Consumer Complaint: On XX/XX/XXXX I went to XXXX XXXX XXXX who is an affiliate of Credit Acceptance Corporation to inquire about a car loan. I was told that if tried for a loan there would be no impact on my credit as I have low credit and been a victim of identity theft. It was a lie as my credit went down XXXX points and got XXXX different inquiries on my credit for which was not advised that this will happen. Also the dealership kept adjusting the loan amount, the deposit amount and they even added a warranty without my consent as they claimed that it would get approved for a higher loan. I was pressured into the signing for the loan even though I was asking for questions about the loan which the dealership gave mixed messages, I also didn't feel comfortable electronically signing the loan as I wanted to write all right reserved, without prejudice and without recourse. I was left with no choice but to e-sign and I signed the acknowledgment of my e-signnature with all rights reserved without recourse and without prejusdice. I was never given any disclosure about the loan and about all my rights as a consumer, especially rights to rescind the contract, right to opt-out, all that by law is included in the finance charges and that no deposit is required for a loan as it should be part of finance charges. I was never given any information about the loan, terms, finance charges, my rights as a consumer. None of the information within the contract was explained to the and when asked questions the dealership didn't have any explanation. I was asked to give a down payment of {$4600.00} which I did in cash. After asking several times for a receipt I was never given a receipt. I left the dealership without a car and without a copy of the contract I had just sign. In fact to this day I do not have a copy of this contract that I signed. The loan was immediately assigned to Credit Acceptance Corporation when I signed for the loan. I was given the car on XX/XX/XXXX and shortly after the car started shacking and making noises. I took it to my mechanic and was told it has a faulty motor, needs XXXX rear tire, both rear wheel bearing, rear shock and balance for all rear tires, the front bumper is falling off. I was deceived into buying an unsafe, mechanically unsound and faulty car. I was deceived into signing a loan for which I didn't get a copy to review prior to signing, I was rushed through the process. I was taken advantage due to my credit situation and my need for a car and the dealership and Credit acceptance bank took advantage by selling an over priced car and having high interest rates. I have sent as of today XX/XX/XXXX my recession to the contract to Credit Acceptance Corporation as I was entered into there was fraud, deceptive, unfair and coercive actions that took place in the transaction. it is also worth mentioning that Credit Acceptance Corporation was sued by Massachusetts attorney general due to their deceptive and unfair business practice and other violations and a settlement was reached in XXXX

XXXX XXXX stated, '' For your reference, Ive attached a copy of the XX/XX/XXXX letter we sent you attaching your Retail Installment Contract, Declaration Acknowledging Electronic Signature Process, and payment history, as well as the notices we sent you during and after your vehicle was repossessed and sold at auction. I am requesting specific proof about the mailing of notices before and after sale. I have been REQUESTING THESE DOCUMENTS from day one, I have never received anything by mail during the appointed time that your company and attorney claimed you sent to the address : XXXX XXXX XXXX, XXXX, CT XXXX. XXXX XXXX stated that, on or about XX/XX/XXXX, A NOTICE OF REPOSSESSION/NOTICE OF RIGHT OF REDEMPTION and so on WAS SENT TO ME VIA USPS CERTIFIED MAIL WITH TRACKING NUMBER XXXX. If you take a look at that tracking info it is unrelated to this case or issue. I will attach. According repo Laws, XXXX XXXX Violated the FDCPA. In addition, XXXX XXXX claim that Credit Acceptance Corporation is not a " debt collector '' under the FAIR DEBT COLLECTION PRACTICES ACT, WHICH THAT IS FALSE. AS PURSUANT TO 15 USC 1692a ( 6 ) The term debt collector means any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another. Also, lets set the record straight my signature and initials is not any where on that alleged " contract '', I have been requesting an original contract with my wet signature. Like I said when I request information from your Counsel they state they only have copies. They cant show me anything original, how is that valid? You stated that your counsel send me documentation or correspondence through mail where is your proof of that? That's all hearsay. I will be taking this case to federal court with proof all violations of my federal consumer rights.

Consumer Complaint: I am Writing this compliant for two reasonings as I entered a consumer credit transaction, on XX/XX/XXXX with Credit Acceptance I realized back in XX/XX/XXXX, I was violated in a few ways, I'm listing here, As I said a consumer credit transaction, ( 1 ) rushed ( robo signing ) ( 2 ) no rescission documents of any kind ( 3 ) no mention of my right to rescind the agreement ( 4 ) 90321, title I, 101, XX/XX/XXXX, XXXX Stat. 146, provided that : Section 401 of title IV of Pu Consumer Credit Transaction does not include any payments in cash value ( 5 ) As stated, I entered a consumer credit transaction for XXXX XXXX XXXX XXXX XXXX on XX/XX/XXXX from XXXX XXXX XXXX XXXX of XXXX. At the time the company was doing business as XXXX XXXX XXXX XXXX XXXX. The vehicle purchase price was { {$15000.00} }, but the company added an optional gap contract { {$760.00} }, vehicle protection plan ( vpp ) { {$1300.00} }, Document preparation fee { {$96.00} } for state of MI, so the amount financed went up to { {$18000.00} }. The total cost was { {$34000.00} }, when I contacted the dealer to cancel the optional charges, they told me they can't do anything about it, and my only choice was to pay the loan on time for one year and then refinance it

Consumer Complaint: They are calling excessively- a minimum of five times daily. I have spoken to them and told them to call the primary person on the loan to discuss the late payments ( I am the cosigner ). They say they will, but then I will receive further calls from them that same day asking the same questions repeatedly. The people on the other end of the phone are rude, harassing, unreasonable, and persistent. I would like the phone calls to stop.

I also spoke to a lawyer who represents them, yesterday and my account is still showing as past due when my car was already repossessed and sold at an auction in XX/XX/XXXX. The representative advised me they aren't doing anything with my account and don't plan on making any changes to my account/ I never received the date, time, and place for the auction, or a phone number you can call for more information about the sale. I've requested numerous times for a break down of all charges and amount car was sold at auction for back in XXXX of XXXX. I haven't received any updated info from XXXX XXXX and I received disdain when calling to the law firm who works with Credit Acceptance.
