a day. It doesn't matter if I communicate with them at all. The calls will keep coming until XXXX my time. I have no problem if a debt collector makes one or two calls. That would be reasonable. I have told them that the frequency they call at this point feels like harassment as it doesn't matter if I talk to them in the morning and they know I can't pay then. They will just keep calling. When confronting them about it they will just tell you to write a letter and hang up. XX/XX/2022 as an example between XXXX they called 4 times. If you think blocking the number could give you some temp relief, you would be wrong as they have several other numbers to call from. I work 12 hour days from XXXX. The lien I have for the car is past due as they made aware every single day except Sunday. I have made payments and still making payments to catch myself up. It's not like I'm 90 days past due or haven't been submitting any type of payments at all.

Consumer Complaint: I am a consumer, a Federally protected Consumer and my name is XXXX XXXX. I am exercising my consumer rights and I am informing you that Credit Acceptance Corporation is violating my consumer laws. On XX/XX/2022, I sent a letter to Credit Acceptance Corporation and this ILLEGAL REPO of my vehicle. Reading the FCRA, Pursuant to 15 USC 1692e ( 4 ) - Foreclosures, Repossessions, Wage garnishment, or arrests are all illegal in the collection of any debts. This is similar to the 4th amendment. This is a Direct violation of 15 U.S.Code 1692e ( 4 ) and it's fraud and illegal in the collection of any debts. They are in violation of 1692d ( 4 ) - advertisement for sale of any debt to coerce payment of the debt. ( debt parking ) .Credit Acceptance Corporation is basically debt parking this account on my credit report and that is illegal. The advertisement or publication of a sale or selling of any debt to coerce payment is also known as debt parking in accordance with findings from the FTC. Once this illegal repo was taken place, I was suppose to receive some documents. The documents that I was suppose to receive was the Contract before the sale, Deficiency Documents, Redemption Documents, and Finance Documents. Also, I never received a response from the letter that I sent in on XX/XX/2022. What they are doing is unfair and it is illegal. Please protect my consumer rights.
