Consumer Complaint: I had autopay set up on my account with my Bussiness XXXX XXXX and credit acceptance new policy said it no longer take Bussiness card payments of XX/XX/2020 which I wasnt aware of so there for my payments wasnt being made I called in XXXX to pay the account in full and still wasnt told my Payments was late or anything I recently check my credit report and sees they put I missed 6 months of payments back to back which was false I try contacting them serval times finally spoke to someone who said just fill out the dispute form and put covoid 19 and we will remove the late payments lies lies lies my account is paided in full XXXX XXXX years early and they wasnt please and not tryna make me pay by reporting it to all three credit bureaus which is not my fault at all i tryed working with them and all still nothing Smh

Consumer Complaint: WITHOUT PREJUDICE Before any financial institution reports any of my information there are proper conditions and procedures that first MUST be met by law before they do any reporting. Any contract I had with Credit Acceptance XXXX is now Null and Void due to the facts they failed to provide the following disclosures during the initial communication, and failed to explain how I can exercise my rights as the consumer to opt out of the unfair reporting and collection activities. I know I am entitled to the right to privacy which means I have the RIGHT to opt out of any of my information being reported to any and all non affiliated third party agencies, due to the fact every financial institution has the obligation to respect the privacy of it's customers and to protect the security and the confidentiality of those customers non personal public information. Also, to protect from unauthorized access or use of such records or information which could result in harm, or inconvenience to any customer. ( This includes primarily XXXX, XXXX & XXXX, plus all the other consumer reporting agencies collecting my information ) Now, this is NOT an option given by Congress under the Privacy Obligation Policy 15 usc 6801 & 15 usc 6802 b ( a, b, & c ). Here are the violations that have caused me to suffer unfair and inaccurate reporting on my consumer reports/files. Violation 1. 15 usc 6802 B ( a ) clearly and conspicuously disclose to the consumer in writing that they are going to report any information. Violation 2. 15 usc 6802 B ( b ) the consumer must be given disclosure that there is opportunity before the reporting begins to not have that information reported. Violation 3. 15 usc 6802 B ( c ) the consumer must be given an explanation on how to exercise the right to the non disclosure option. I have contacted them sending letters about these grave errors and other unfair collection activities demanding they cease collection attempts, meanwhile nothing has been peacefully resolved as they continue to violate my consumer rights and fail to acknowledge my written consent to stop furnishing inaccurate information that is not permissible. I know that if they have any reason to believe that any information being reported is not accurate, they must Delete and Block any further reporting pursuant 15 usc 1692g ( c ) and that they also must have my consent in writing to report or delete anything ( 15 usc 1681b ( a 2 ) and I only gave them permission to cease.

Issue: Struggling to pay your loan

Consumer Complaint: Credit Acceptance sent me a tax form stating the auto loan was forgiven and it was mandatory to file the form with my taxes. Now I am seeing the debt of the loan being re-aged and reappearing on my credit. Since the loan was cleared as a gift for the forgiveness of repayment it must be deleted from all credit bureaus reporting on my credit immediately and stop reporting it as re-aged. The loan was taken in 2014 and has been over 7 years of it reporting. Why is the loan still on my credit being re-aged? Other auto companies are running my credit and finding the repossession still reporting.

Consumer Complaint: I was just denied an extension of credit because of SEVERAL inaccurately furnished late payments by CREDIT ACCEPTANCE. These inaccurately furnished late payments are an invasion of my right to privacy and is causing me severe XXXX and extreme XXXX. XXXX has made it clear that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. Credit Acceptances failure to maintain the integrity of my nonpublic information has caused me substantial harm and inconvenience to my financial reputation due to this fraudulently furnished late payment without my lawful authority. XXXX has also stated that unfair credit reporting undermines public confidence, which XXXX has made clear, is essential to the continued functioning of the banking system. Credit Acceptance is reporting my transactions and experiences, and this is a violation of my consumer rights and the FCRA. Pursuant to 15 USC 1681a ( 2 ) ( A ) ( i ), reported information can not be only transactions and experiences between the consumer, I, and a company, Credit Acceptance. A late payment is a transactional history. XXXX clearly states that the reporting of transactions or experiences between the CONSUMER and the PERSON making the report is not included on the consumer reports! These late payments are clearly a billing error. Take notice that I am aware that if a finance charge is involved then there should be no " late payments '' .I am also aware that a consumer must be given a chance to direct whether they want the information about the transaction to be reported or not. I was never given the opportunity to opt out of having this reported information about CREDIT ACCEPTANCE XXXX. Pursuant 15 U.S. Code 1666b ( a ), A creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose. Pursuant to 15 U.S. Code 1602 ( l ), a credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. I partook in a consumer credit transaction and my social security card was used to obtain property on credit, which is my right. If Credit Acceptance can not provide me with proof such as a tracking number or a certified mail return receipt bearing my wet signature that THEY adopted reasonable procedures to ensure my periodic statement was delivered to me no later than 21 days before the payment due date, these alleged late payments must be removed. Until the requested documentation is received, this request for documentation shall be treated as a billing error and an erroneously billed amount under section 1666 of title 15. Credit Acceptance, as the creditor, may not collect any disputed amount. As a federally protected consumer, the creditor can not restrict, accelerate payment, close an account and or make or threaten any adverse reporting to any person about the consumer 's credit standing without resolving the billing error. I am demanding the following late payments are UPDATED to PAID AS AGREED and a DELETION of each late payment is submitted to the credit reporting agencies immediately in order to prevent me from receiving more harm as a result of the fraud that has taken place. Also, do not add any more of my transactional history to my consumer reports.

XX/XX/2022 I talked to an employee that said they couldn't remove it off my account and stated, '' we have to make a pay arrangement on your account so that the call agency can stop calling your phone. " So, for these past couple months I have been getting calls every day from them and I'm tired of being harass, when I'm paying them every month on time.

It was without knowledge to transfer actual cash value from me, the alleged borrower, to the bank and return it to the alleged borrower as a loan. The banks intent was to receive cash value and return cash value as a loan. They also include interest charges on the transaction all funded by my signature. Consumer Complaint: Back in XXXX I purchased a vehicle with XXXX miles and at the time I didn't have the greatest credit so I was set up with Credit Acceptance. I was told they was okay and that they has handle many of there of clients for them in the past. In XX/XX/XXXX my car was repoed. Upon getting the car back I was told to make a payment of XXXX monthly for the next two years. Credit Acceptance agreed to letting me do my payments every two weeks {$300.00} which would make it $ 600 monthly. I then learned that I had 120+ missed payments from Credit Acceptance. When I call them they said I also have to make the monthly payment of {$390.00} also. I filled a dispute with Credit Acceptance and nothing was done. I also filled a dispute with the Attorney General office and they said since Credit Acceptance didn't respond they couldn't do anything. I currently owe over {$7000.00} and the vehicle is not working. These missed payments is hurting my credit.

Thank u Credit acceptance for stating in the response you sent through the CFPB on XX/XX/2022 that you halt ( cease ) all written collection efforts and telephone communications with me the consumer thank you again for providing me with evidence Credit acceptance you still in violation of federal law pursuant to 15 USC 1692a ( 2 ) Congress stated using any medium the three major credit bureaus are used as medium for communication so you are still in violation of the fair debt collection practices act you are still in communication with me through the three major credit bureaus pursuant to 15 USC 1681a ( d ) ( 1 ) consumer report is use for Communication remove this account from all three major credit bureaus immediately if not I will send my evidence and a Affidavit of Truth to you and to the MichiganDepartment ofAttorney General : Consumer Protection XXXX XXXX XXXX XXXX, MI XXXXand to the Consumer Financial Protection Bureau and to the FTC and to the Office of the Comptroller of the Currency and will bring lawful actions against your corporation for your nonfeasance act and defamation of character with a invoice. I will consult with my legal counsel for suit if need it.
