Consumer Complaint: On XX/XX/2022 I called the company to inquire about the status of my complain sent via online portal; was not addressed. I was then told that my car was out for repossession. I explained why and how my payments have gotten behind. I did request as for the same with every conversation that I need to be able to make smaller payments or refinance the loan. I did also request a coupon book be sent 3 weeks prior to repossession and it was not honored. I implied that I would like to make a payment via 1099A process and they refused to accept it. I have acquired a lawyer because of the breach of peace when the vehicle was repossessed. There is also another account that I have paid off and has not been removed from credit report and is still reporting with no balance owed. I was advised to contact the dealership to speak with them about payments and how can i rescind my signature to void out the contract. I was advised that they did not have any information and would not help me with this. now my last major concern is that I was informed 3-4 hours prior that i can pay 1 monthly payment and it will remove the repossession. By the time they came to pick up the vehicle the amount to pay is no {$1500.00} ; which is double the payment plus interest.

Consumer Complaint: I, the consumer, purchased a XXXX XXXX XXXX on XX/XX/XXXX with XXXX XXXX XXXX XXXX. I made a down payment of {$2800.00}. I paid {$400.00} for insurance before I could leave the car lot. I have been making payments in the amount of {$290.00} for the past XXXX months ( I have not missed a payment ). After learning of my consumer rights, I was not provided with the type of notice of my rights to recission under the Truth in Lending Act ( TILA ), 15 USC 1601et.Seq this is required by Federal Law. Upon reviewing my contract, obligations, and rights as a natural person operating in commerce, I noticed that there are several violations present which nullifies the contract pursuant to 12 CFR 1026.3 named Truth in Lending. Per the congressional finding of TILA as well as my due diligence, " It is the purpose of this subchapter to assure a meaningful disclosure of credit terms so that the consumer ( me ) will be able to compare more readily the various credit terms available to me and avoid the uniformed use of credit during the consummation of the contract. '' Furthermore, according to the Truth in Lending Act 15 USC 1605, my down payment and insurance should have been included in my finance charge, which is all I needed to complete the contract. There should NOT have been any cash exchange after the use of my social security number ( which is by law my credit card ), that constitutes as unauthorized use of a credit card once I entered into a consumer credit transaction. XXXX XXXX XXXX XXXX did not disclose my right to rescind. This being the case, pursuant to 15 USC 1635, I have the right to rescind my initial consent to pursue the terms of my contracts. I conclude this complaint with a demand for XXXX XXXX XXXX XXXX to return my initial down payment of {$2800.00} and all monthly cash payments totaling about {$11000.00} I have made since they have failed to mention that my finance charge was all I needed to complete the deal and that the cash payment was only of benefit to them. 15 USC 1635 ( b ) ( F ). I demand that XXXX XXXX XXXX XXXX return my down payment and other cash payments made within 20 days of this notice by law.

Under the laws of the state of TEXAS UCC 9.506 and State RISA and MVISA statues a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhere to. Please provide copies of the legal notices and proof of the commercially reasonable3 manner of the resale of the subject vehicle. If no such proof is provided within 14 days from receipt of this notice, the alleged claim of a deficiency will be considered null and void, and any continued activities, or continued reporting of this invalid claim on my credit reports will be considered a violation of the FDCPA and FCRA. In addition, if you singularly or severally fail to comply with the above requests, I reserve the right to seek damages against all parties, under all available State and Federal statues and UCC 9 REMEDIES. Also, Section 16.004 of Texas Civil Practice and Remedies Code, states ... .the statue of limitations on debt in Texas is four years. And this account is over 4 years old, so it must be removed.

Consumer Complaint: I brought a car from a dealer and I pay credit acceptance XXXX every month for that car. I have had the car for only 3 months. The transmission for the car is not good and my car is now in the shop. Before I put my car in the shop, I spoke to the person that sold me the car and she said it had warrant to contact credit acceptance. I spoke to a lady name XXXX from credit acceptance and she said they could help to just get a estimate for the car. Then crier acceptance calls back and says there no warrant with the it's only with the dealer. The dealer is not at the location I brought he car they closed down. The phone number I have for them she answers then hangs up. I have no car and credit acceptance is not trying to do anything to help. They just want me to keep paying them and I don't even have the car to drive which is messing up my credit if I don't pay them. I have ask credit acceptance to locate them or give me the number they have and it's the same number I have & the same number on XXXX. I just want somebody to help me because this is unfair for my first car I only drove it for 4 months transmission should be messed up so fast. I paid over XXXX already between the car insurance and putting money into the car. If I don't have the car I don't think I should be pay XXXX for 4 years with no vehicle.

Consumer Complaint: On XX/XX/2022, I contacted Credit Acceptance loan company concerning bank fraud/ procuring a loan fraudulently via XXXX XXXX XXXX For clarification, I was coaxed into sending paystubs to get a vehicle as a co-signer, although they were not accurate. The original primary person XXXX XXXX, was denied a loan due to his credit score, leaving him with no option but to bring someone else in. On the day of, at XXXX XXXX, XX/XX/2022, I informed the sales agent something was wrong with my work portal for my second income, and the dates were switched in our system and not displaying my check stubs. I emailed my employer while at dealership concerning the issue. I was then told to just submit what was on sight, by sales representative so they could get the vehicle to XXXX. I then informed them that the information was not accurate, and was told they would handle that. I expressed my disdain by objecting and walking out. I was then contacted by XXXX from XXXX at XXXX XXXX, for several days afterwards, for resigning loan papers and going with a different bank lender, and I declined involvement with the bank fraud. With the correct paystubs, my debt-to-income ratio would also be too high to be accepted for the loan. However, on XX/XX/2022 I was called to come in to speak with XXXX XXXX management team, XXXX XXXX, and XXXX in finance, managers. They told me a totally different story that the loan was not process due to a letter of residency needed a month ago by XXXX XXXX, and that they no longer wanted to do business with me or him, and to return the vehicle immediately, or they would issue a stolen vehicle BOLO. I was certainly under duress, because my freedom was at state. They then pressured me to find the vehicle and return it to the lot, or they would pursue Stolen Vehicle report, and would not stop until it was done. Later that evening, XXXX Police Department located the vehicle, but told XXXX whom was on the phone with me, that the dealership needed to file the police report to get back the vehicle, because I did not need to do it for my protection. I was then told by XXXX that he filed a Police Report with XXXX XXXX, XXXX Police Department, concerning the vehicle. However, on Sunday, XX/XX/2022, the vehicle was located and no such report was made, to repossess the vehicle, and on XX/XX/2022, XXXX XXXX from XXXX XXXX, called me to inform me that XXXX XXXX turned in the letter of residency, but overlooked the fraud issue. I then informed her that the deal was suppose to be off the table, per management, and what was she talking about? She advised me that she did not know about that. Once I was enlightened of the false claim of report to police and XXXX XXXX not honoring the fraud revelation, I declined to be involved any further with them and sought a higher authority to void this contract due to known fraud by the dealership. Furthermore, on XX/XX/2022 I received fraudulent documents concerning my electronic signature and initials. I did not sign up for that service nor gave authority to XXXX XXXX to sign without my knowledge to procure the loan. Electronic signature is still required by law to be given by signer not by dealership. These are fraudulent documents. Because I made the loan company and dealership aware of the issue within the three ( 3 ) day cancellation procedure, I am not and will not be held liable. In addition, I have attached the discrepancy with paystubs and email correspondence from that day proving my side. This gives grounds for automatic termination of the contract.
